A CAPITAL PROJECT AUTHORIZING RESOLUTION OF
THE VILLAGE COUNCIL OF THE VILLAGE OF KEY
BISCAYNE, FLORIDA; PROVIDING FOR THE
ACQUISITION OF SIXTEEN (16) SELF CONTAINED
BREATHING APPARATUS (SCBA) FOR THE FIRE RESCUE
DEPARTMENT FROM DRAEGER SAFETY INC.;
AUTHORIZING THE VILLAGE MANAGER TO
IMPLEMENT THIS TRANSACTION; PROVIDING FOR A
WAIVER OF COMPETITIVE BIDDING; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Fire Rescue Department (the "Department") has a critical need to purchase
sixteen (16) new Self Contained Breathing Apparatus (SCBA) which are essential to the mission of
the Department to replace discontinued and non -compliant SCBA units; and
WHEREAS, these older models of SCBA units have been routinely used by the Department
during fire, medical and other hazardous situations and the current SCBA units comply with previous
safety standards; and
WHEREAS, Draeger Safety Inc., is the sole provider of the SCBA units which were
previously acquired by the City of Miami after a sole source funding process, and the operating and
maintenance software for the system is proprietary to said company; and
WHEREAS, the Department, as a result of the Automatic Aid and Ancillary Services
Agreement with the City of Miami, relies solely on the use of these SCBA packs and the Air
Program provided by the City of Miami; and
WHEREAS, the Village Manager and the Fire Chief recommend that the purchase of
Sixteen (16) PSS 7000 HP Backplate with Harness, Sentinel 7000 and Luxfer L65G 4500PSI
Carbon Composite Bottle with Accessories (the "Equipment") from Draeger Safety Inc., the sole
source provider, be approved; and
WHEREAS, pursuant to Section 2-85 of the Village Code, the Village Council finds that
the use of formal competitive bidding procedures is impractical in light of the sole source factor
which is stated above and does hereby waive formal competitive bidding for the purchase; and
WHEREAS, the Village Council finds that the Equipment purchase is in the best interest
and welfare of the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOWS:
Section 1. Recitals Adopted. That each of the above stated recitals are hereby adopted,
confirmed and incorporated herein.
Section 2.Capital Project Authorizing Resolution. That pursuant to Section 3.07 (b) of
the Village Charter, this Resolution shall constitute a Capital Project Authorizing Resolution. The
Capital Project is the purchase of the Equipment, at a total cost not to exceed Seventy Thousand
Nine Hundred Forty Seven ($70,947.00) Dollars.
Section 3. Purchase Authorized: Transaction Approved: Implementation.
A. That the Equipment purchase is hereby authorized.
B. That the Village Manager is hereby authorized to purchase the Equipment at a cost
which is consistent with Section 2 of this Resolution, using funds provided by the Capital
Improvement Fund of the Village Budget, and is authorized to sign any necessary purchase orders
or documents upon approval by the Village Attorney as to form and legal sufficiency.
C. That the Village Manager is authorized to take any action which is necessary to
implement the purchase transaction and this Resolution.

Section 4. Waiver of Competitive Bidding. That the Village Council hereby waives
competitive bidding, pursuant to Section 2-85 of the Village Code, because the use of formal
competitive bidding procedures is impractical in light of the sole source factor stated above in the
recitals.
Section 5. Effective Date. That this Resolution shall be effective immediately
upon adoption.

All of the above referenced part numbers, with the exception of part number 4055967, are offered under our GSA contract number GS -07F -9510G. The
pricing that has been quoted for these items exceeds the standard discounts that are normally offered under this GSA schedule. Part number 4055967
is not included within our GSA contract and therefore this item has been quoted under open market conditions. If this proposal should result in a
purchase order, please clearly identify on the order the items being procured under the GSA contract and the item that is being procured under the
open market. The estimated shipping dates that have been provided are based upon current inventory levels at the time of this proposal and these
