BOARD OF PUBLIC WORKS AND SAFETY OF THE . .
. CITY OF RICHMOND, INDIANA, MAY 26, 1983
1 - The Board of Public Works and Safety' of the City of Richmond, Indiana met
2 • in regular session May 26, 1983 at the hour of 9:00 a.m. in the Municipal.
3 Building in said City. Mr. Meredith presided with Mr. Webb and Mr. Cordell
4 , present. The following business. was had, to- wit:

6 APPROVAL OF MINUTES OF MAY. 19, 1983 .

8 Mr. Cordell moved the minutes of May 19 be approved as prepared and placed on
9 file, seconded by Mr. Webb and on' unanimous voice vote the motion was carried.

11 REQUEST FOR SHRINE PARADE - Wagner

13 Roy Wagner, Parade Marshal, 533 Richmond.Av. , presented the Board wi.th. invitations
14 to participate in the 20th.Annual Shrine Day.. . 'The requested date is Saturday,
15 • August 13, the parade to assemble at 1.:.00 p.m. and move out.. at. 2:00 p..m. and. the
16 route will be.the same as in the past. He reminded .that the parade -is a Shrine
17 func:tion. and as .usual, is not a political .function, but as always, they do have
18 the .mayor as the head of the city.

20 Mr.. Webb moved for the approval of the annual Shrine Day Parade for. August-13,
. 21 1983, starting, with the assembly at 1 :00 p.m. and the parade at. 2:00 p..m.',
22 seconded by.Mr. Cordell and on.unanimous voice vote the motion was carried.

24- REQUEST FOR BLOCK PARTY - Glennen' . .

26 Tom Glennen, 1700 Idlewild R. , appeared to request the blocking off of Mikan
27 Drive & Idlewild and Capri and Idlewild this Sunday, May 29th from 9:45 a.m.
28 to dusk for their'.annual. block party.

30 Mr. Cordell moved .the. request f.or.the 'block party on Idlewild Drive be approved
31 from 9:45 a.m. -to dusk -on May, . 29, 1983, seconded:by Mr. Webb and on unanimous
32 voice vote the motion was carr.ied.. , .

II34 SET DATE FOR UNSAFE BUILDING HEARING - Roberts

36 Building. . Commi.gs:taner Charles Roberts requested the date of June 23 for a
• 37 - hearing 'on the unsafe building at 1516 South 4th Street, at 10:00 a.m.

39 City Controller Don Meredith set June 23'at 10:00 a.m. for the hearing.

43 Mr.' Roberts reported the former tenants are now. living at .61 .N. W. "H". The
44 owner: has. contacted Mr. Roberts, and will meet all the codes.. .- He has done some
45 cleanup and Mr. Roberts is satisfied it will be brought up to code.

47 Mr. Webb moved that whereas, on March 31, 1983 .the Board of.Public Works and
48 Safety found .#24 .River Court to be an unsafe building; and; on March 31, 1983
49 the Board issued an order for the repair of. said_ b.uilding to meet code standards
50 within thirty (30) -days; and whereas, said property was not vacated until May 11'
51 per a Superior Court III order; and whereas, the time has now expired on said
52 original order; ' now, therefore; 'the Board of Public Works still finds the build-
. 53 . ing to be unsafe and extends its original order to ..thirty (30) days from the re-
54 ,ceipt of. the notice of this order. Mr. Cordell seconded the motion and on
55 unanimous voice vote the motion was 'carried.

59 Mr. Meredith set Thursday; June 16 at 9:30 a.m. to hear the complaint on Donald
60 Elli,s.on at 1516 So. 4th Street.

62 ENGINEERING SERVICE CONTRACT, N. W,. llth - Webb

64 .City Engineer George Webb reported that in conjunction with the reconstruction
- 65 at N. .W. 11th St. , we propose to enter into an agreement with Jacobs-Maze,
66 Associates to prepare the specifications and make the necessary drawing changes
67 to implement bidding and construction of the street. The engineering department
68 will,.do. the construction engineering. We are requesting Jacobs-Maze because -
69 they did the design engineering on a grant of the Economic Growth Group. They
70 are the best qualified to complete the specifications and drawing changes.

1 City Attorney Ed Anderson has reviewed a copy of the agreement and finds it
2 in order.

4 Mr. Webb said the total sum of the contract is $1900. and the grant .money has
5 been approved.

7 Mr. Webb moved the Board of Works enter .into_ an agreement with Jacobs-Maze,
8 Associates for the. preparation of .specifications and .drawing changes for the
9 N. W. 11th Street project between N. W. "L" Street and Rich Road, Richmond,
10 Indiana, seconded by Mr. Cordell and on unanimous voice vote the motion was
11 carried.

17 RECONVENED - Public Hearing 'on Sale of Property •
18
19 Mr. Meredith reconvened the Board of Works meeting at 10:00 a.m. for a hearing •
20 on the sale of public property, stating that the laws which govern the sale
21 have changed somewhat since the last public sale.

23 City Attorney Ed Anderson read the following statute:

25 . Disposal of real property .under this chapter is subject to the approval
26 'of: (1) the executive of the political subdivision or agency; or
27 (2) the fiscal body of the political subdivision or agency, if there
28 is no executive. The executive may not approve a disposal of property •
29 without conducting a public hearing after giving notice under IC 5-3-1.
30 However, in a municipality the executive shall designate a board or
31 ' commission of the municipality to give notice, conduct the hearing,
32 and notify the executive of its recommendation.

34 This- hearing is being conducted pursuant to 36-1-11-3 as the .Mayor has .desig-
35 nated the Board of Works to conduct such a hearing and to notify him of its_
36 recommendation, and Mr. Anderson finds the hearing was advertised pursuant to
' 37 IC 5-3-1, and finds it in order.

39 Mr. Webb moved the notice be accepted; placed On file, seconded by Mr. Cordell
40 and on unanimous voice vote the motion was carried.

42 Mr. .Webb stated .that in September of 1981, SPUR wrote regarding certain lands
43 along the river, including lands owned .by the' city. At that time, he looked
44 . into deed records deeding it to the city. Only one description defined any
45 particular property.

47 A memo' to SPUR requested if they were interested in the land that they obtain
48 the services.of, an abstract company to determine ownership. . Except for one
49 property,. he did not know of one containing a "meets and bounds" description
50 covering land that were owned by the First National Bank.

52 Mr. Webb read from the legal ad: " Also, all that portion of Official Map
53 Tracts of said City or other unplatted lands located between the west line of
54 North Seventeenth Street and same extended north and North Twelfth Street of
55 the Middleboro Pike, and between North J Street and the New Paris Pike, which
56 is now owned by said Grantor".

58 The undescribed lands in the deed are undetermined. The described land is
59 marked on the plat as "owned by city".

61 City Attorney Anderson asked if the land as described in the published notice
62 and the deed is more extensive than was vacated. He suggested the city see
63 what they can sell. ,

65 City., Engineer Webb said the land we ,ae; talking about is the land. between
66 New Paris Pike, North "J" and North 17th and North 12th.

1 Lucille McCreary, .937 North 12th St. , representing Lucille Myers, appeared
2 to inquire about the sale of the land, but was informed the section she desires
3 is not included in this description.

5 Richard .L. Hamm, 2266 Walnut Lane, appeared to indicate his interest in the
• 6 disposition.

II/ 8 Ed Parrish, 52. South 18th St.. , voiced disagreement with selling- any of the
9 land except _that which ,Mr.. Hamm wants. ,. He stated there is a bridge between
10 12th and 24th which the.County Engineer stated is in good condition. There
11 are sewers through the area and part of the area is""unknown boundaries".
12 The remains of an historic area are also there.

14 City Attorney Anderson is to check the legality of selling a bridge.

16 Mr. Webb recommended continuing the hearing inasmuch as there seems to be a
17 lot of interest generated. '

19 Mt. Cordell moved .to continue the hearing to a later date, seconded by Mr. Webb
20 and on .unanimous voice vote the motion was carried.
