CPA funds may not be used for maintenance or the use of land for a stadium, gymnasium, or similar structure. For examples of projects and additional information, go to: www.communitypreservation.org. Applications should be submitted by July 1st for the fall meeting or December 1st for the spring meeting, to allow sufficient CPC review time for potential presentation to the following Brewster Town Meeting. These requirements include: Acquisition, creation, and preservation of Open Space Acquisition, preservation, rehabilitation, and restoration of Historic Resources. The CPC may recommend grants for the planning phase of projects where sufficient information is included in the application concerning the sources of funding that will be available after the planning phase is completed. Applications will be considered incomplete if all requested information is not provided. Include supporting materials (maps, diagrams, photos, etc.). Please number pages of application. Form field with wrap text feature. 10.Site Control and Appraisal: If the project involves acquisition of real property, provide evidence of site control (deed, purchase and sale, option, etc.). In addition, provide an appraisal of the property’s value by a state licensed appraiser using customary appraising techniques. The CPA does not allow funding for acquisitions if the acquisition price is greater than appraised value. Open Space Proposals Permanently protect important wildlife habitat, including areas of significance for biodiversity, diversity of geological features and types of vegetation, contain a habitat type that is in danger of vanishing from Brewster or preserve habitat for threatened or endangered species of plants or animals. Provide opportunities for passive recreation and environmental education. Enhance or protect wildlife corridors, promote connectivity of habitat and prevent fragmentation of habitats. Provide connections with existing trails or potential trail linkages. Preserve scenic views or border a scenic road. Protect drinking water quantity and quality. Provide flood control/storage. Preserve important surface water bodies, including wetlands, vernal pools or riparian zones. Preserve priority parcels in the Town’s Open Space Plan/maximize the amount of open land owned by the Town of Brewster. Historical Preservation Proposals MANDATORY:Must be on the State Register of Historic Places or have a letter from the Brewster Historical Commission indicating that the resource has been determined to be significant in the history, archaeology, architecture, or culture of Brewster. MANDATORY: Project must meet Secretary of the Interior Standards for rehabilitation and/or restoration of Historic Preservation Properties. MANDATORY IF REQUEST IS FROM A CHURCH/RELIGIOUS ORGANIZATION:The project must satisfy the analysis outlined by the SJC’s Caplan vs. Town of Acton decision. Protect, preserve, enhance, restore and/or rehabilitate historic, cultural, architectural or archaeological resources of significance, especially those that are threatened. Protect, preserve, enhance, restore and/or rehabilitate town-owned properties, features or resources of historical significance. Protect, preserve, enhance, restore and/or rehabilitate the historical function of a property or site; Demonstrate a public benefit and/or public access, or Otherwise provide permanent protection for maintaining the historic resource. Project site should not be privately owned unless there is demonstrable public access and benefit. Community Housing Proposals Increase the supply of year-round affordable rental housing for all types of households, such as young singles and couples, families, and seniors. Build support for addressing housing needs through partnerships with conservation groups and non- profit and for-profit developers. Create housing that is affordable and appropriate for very low-income seniors and people with disabilities. Increase local capacity to plan, advocate for, and create affordable housing, preserve the affordability and condition of existing affordable units, and monitor affordable housing restrictions. Increase the variety of mixed-income housing choices in Brewster, particularly in or near commercial areas in order to support Brewster’s economy and accommodate household growth. Provide at least 10% of Brewster’s year-round housing units as affordable housing in order to meet local and regional needs. Ensure long term affordability. Commit to a resident selection process that promotes diversity and does not include a local preference. 7 Community Preservation Committee Application October DRAFT 092221 Recreation Proposals Support multiple active and passive recreation uses. Serve a significant number of residents and visitors. Expand the range of recreational opportunities available to all ages of Brewster residents and visitors. Benefit other Brewster committees providing recreational resources to residents. Promote the use of alternative corridors that provide safe and healthy non-motorized transportation. 8 Community Preservation Committee Application October DRAFT 092221 Town of Brewster Community Preservation Committee APPLICATION REVIEW AND APPROVAL PROCESS Step 1 – Complete the application (with numbered pages) and submit with all attachments either: Electronically to cpcmeeting@brewster-ma.gov, or Deliver a thumb drive containing the complete application with all attachments* to: Community Preservation Committee Town Hall 2198 Main Street Brewster, MA 02631 *Do not submit access to additional documentation via links as the committee will not be checking for updates. Step 2 – Community Preservation Committee Review and Public Comment A. Application Review: The Brewster Community Preservation Committee (CPC) will review submitted applications to determine whether: Proposed project is eligible for Community Preservation Act funding after review by Town Counsel. The application, including the project description and any supporting documentation, is complete. The application is sufficiently developed in terms of work plan and timely for further consideration. When necessary, the CPC will ask applicants to provide additional information, and the CPC may accept modifications to the original proposal based upon that information and/or discussions with the CPC. B. Project Review Guidelines are as follows: When the CPC has determined that the 3 criteria in the application review process listed above (A) have been satisfied, the CPC will refer an application to the appropriate committee for review and comment: Historic Preservation applications will be referred to the Brewster Historical Commission for review and recommendations. Community Housing applications will be referred to the Brewster Housing Partnership for review and recommendations. Recreation applications will be referred to the Recreation Commission for review and recommendations (unless the application originated with the Recreation Commission). Open Space applications will be referred to the Open Space Committee for review and recommendations (unless the application originated with the Open Space Committee) C. Public Comment – The CPC will seek public comment on proposed projects at regular scheduled meetings. D. CPC Recommendation – After Application Review (A), Project Review (B) and Public 9 Community Preservation Committee Application October DRAFT 092221 Comment (C), the CPC will make recommendations, pro or con, on all applications and will notify applicants of the CPC’s determination.Applications that are approved will be recommended in the form of warrant articles to be voted on at the next Town Meeting. The Brewster Community Preservation Committee (CPC) will make a recommendation to Town Meeting for warrant articles that seek Community Preservation funds only if satisfactory information is received from a project applicant indicating that: 1.Sufficient funds will be available to complete the project(s). 2.Every application shall include a project budget with a list of project sources and uses/expenses of funds and a schedule for completion. 3.The source and estimated value of any expected ‘in-kind’ contributions shall be specified. 4.The Brewster CPC may decline any application that is not responsive to these requirements. 5.The CPC will establish the preliminary terms and conditions for any recommended grant as part of its vote to recommend it. 6.Specific terms and conditions/requirements will be contained in the conditional award letter from the CPC. Step 3 – Town Meeting Approval. Town Meeting has the final authority to award funds from Brewster’s Community Preservation Fund. Should Town Meeting vote approval, for non Town-sponsored awards, a Grant Agreement will be executed between the Town and the applicant that will incorporate the terms and conditions included in the award letter among other items. No CPC funds shall be expended until the Grant Agreement is fully executed. Step 4 – Funding and project oversight by the Community Preservation Committee Funding will be available following Town Meeting, subject to submission of documents, including the Grant Agreement if necessary, as required by the Community Preservation Committee. In general, the Town and CPC will execute a grant agreement with the applicant that will describe, among other issues, the conditions for CPC disbursement of funds, including any funds held back until project completion. The CPC must review and approve all agreements. Historic Preservation projects will require monitoring to ensure that work meets the restrictions as outlined in the Secretary of the Interior Standards for Historic Properties. In general, grant agreements will require that the project be completed and CPC funds expended within two years. The CPC will appoint one of its members as the liaison for each approved project. The liaison will frequently be in contact with persons responsible for each project and will require regular reports in person and/or in writing to the Committee. The liaison will also provide the initial approval for any project funding request. Two sets of bills must be submitted directly to the CPA Administrative Clerk (one original for the Town Accountant and one copy for the CPA Committee files). These must be approved/initialed by the Committee Clerk/Treasurer prior to being submitted to the Town Accountant. Step 5 – Final Report after project completion. The Community Preservation Committee requires a final grant report. The Committee reserves the right to withhold some funds until a final report is received and approved by the Committee. This request is asking the CPC to fund the State mandated Update of Brewster’s 2017 Housing Production Plan. Should the Brewster Town Meeting on November 15, 2021 vote to approve this request, the funds will be available to the Town Administrator and Housing Office on or after that date, subject to the terms and conditions listed below. Project Description: For the Town and its chosen contractor to update Brewster’s current Housing Production Plan which was last updated in 2017, which approval is good until June 29, 2022. An update builds on the Town’s previous plan by revising those sections that no longer accurately reflect the character, needs, and goals of the community. An update contains all the components of the previous plan, modified to reflect a current picture of the housing needs and goals of the community and to provide a clear direction for the next five years. The new plan will include the latest census data, explore present housing trends including the impact of the COVID-19 pandemic, involve outreach with the community, and be compiled in coordination with the Vision Planning effort. Housing Production Plans are mandated by the state. Having an approved Housing Production Plan allows the Town to request the Department of Housing and Community Development (DHCD) Certification of Municipal Compliance, often referred to as “safe harbor” because it provides a Town with more control over the Comprehensive Permit Process. Community Preservation Committee Page 2 of 3 The specifics of the project are more fully described in the CPC application dated June 30, 2021. That application is referenced hereto in Exhibit B. Project Eligibility: The CPC determined that Community Preservation Act (CPA) funds may properly be used for this project because the Town may use CPA funds to update its Housing Production Plan (the “Plan”), as the purpose of the Plan is to create and support community housing. Specifically, the application states that in updating the Plan, the Town will analyze the affordable housing needs of the Town, conduct community outreach, prepare possible solutions to increasing the availability of affordable housing in the Town, and detail implementation strategies. Many other municipalities have used CPA funds for this purpose. Terms and Conditions: The funds will be made available to the Town Administrator and Housing Officew under the following terms and conditions: 1)Brewster Town Meeting met on November 15, 2021 and approved the CPC’s recommendation to appropriate $25,000 for the Project (the “Grant Funds”) under G.L. c.44B, the Community Preservation Act (the “CPA”), 2)All work shall be performed in accordance within the scope of work identified in the project application’s “Project Description.” 3)Prior to the disbursement of any CPC funds for eligible expenses, the Town Administrator shall submit to the CPC a copy of the executed contract with the selected contractor(s). 4)Requests for reimbursement, including documentation of the expenses incurred, shall be submitted to Elizabeth Taylor, CPC Clerk, c/o Brewster Town Hall. The CPC reserves the right to inspect the work prior to approving any funding request. Any funds not utilized for the project shall be returned to the CPC’s Undesignated Fund Balance. 5)The Town Administrator shall provide status report/updates to the CPC liaison every three months (i.e. Jan 1, April 1, June 1) until the project’s completion, at which time a final report will be due. 6)The project must be completed no later than June 30, 2022. 7)The terms and conditions herein shall be binding on the parties unless and until amended, in writing, by mutual agreement. (Community Preservation Committee) (Majority Vote Required) COMMENT In May of 2005, Brewster voters approved a ballot question which allowed for the adoption of the modified Community Preservation Act. The act appropriates a 3% surcharge on the town’s real estate tax revenues, which are reserved in a special fund in order to finance projects and programs for the purposes of preservation of open space, recreation, community housing, and historic preservation. Brewster is also eligible to receive up to 100% in matching funds from the State, although we anticipate a reduced reimbursement rate from the State for Fiscal Year 2022, which is projected at 15%. Brewster established, through a local bylaw, a distribution schedule for the CPA funds according to the following: 50% of the funds for open space, 10% for community housing, 10% for historic preservation, and 30% balance is available for housing, historic preservation and/or active or passive recreation projects. 1. Historic Preservation: a. Crosby Mansion Committee – Ongoing reconstruction and restoration of the Crosby Mansion – The goal of the project is to continue ongoing restoration needed to preserve the historic Crosby Mansion. The work will include restoration of chimneys to mitigate water intrusion, restoration of roof sections, 3 window restorations, and some exterior repainting. The amount requested includes $67,400 for the restoration work and a $5,000 set aside to pay for CPC expenses for historical consulting services to ensure work meets federal and state requirements for protection of historic properties. The plan includes a housing needs assessment, goals, and implementation strategies. Latham Center – Strong Start in Adult Living Program Housing Latham Centers, Inc. proposes to develop seven affordable studio apartments for individuals ages 17 – 22 and a one-bedroom apartment for live-in staff, as part of its Strong Start in Adult Living (SSAL) program. The property is located at 1439 Main Street, Brewster. This meeting will be conducted by remote participation pursuant to Chapter 20 of the Acts of 2021. No in-person meeting attendance will be permitted. If the Town is unable to live broadcast this meeting, a record of the proceedings will be provided on the Town website as soon as possible. 1.Discussion and possible vote on recommendations for financial awards, conditions, liaisons for the following funding requests: a.Crosby Mansion Committee request for $73,400 in CPA funds for Restoration and Preservation Project Brian Locke addressed the Committee. He said the list of projects they are asking for the funding for maintenance and restoration issues for the Manion. They are essential for maintenance and safety going forward for the building to be used by the community at large. Some items that need help are windows, roof repair, chimney leaks, to stop future damage to the building. Eric Dray said he reviewed the project and broke items down by groups that would be approvable under Historic preservation and some that were not. The chimneys are certainly appropriate for CPC funding. He said we want to document the existing conditions before restoration. It’s important to document the current appearance of what is there now. There are old photos showing original windows that are no longer on the building, and Eric Dray feels its important to see what was there in the past to document each item looking to be restored today. Paul asked if any of this would be done by volunteers or tradesmen – Brian Locke answered, all are tradesmen. Paul also asked about timing – beginning Winter 2022, why is that? Brian Locke answered it was timing with everything getting approved. Winter 2022 is January, so he felt if there were functions at end of November, it would give them time to start working. The water is turned off and there is no heat in the house in Winter, so we have to be conscious of that and what work can be done at that time. Peter Lombardi said that Counsel flagged the need for the Town to have a property interest in the Mansion to be eligible for at least 30 years. We have a lease currently, with a 10-year option, but it doesn’t take us out the full 30 years that counsel is looking for. Working with a State Agency, navigating a new lease agreement seems a bit cumbersome and may take some time. What DCR pointed us to is, in other similar situations, there are certain Constitutional Preservation Restrictions through Article 97 that make those projects eligible. We reached out to our Town Counsel, and they are looking at the existing restrictions on the Mansion and deed itself. We are hoping to bring this to Town Meeting in a couple months. They are aware of that timeline. I will keep you updated on the status as we go. Faythe said what we talked about was that $6000 as ineligible, so, $67,400 would be the total request. Two areas incurring additional expense, Eric Dray to stay involved and legal expenses after Town Meeting related to sorting out the legal portion. Peter Lombardi said he didn’t think that was true – we can take this to Town Meeting without hearing from Counsel. This isn’t just checking the box on CPA eligibility but also on the commitment we have to the property. It is really looking at the deed and restrictions. Faythe proposed an additional $5,000 to set aside for historical consulting. She is one of the only persons of color and living in a subsidized housing unit, and she is always looking for more subsidized housing, more for families, and more diversity. Peggy said she wants to see us look at things from a strategic and long-term perspective, not just what is right in front of us. So, when things come up, like Cape Sea Camps comes up, we have the funding for that. Community Preservation Committee Minutes of September 8, 2021 Page 3 of 5 Elizabeth said she is the rep of the Planning Board and Chair of the Open Space Committee and is really looking forward to the future as to major projects. She hopes our work can go into climate change initiatives, and open space and passive recreation because all of these have a major effect on climate change issues in town. Bruce is the Conservation Commission Rep here and trying to preserve the wetlands areas – 80 ponds in town and they are a huge issue in town. He would like to see our efforts here that we are a small rural community, we are a tourist destination and that is important to many in town. Sharon is hoping we can get a better handle on the trends and what our real needs are going to be in the future, to come up with a more realistic funding formula that doesn’t tie up funds to have a fairer use of the funds as we get them each year. Paul is a Citizen’s Rep and has been on the Committee since its inception. For him, it is trying to strike a balance of environmental preservation and the real need for people to be able to afford to live here in terms of the projects we look to fund in the long-term. Rollie agreed with Paul, there is the Formula issue – recreation is only 30% when they have a project. He would like to see those percentages updated. Faythe said she would reiterate the focus and need for robust discussion around our Funding Formula and possibly looking to change that. She would also like guidance and insights from residents regarding regional projects coming in front of the Committee. How do we strike a balance between the different categories and have a Town that provides housing and opportunities for everyone in a setting that is rural, scenic, and tourist. Jenn then went through her slide presentation. They discussed having the meeting at a little later time than the regular 4PM timeslot. This meeting would really be looking for public feedback. Faythe was going to look at the dates for Legal Ad publishing deadlines, etc. before deciding on a date. Jenn Goldson went on to the profiles she sent in. She said she would like to use them for information to the public/officials, making them available on the website, and possibly distribute them in draft form to the focus group participants. The second purpose is to incorporate them into the draft CP Plan. It is super important to make sure everything is right and correct. She went through the draft profiles with the Committee. CPA Fast Facts, Local and State CPA Revenue, CPA Projects, Review of Community Goals, Active Recreation Needs & Resources, Community Housing Needs & Resources, Historic Preservation Needs & Resources, Open Space Needs & Resources. Jenn Goldson asked the Committee to look at these in detail to make sure they have everything they need incorporated into the plan. Faythe said that for those of us who represent a CPA area take the lead on reaching out to others in those areas to look over these profiles carefully. Jenn Goldson then talked about the Focus Groups and how they would be built, the invitation list, and what they would be discussing. The Town’s engineering and surveying consultant has staked out the roadway, bark mulch has been spread, the water line has been completed by the Water Department. They are working on granite curbing; they are getting a price on that. They are coordinating the planting plan and they are in the process of delivering granite for the parking area and roadway. Sharon also gave an update for Brewster Woods - Donna Kalinick said Phase 1 is substantially completed. They need to finish work on sidewalks, final testing of septic, landscaping, and light poles are demobilization. They expect all work to be completed by no later than December 31st. Phase 2 began in July – forms and foundations have been poured. They expect building forms to be up by winter so interior work should be completed in the winter. Already accepting calls inquiring about applications. Faythe asked Barbara if there was a new Head of the Housing Authority. Barbara said we voted in Laurel Labdon as the temporary Chair.
