HomeMy Public PortalAbout04-28-1983 • /• • BOARD OF ,PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, APRIL 28, 1983 • 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session April 28, 1983 at the hour Of 9:00' a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Cordell and Mr. Webb ' 6 . present. The following) business was .had, to-wit: ' 5 6 APPROVAL OF MINUTES OF APRIL 21, 1983. ' ' III 7 8 Mr. Cordell moved to approve the minutes of April 21, 1983 as prepared, seconded 9 by Mr. ,Webb and on unanimous voice vote the motion. was carried. 10 11 REQUEST TO PLACE BLACK WROUGHT IRON HORSE HEAD - Russell Conway 12 13 Mr. Russell Conway, 410 No: 22nd Street, requested permission to set an ornamental 14 horse head on a 3" post about '4' high between the curb line and the sidewalk. 15 Traffic Capt. Dan Wogoman stated there is no' problem 'as far as traffic is concerned. 16 17 Mr. Webb moved to give Mr. Conway permission to put a hitching post 2' back from 18 the curb .at 410 North 22nd STreet, seconded' by Mr. Cordell and on unanimous voice 19 vote the motion was carried. . 20 21 REQUEST FOR RUN FOR YOUR LIFE ROAD RUN - Larry Spurgeon 22 ' 23 Mr. Larry Spurgeon, 1400 Shamrock Ct. , requested permission for a RUN FOR YOUR 24 LIFE road run using the same course as last year.. It •is a 6.2 mile or 10 kilo- 25 meter race to be held . May 15 at 8:00 a.m and should be over by 9:15 a.m. This 26 is not a fund raiser and. last year. Life Underwriters. made a profit of- $1.99: ' 27 The entry fee covers giving entrants a shirt and refreshments'. The race is held 28.. for -the benefit of the runners. There were 89 'runners last yearend they expect .29 over 100 this year. Mr.'_:Webb noted the City Attorney has examined the form,which 30 includes a, hold harmless clause. :Mr. .Meredith noted`they do not need insurance. 31 Capt. Wogoman stated _ther•e,,is no traffic problem. Mr. Spurgeon stated there III32 would' be-civilians with flags to help with traffic.. - Mr. Meredith warned about 33 the use of flags for traffic by. civilians being dangerous to both vehicles and 34 runners. 35 - , 36 Mr. Webb moved that RUN FOR.YOUR LIFE II on.May 14, 1983 at, 8:00 a.m:, be approved 37 • as presented, seconded. by Mr. Cordell and on unanimous voice vote the motion was 38 carried.' 39 ' 40 REQUEST 'FOR PAPER AIRPLANE THROWING CONTEST FROM PARKING GARAGE DURING ROSE 41 FESTIVAL -- Beverly Nixon & Loren Vance '(June 23, 7 :00 p.m.) 42 . ` 43 Mr. Loren Vance requested use of the parking garage for a paper airplane contest 44 throwing from the south side of the building. There is a cut out place over the ' 45 ' north-south 'alley. . Ms. Nixon noted the 'youngest age group will be 7 or 8. Mr. 46 Cordell noted a concern with traffic in the garage area. Ms. Nixon noted the 47 only vendors' on the Promenade during the' festival• will '...be not-for-profit local '48 vendors and crafters. They requested blocking the north-south -and east-west .49 alleys. Following discussion on handling the' crowd, Mr. Vance 'suggested it ' 50 might be better to register entrants at a different location and take different 51 age groups up individually. It was noted there have been a number of problems 52 with kids throwing things off the parking garage and this 'contest might encourage 53 that type' activity.' Mr. Cordell noted it would be difficiilt; to close off the 54 alley to. the public who are parked in the- garage as they would not be' able.to 55 exit. It was suggested Mr. Vance and Ms. Nixon meet with Mr. Bill Davis, Ms. Helen 56 Fackson and Mr. Cordell- to !work out details. . Mr. Meredith stated he was taking .` III57 this request under advisement and continuing it to 'next week:. 58 . . 59 REPORT, ON- UNSAFE. BUILDING ON RIVER. COURT. - Charles Roberts 60 , 61 Building Commissioner Charles Roberts, noted the property owners. at 24 River Court 62 are trying. to abide by 'the 'ordinance as the tenants- were 'supposed to be out today; 63 however, Judge Holtsclaw gave- them until May 3-to-get .out. The Housing Authority 64 refuses to place them in any home. The tenants consist of a man,. his wife and 4 65 children. Under the court order they are to be out by May 3:.. •' Mr, Meredith sug- 66 gestedthe Board continue the matter to -concur with the court order. Mr. Webb so 67 moved, seconded by. April 28, 1983 Page 2 , 1 CURB CUT REQUEST FOR D&J TRAILER SALES - George Webb • 3 Mr. Webb presented a request for a driveway on Industries: Road by D&J Trailer 4 Sales. The request has been checked by Traffic, Engineering and Planning De- ; 5 partments. 6 7 Mr. Webb moved that the driveway petition`.of -:D.&J• Trailer Sales for .one (1) 8 driveway on Industries Road be approved, ,seconded by Mr.• Cordell and on unanimous 9 voice .vote the motion was carried. ,, • 10 11 REPORT ON NUISANCE AT':1326 RIDGE STREET - Dennis Bronston 12 13 Mr. Meredith conducted the hearing in the absence of. City Attorney Ed Anderson. 14 Mr. Bronston reported he was at 1326..Ridge-.Street.y-esterday. afternoon and the 15 nuisance does still' exist. He talked with the owner of the property and she was - 16 to be here today. His recommendation' to the Board is to cause this to be removed • 17 within 30 days. The stock car has been removed; however; the Chevy still exists. • 18 It was noted by the minutes that the hearing had 'been continued until today. 19 • 20 Mr. Webb moved that there is a nuisance .at 1326 'Ridge Street and that the owner of 21 the nuisance be given thirty (30) days to remove same and,.. if nuisance is not 22 removed, that the city remove the:nuisance, seconded by Mr. Cordell and on voice 23 vote the: motion was carried. Mr. Meredith did not vote as he was conducting the 24 hearing. 25 26 NUISANCE HEARING FOR 605 SOUTH 12TH .STREET . 27 28 Mr. Meredith conducted the hearing noting Ellis Armstead. was not.: present. He 29 noted the registered letter was returned as-.refused..which does serve as. no.tine 30 having been served.,. He presented 'the' returned :registered letter unopened. Mr. . 31 Bronston noted Ellis Armstead is- the contractual .owner of the property, but is 32 not the owner of. .record. . He noted the owner is Elijah & Tracey Fultz. The 33 Treasurer's office has three (3) different addresses, - one of which is 1413 South 34 5th. • He' stated he thinks the owner of the-nuisance .is Ellis Armstead. Mr. 35 Webb noted the laO has put more responsibility ,on: buyers. on contract. . • 36 37 Mr. Webb recommended this be taken under advisement to seek legal counsel in 38 regard to providing what action should be taken. 39 40 Mr. Meredith noted he is continuing the hearing until this can be resolved. 41 42 NUISANCE HEARING FOR.1414 HOLSAPPLE 43 _ 44 Mrs. Roger (Antonette) Thomas, 289 Snyder Lane, was present. She did receive 45 notice of the hearing, does understand the notice and does own the property. 46 Mr. Bronston stated the property has been a source of numerous complaints in- 47 . the storage of inoperable':vehicles and car parts. - This complaint was filed on 48 two (2) vehicles which do not have engines. Mrs. Thomas stated she was told 49 they are putting an engine in one of the vehicles and the other was to have been 50 towed away last night. Mr. Bronston noted both were still there yesterday 51 afternoon and both appeared to be inoperable. Mrs. Thomas agreed there is. a 52 complaint there. She noted one of the vehicles was licensed; however, she did 53 not know if it had an' 83 sticker. She was told it is still a nuisance if it 54 has been there for a while and is not operable. Mr. Bronston stated he sent a 55 notice at least two (2) months ago: 'He sent a form letter to the resident and 56 got no response, so he filed a formal complaint. Mrs. Thomas stated she doesn't 57 feel the owner can take the cars as they are not her' cars but are on her property. 58 The tenant is Rudy Sparks. Mrs. Thomas said she talked to Dan Dooley yesterday 59 and was told the City would tow the cars. She requested an extension of time. 60 61 Mr. Cordell moved that a nuisance does exist at 1414 Holsapple Road and give 62 thirty (30) days to remove this nuisance at .which time the city will remove 'said 63 nuisance, seconded by Mr. Webb and on voice vote the motion carried.
