RE: Septic System Replacement Project

Conservation Commission Members,
On behalf the applicant, Norman A. Sylvia, Marsh Matters Environmental (MME) submits the enclosed
Request for Determination of Applicability (RDA)(WPA Form 1) with proposed project plans, existing
conditions photographs, and required administrative documents proposing the replacement of an on-site
sewage disposal system serving a single-family residence on property located at 268 Slough Road in
Brewster (see Figures 1, 2, and 3 in Attachment 1). The existing leach pit and tank will be removed and
replaced with a new tank and soil absorption system (see project plan set in Attachment 2). While all
work will be located within the one-hundred-foot buffer zone to a Bordering Vegetated Wetland (310
CMR 10.55), all work will be confined to an existing lawn area between the residence and roadway and no
vegetation in the buffer zone will be disturbed. The project meets the BVW performance standards, and
no project activity will occur within fifty feet of the wetland boundary. Please accept this cover letter as
the project narrative describing project aspects. The enclosed proposed project site plan set by
Engineering Works, Inc. (dated 7.27.2021) provides all additional project details.
MME files this NOI pursuant to the Massachusetts Wetlands Protection Act (MWPA)(M.G.L. c. 131 §40)
and the Town of Brewster Wetlands Protection By-law (§172-1), and in accordance with the implementing
MWPA Regulations (310 CMR 10.00), the Brewster Wetland Regulations, and the town’s Request for
Determination of Applicability Filing Checklist. MME attests that it will notify property abutters of this
application and of the September 14, 2021, public hearing in accordance with state and local
requirements. The $110 RDA filing fee is enclosed.

Project Narrative
Site
The existing developed lot at 24 Capt. Dunbar Road is comprised of 9,778 sq.ft with an existing
dwelling built in 1966, partially located within the 100’ buffer to the Top of Coastal Dune. The top
of Dune is located across the sand/gravel driving path of Capt. Dunbar Road. Please see the
locus map attached for the exact location. The existing plot of land includes the dwelling, turf
grass and scrub vegetation. Capt. Dunbar Road is generally a sandy path for driveway
access, parking and general pedestrian use for access to Ellis Landing.
The Proposed Work
The applicant proposes to renovate the existing dwelling and add a partial second floor
space above the existing dwelling. In recent years, the existing structure has deteriorated to a
state of disrepair. Siding, roofing, chimney and decked areas have extensive rot and safety
concerns. The existing dwelling will be renovated to a code compliant structural level. The
structural members of the exterior walls, floors, partial roof areas and foundation will
remain. Areas of rot and/or non-compliance structural items will be replaced as required.
The proposed renovation and addition will not increase the footprint of the structure. The
existing screened in porch will be removed because of rot and insufficient load capacity of
the existing sonotubes. The new screened in porch will be built on the exact footprint and
include new concrete filled sonotubes at a similar placement to the original. This work will
include limited/minimal point load excavation.
Utilities
The existing septic system shall remain and continue in service. The existing water main
will also remain.
Site Amenities and Process
A work limit has been placed at the property edge adjacent to Capt. Dunbar on the north
side. The disturbed area of the site shall be restored with coastal hardy plants and shrubs in
order to return the area to a stable and vegetated condition. Should a landscape plan be
required, the applicant will provide one. The applicant intends to place a riprap/boulder
retaining wall along the northern edge of the property adjacent to Capt. Dunbar Road to
stabilize existing soils. See the site plan for proposed retainage location.
Proposed Mitigation
Areas between the north facing elevation and the property line (within in the 50’ buffer) will
be planted with grass/turf, native shrubs/plants and three trees selected from the Cape Cod
Cooperative Extension planting list. The three trees will be located on the property to replace

the three cedar trees that were previously removed. A planting plan can be provide if
required.
Wetlands Protection Act interests as related to Coastal Dunes
Any alteration of, or structure on, a coastal dune or within 100 feet of a coastal dune shall not have
an adverse effect on the coastal dune by:
1.) Affecting the ability of waves to remove sand from the dune:
a. The existing developed lot with the existing dwelling built in 1966 is located landward of
Cape Cod Bay, stone revetment, multiple developed lots and structures and across the
sand/gravel driving path of Captain Dunbar Road. With minimal change to the site, the
overall affect sand removal by wave will remain unchanged.
2.) Disturbing the vegetative cover so as to destabilize the dune:
a. The minor areas of disturbed site shall be restored with coastal hardy plants and
shrubs in order to improve the stabilization and vegetated condition. Should a
landscape plan be required the applicant will provide one. The applicants intend to
place a riprap/boulder retaining wall along the northern edge of the property
adjacent to Capt. Dunbar Road to stabilize existing soils.
3.) Causing any modification of the dune form that would increase the potential for storm or
flood damage:
a. With no new foundations or substantial excavation on the site, the dune form will
remain unchanged.
4.) Interfering with the landward or lateral movement of the dune;
a. With no new foundations or substantial excavation on the site, the dune form will
remain unchanged.
5.) Causing removal of sand from the dune artificially;
a. With no new foundations or substantial excavation on the site, the dune form will
remain unchanged.
6.) Interfering with mapped or otherwise identified bird nesting habitat;
a. No nesting habitat located on site
Additional Bylaw interests
1.) Public Water Supply – No significant relationship to this project

3.) Groundwater and Groundwater Quality – not affected by the activity
4.) Fisheries – No significant relationship to this project

8.) Flood control. The work area is landward of and above the 100 year coastal flood
zone and within 50 ft. of the Top of Coastal Dune. The work area shall be limited by
sediment barriers as described in the Notice and maintained to keep activity from
the bank and functional dune area across the street.
9.) Erosion and sedimentation control. Properly installed work limits will effectively
quell the wind. There will be no major excavation on the project. Minor sonotube
locations and a window well will be dug by hand and filled with efficiency.
10.) Storm damage prevention. The existing stone revetment, multiple homes and

developed land, the existing dune, Capt. Dunbar Road and the sediment control
barrier all act as protection against storm damage prevention towards the bay.
11.) Wildlife – With no major excavation, there will be no displacement of practical
habitat.
12.) Aesthetics/Condition – The existing structure has deteriorated to a state of
disrepair. Siding, roofing, chimney and decked areas have extensive rot and safety
concerns. The renovation project will increase the quality and material standard for
decades to come. The addition and exterior detailing work with and mimic the
local beach cottage community.
Alternatives Summary
The project objectives are to provide a habitable living space that is safe, healthy and sustainable
for many future family generations. The usability of the space is predicated on an overall dwelling
improvement and to provide additional interior floor space.
1.) Alternate #1: Maintain the existing structure as is:
a. The quality and safety of the existing structure had come into question. Exterior
siding, roofing, chimney and decked areas have extensive rot. Continual
roof/chimney water infiltration left portions of the first floor “soft” and rotted out.
Standing water had appeared in the lower level on multiple occasions during
periods of rain. The moisture was followed by areas of mold and further rot.
b. The solution to maintaining the existing structure would result in a similar
renovation process to update the structure to a safe and code compliant level,
remediate rot and mold and update the mechanical systems.
c. This solution would not satisfy the objective for added interior floor place.
2.) Alternative #2: Remove the existing structure and rebuild a new home:
a. The process of full demolition to the existing structure would create
i. Zoning dimensional conflicts and required approvals
ii. Challenges with Old King’s Highway/Historic Review
iii. Further soil/land disturbance with revised septic components
iv. Extensive excavation/demolition of the existing foundation system.
b. The process of constructing a new home on this lot will be exponentially more
invasive and disruptive to the lot, neighborhood and potentially the coastal dune in
close proximity.

Dear Brewster Conservation Commissioners:
We request you vote for the approval for a Certificate of Compliance for the Holtman residence 5 Carson Way. –
Brewster, MA 02631 (SE9-1749) to:
(1) limited pruning along the existing path to Canoe Pond, including an overhanging branch from a Black Oak
(2) removal and replacement of invasive species, …namely Black Locust. There is also proposed mitigation to
compensate for invasive removal. (Service berries)
(3) installation of kayak rack in the easement area;
(4) Limited control of the existing Poison Ivy around the location of the Kayak rack
Since: (1) all major work was performed; and (2) the existing vegetation was pruned to accord of the OOC; (3)
kayak rack was built, we seek a certificate of compliance. This project serves as an example of well-conceived
collaborative idea that fulfills the permit’s goals. The resulting project’s footprint matches the proposed layout with
no major changes and, therefore, this property is one of sustainable completion.
Please vote on this COC request at your next meeting.
