BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 24, 1981
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met
2 in regular session December 24, 1981 at the hour of 9 :00 a.m. in the Municipal
3 Building in said City. Mr. Meredith presided with Mr. Ryder present. Mr.
4 Webb was on vacation. The following business was had, to-wit:

6 APPROVAL OF MINUTES OF DECEMBER 17, 1981

8 Mr. Ryder moved to approve the minutes of the previous meeting as prepared,
9 seconded by Mr. Meredith and on unanimous voice vote the motion was carried.

11 REQUEST FOR ROSE CITY GRAN PRIX
12
13 Mr. Joe Plankenhorn, representing the Jaycees, requested permission to use
14 North and South 4th, 5th and 6th Streets between North and South "A" and the
15 old Wayne Dairy lot, if available, for a pit area. If the Wayne Dairy lot
16 is not available, he requested using the North 7th Street parking lot. The
17 course is to start on North 6th to the service drive, east to 5th, south to
18 Main, east to 4th, south to the County parking lot to 5th, through the service
19 drive to 6th. The request is for June 20, 1982 from 10:00 a.m. to 6:00 p.m.
20 Mr. Ryder informed Mr. Plankenhorn he should send a letter to Mr. Frank Otto,
21 President of the Redevelopment Commission, requesting use of the Wayne Dairy
22 lot. Permission from this Board is for City property only and permission
23 will have to be granted from the County for the use of their property. Traffic
24 Capt. Dan Wogoman noted there was not a problem with the route last year.

26 Mr. Ryder moved to grant the Jaycees their request for the Rose City Gran Prix
27 on Sunday, June 20 on the course as outlined and the use of the North 7th
28 Street City parking lot as a pit area, seconded by Mr. Meredith and on
29 unanimous voice vote the motion was carried.

31 REQUEST TO BLAST - Dale Jacobs

33 Mr. Dale Jacobs, representing Richmond Community Schools, stated they have
34 received a request from A&D Excavating, who is the contractor on the Richmond
35 High School storm sewer project for permission to excavate a stretch of sewer
36 southwest of the high school by use of explosives. The area is on school
37 property, part of Southwest 1st Street„sand Southwest "E" Street. He pre-
38 sented a map showing the areas involved.

40 Four (4) utilities have been contacted and there has been a response to date
41 from three (3) : RP&L has no objections; General Telephone requests that the
42 area of their: conduit be hot-less tfian tweiity=five (25') from the trench area;
43 Richmond Water Works is opposed to the blasting because of the age of some of
44 their lines in the area; there has been no response from the Gas Company.

46 A&D will subcontract the explosive work to Prater Explosives, Inc. , which is
47 the one doing the work for Peirce Construction. Prater has provided a certi-
48 ficate of insurance in the amount of 1.5 million. Mr. Jacobs stated the
49 certificate holders have been advanced to include the contractor, Richmond
50 Community Schools, Jacobs & Maze and the City of Richmond, They would like
51 to proceed with this operation during the Christmas vacation.

53 It was noted there are gas lines in the area. Mr. Arias Moore stated there
54 is approximately six foot (6') of ground cover above the rock. Blasting was
55 not a part of the options in the specs. The blasting can be done in three (3)
56 days. Mr. Moore stated they can exactly locate the utilities. Repair of any
57 damaged lines lies with A&D. The project is to separate the storm and sanitary
58 sewer, but this is not a part of the City sewer separation project. Richmond
•
59 Community Schools has not yet given permission. Mr. Meredith informed Mr.
60 Jacobs the Sanitary District should be contacted as there are sewer lines in
61 the area.

63 Mr. Meredith stated the certificate of insurance just names the City of Rich-
64 mond as certificate holder. The City of Richmond should be additionally

1 insured, not just a holder. A certificate holder would not include defense of
2 a suit.

4 Mr. Anderson stated his opinion would apply to any blasting request and recommended
5 Mr. Jacobs get a copy of this opinion and they should satisfy the stipulations in
6 the opinion. A requirement is insurance in the amount of five million, as this
7 is the most that can be collected from suits against the City. Mr. Anderson
8 noted two things are required by this Board; proper insurance and a permit from
9 the Fire Prevention Bureau.

11 Mr. Meredith noted the City being a certificate holder is normally all that is
12 asked; however, since this is ultra hazardous, we do not have coverage on our
13 policy and we have no protection at all. In order to get that protection, the
14 City should be named as an additional insured on the policy that is going to
15 cover this activity, which insurance must be in the amount of five million dol-
16 lars. The City will also require a waiver of damages to City-owned property.
17 The Sanitary District should be notified, as the other utilities have been.
18 Written permission from the property owner is required and a permit from the
19 Fire Department. A permit is required for each occurrance.

21 Mr. Meredith moved that permission be granted in the area as outlined with the
22 conditions being met that the City be named as an additional insured, insurance
23 in the amount offive million dollars, including defense, that a waiver of City
24 owned property not be included on the policy, that the permission of the pro-
25 perty owner be obtained, that the Sanitary District be informed, and a permit
26 issued from the Fire Department; when all these are satisfied to the satisfaction
27 of the City Attorney, that permission be granted, seconded by Mr. Ryder and on
28 unanimous voice vote the motion was carried.

49 AGREEMENT FOR FIRE DEPARTMENT SERVICES FOR WAYNE TOWNSHIP _

51 City Attorney Ed Anderson stated he has examined the agreement and finds it
52 in order.

54 Mr. Meredith moved it be approved, seconded by Mr. Ryder and on unanimous voice
55 vote the motion was carried.
