HomeMy Public PortalAbout09-16-1982 9f5- BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 16, 1982 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session September 16, 1982 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Cordell present. Mr. Webb 4 was on vacation. The following business was had, to-wit: 5 6 APPROVAL OF MINUTES OF SEPTEMBER 9, 1982 7 8 Mr. Cordell moved to approve the minutes of September 9, 1982 as prepared, 9 seconded by Mr. Meredith and on unanimous voice vote the motion was carried. III 1'0 11 RECKLESS DRIVING IN HIGH SCHOOL AREA - Donna Hardin 12 13 Ms. Cathy Sweet, 317 S. W. "D" and Ms. Donna Hardin, 438 S. W. 3rd, told the 14 Board of excessive speeding and reckless driving in their neighborhood before, 15 after and during school hours. They noted disregard of school busses while 16 loading and unloading children. They have approximately 460 names on a 17 petition circulated through the neighborhood. They requested Board members 18 attend a meeting at 7:00 p.m. this evening in Common Council chambers. They 19 requested stepped up police patrol and stricter law enforcement. 20 21 USE OF FIRE TRUCK FOR FOOTBALL GAME ON SEPTEMBER 17, 1982 - Chief Mullin 22 23 Fire Chief Paul Mullin stated he has a request from the high school for a fire 24 truck before the Richmond-New Castle game this Friday night to take Booster 25 Club members and the cheerleaders around the track. He recommended use of the 26 aerial truck to "fire up the crowd". 27 28 Mr. Meredith moved for approval of the use of the fire truck at the football 29 game to fire up the fans, seconded by Mr. Cordell and on unanimous voice vote 30 the motion was carried. 31 32 POLICE RESIGNATIONS 33 34 Larry Walton 35 36 Major Ron Chesnut read a letter from Chief Charles Chris recommending acceptance 37 of Officer Larry L. Walton's resignation from the Richmond Police Department 38 effective September 20, 1982. 39 40 Mr. Meredith moved to accept the resignation of Larry Walton from the Police 41 Department effective September 20, 1982, seconded by Mr. Cordell and on unanimous 42 voice vote the motion was carried. 43 44 Rebecca Caudill 45 46 Major Chesnut read a letter from Chief Chris recommending acceptance of Rebecca 47 J. Caudill's resignation from the Richmond Police Department effective September 48 3o, 1982. 49 50 Mr. Meredith moved for acceptance of Rebecca J. Caudill's resignation effective 51 September 30, 1982, seconded by Mr. Cordell and on unanimous voice vote the motion 52 was carried. 53 54 SET DATE FOR ELECTION OF NOMINATION-ELECTION COMMITTEE FOR POLICE MERIT 55 COMMISSION 56 111 57 Mr. Meredith noted that under Ordinance No. 3187-1977, which deals with the 58 Merit Commission, police officers. have a nomination and election committee 59 that nominate and elect candidates for the Merit Commission. This Board runs 60 the election to elect officers to be on this committee; therefore, he set 61 from 2;30 p.m. Friday, October 15, 1982 to 3:30 a.m. Saturday, October 16, 1982 62 for that election. Any officer interested in filing a notice of candidacy must 63 do so before the closing date of October 1 at 4:00 p.m. Board of Works Minutes Cont'd. September 16, 1982 Page 2 1 WEIGHTS & MEASURES REPORT FOR JULY AND AUGUST 2 3 The Board received a copy of the Weights & Measures report for July and August. 4 5 Mr. Meredith moved the report be approved and filed, seconded by Mr. Cordell 6 and on unanimous voice vote the motion was carried. 7 8 RECESS 9 10 The Board was recessed until 10:00 a.m. 11 12 JUNK VEHICLE HEARINGS 13 14 City Attorney Ed Anderson conducted the hearings noting the hearings are con- 15 ducted under Ordinance No. 16-1978 regarding storage of inoperable machinery, 16 motor vehicles, junk vehicles and parts of machinery. 17 18 1613 South 4th Street 19 20 A complaint was filed and notice of this hearing was served by certified mail to 21 William acid Lula Mae Sutherland. The Defendants were not present. A certified 22 receipt was presented. The Ordinance provides the hearing can be held without 23 their being present under Section 4. 24 25 Mr. Dennis Bronston of the Plan Department filed the complaint and noted he sent 26 a letter to the owner of the inoperable vehicle on July 1, 1982 informing him the 27 nuisance did exist on his property. He has had conversation with Mr. Sutherland 28 but the nuisance was not removed. He presented photographs taken yesterday 29 morning of the nuisance. He noted the vehicle is in an inoperable condition 30 as it does not have an engine. 31 32 Mr. Anderson pointed out that the Board must determine if a nuisance exists, 33 should it be removed and when should it be removed. The property is not a 34 licensed business to store vehicles and not zoned for the storage of vehicles. 35 36 Mr. Meredith moved the Board does find a nuisance existing on the property 37 located at 1613 South 4th and that the nuisance be caused to be removed, 38 seconded by Mr. Cordell and on unanimous voice vote the motion was carried. 39 40 1617 South 4th 41 42 Mr. Bronston requested withdrawal of this complaint as the vehicle has been 43 removed and the nuisance no longer exists. 44 45 Mr. Meredith moved that the complaint at 1617 South 4th be withdrawn, seconded 46 by Mr. Cordell and on unanimous voice vote the motion was carried. 47 48 315 South 9th 49 50 A complaint was filed and notice of this hearing was served by certified mail 51 to Wilbur Perkins. The Defendant was not present. A certified receipt was 52 presented. The hearing will be held in his absence. 53 54 Mr. Bronston stated he has received numerous complaints in reference to a van 55 at the rear of the property. There was a family living in the van. He contacted 56 the people living in the van and told them they were in violation of several 57 ordinances, among them maintaining an inoperable vehicle. The van is still in 58 the same location and .does not have a license. He talked with Mr. Perkins, 59 who does not live at this address and he has authorized the people to use 60 this property. He presented pictures taken yesterday morning showing the 61 nuisance still exists. 62 63 Mr. Meredith moved that the Board finds a nuisance exists at 315 South 9th and 64 cause it to be removed, seconded by Mr. Cordell and on unanimous voice vote the 65 motion was carried. 97 Board of Works Minutes Cont'd. September 16, 1982 Page 3 1 222 South 10th Street 2 3 A complaint was filed and notice of this hearing was served by certified mail 4 to John Satterfield and receipt was acknowledged. The Defendant was not present. 5 The hearing will be held in his absence. 6 7 Mr. Bronston stated he sent a letter to 222 South 10th on May 11 , 1982 informing 8 them of inoperable vehicles and machinery being stored. There were two (2) 9 inoperable vehicles but now there is just one (1) . The resident is not the owner. 10 Mr. Satterfield is the owner and he has told the resident he would like the 11 nuisance removed. He presented a picture taken yesterday morning showing the 12 nuisance still exists. 13 14 Mr. Meredith moved that the Board find a nuisance exists at 222 South 10th 15 Street consisting of one (1) inoperable vehicle and bicycle and parts and that 16 it be caused to be removed, seconded by Mr. Cordell and on unanimous voice 17 vote the motion was carried. 18 19 1516 South 4th Street 20 21 A complaint was filed and notice of this hearing was served by certified mail 22 to Donald Ellison for three (3) inoperable vehicles. Mr. Max Ellison, 712 23 So. "N", was present and asked to represent his brother, who is working. 24 Mr. Ellison stated the three (3) vehicles are International Carryalls. One has 25 been wrecked and is being used for parts. The other two (2) are operable. He 26 stated everything else has been hauled away. 27 28 Mr. Bronston stated he sent a letter on July 1 in reference to the storage of 29 inoperable vehicles. He noted none of the vehicles had license plates. He has 30 received complaints from the neighbors saying they are inoperable and being 31 stored there. He presented pictures taken yesterday morning showing a new 32 vehicle in the picture that is plainly inoperable but not a part of the complaint. 33 34 Mr. Ellison noted from the pictures the vehicles which had been removed and 35 stated the remaining vehicles are all operable. Mr. Bronston stated if the 36 vehicles are operable and that could be demonstrated to him, he will be willing 37 to withdraw the complaint. Mr. Ellison stated his brother will cooperate at 38 any time. Mrs. Dorcil Shehan, 1229 Parry Street, stated she removed the Cadillac 39 and debris to the Recycling Center yesterday and there were only two (2) Inter- 40 nationals left. Mr. Bronston stated he would be satisfied if the vehicles are 41 licensed and used, so they would be moved. Mr. Ellison requested an acceptable 42 time to remove the vehicles. Mr. Meredith suggested two (2) weeks and Mr. 43 Ellison agreed. 44 45 Mr. Meredith moved that the Board find a nuisance exists in the form of two (2) 46 inoperable vehicles at 1516 South 4th and, if they are not made operable, removed 47 from the premises at the end of two (2) weeks that they be caused to be removed, 48 seconded by Mr. Cordell and on unanimous voice vote the motion was carried. 49 50 712 South "N" 51 52 A complaint was filed and notice of this hearing was served by certified mail 53 to Max Ellison for four (4) inoperable vehicles and receipt was acknowledged. 54 Mr. Ellison was present. 55 56 Mr. Bronston stated for the past year or so he has received a complaint from a 57 City Councilman concerning this nuisance. He went by the property this morning 58 and two (2) of the vehicles have been removed. The two (2) remaining are 59 licensed; however, they have been maintained at that specific location for 60 quite a period of time and he would like proof that they are operable. The 61 Gas Company was working there this morning and he was unable to take a photograph. 62 63 Mr. Ellison stated all the vehicles are operable and have been moved today. 64 Mr. Ellison stated he leaves the cars parked there to deter employees from 65 Kemper Cabinet from gathering there during their lunch hours. Mr. Anderson asked if the Board will 3 accept the request to withdraw. 4 5 Mr. Meredith so moved, seconded by Mr. Cordell and on unanimous voice vote 6 the motion was carried. 7 8 Mr. Anderson stated this concludes the hearings. 9 10 ADJOURNMENT 11 12 There being no further business the meeting was adjourned. 13 14 Donald E.
