HomeMy Public PortalAbout11-12-1981 /gS BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 12, 1981 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session November 12, 1981 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Webb .present. Mr. Ryder 4 was ill. The followings.business was had, to-wit: 5 6 APPROVAL OF MINUTES OF NOVEMBER 5, 1981 7 8 Mr. Webb moved to approve the minutes of the previous meeting as received, 9 seconded by Mr. Meredith and on unanimous voice vote the motion was carried. 10 11 RECESS UNTIL 10:00 A.M. 12 13 Mr. Meredith announced the Board is recessed until 10:00 a.m. at which time 14 there will be two (2) nuisance hearings. 15 16 TWO (2) NUISANCE HEARINGS SET FOR 10:00 A.M. 17 18 430 South llth 19 20 City Attorney Ed Anderson conducted the hearings. The first hearing is Board 21 of Public Works vs Mark Issen for three (3) inoperable vehicles at 430 South llth 22 Street. The Defendant was not present. Complaintant Dennis Bronston stated he 23 was there this morning and all three (3) inoperable vehicles have been removed 24 and he would like to withdraw his complaint. 25_ 26 Mr. Webb so moved, seconded by Mr. Meredith and on unanimous voice vote the 27 motion was carried. 28 29 Mr. Issen did appear later in the meeting and notified the Board he is not the 30 owner of the property. He stated the property is owned by Marc Jaffe. 31 32 402 South llth 33 34 The second hearing is Board of Public Works vs. Joseph Hesson for one (1) 35 inoperable vehicle at 402 South llth Street. No one was present representing 36 the Defendant. 37 38 The Clerk read the following complaint: 39 40 . COMPLAINT 41 TO 42 THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND 43 44 I, the undersigned to hereby complain of and declare that I observed 45 a nuisance described as 1 inoperable vehicle located on the premises 46 known as 402 South llth Street in the City of Richmond, Indiana; I 47 also have seen the above nuisance in the same location as above des- 48 cribed for a period of time from the 8 day of October, 1981, and that 49 during that time said above nuisance was not moved. 50 51 I observed the aforesaid nuisance on the premises located at 402 52 South llth Street. 53 54 I believe that the property on which the above nuisance exists is 55 owned by Joseph Hesson, 121 Richmond Ave and that the above nuisance 56 is owned by 57 58 I ask the Board of Public Works and Safety to cause the above said 59 nuisance to be removed from said premises. 60 61 John D. November 12, 1981 Page 2 1 Mr. Anderson noted the notice of this hearing was sent on October 16, 1981 to 2 two (2) addresses and the certified mail was returned undeliverable. Mr. Bronston 3 stated he has not been able to contact. the Defendant. The nuisance_still exists 4 this morning. Mr. Bronston stated he does not believe the owner of record, Mr. 5 Hesson, resides at the property located .at. 402 South llth; however, he is owner 6 of record at the Treasurer's office. Mr. Anderson stated that our Ordinance does 7 not elaborate under type of notice to be served and an attempt has been made to 8 notify the Defendant through certified mail at the last known address; therefore, 9 Mr. Anderson feels the Board can proceed with the hearing. 10 11 Mr. Bronston stated he finds a nuisance at 402 South llth.as the inoperable 12 vehicle has been there foroa period of time, there are no tires on the vehicle, 13 several windows are broken out and. it..appears to be a junk car. He stated, if 14 the Board orders the vehicle removed, he will try to contact Mr. Hesson to make 15 him aware of the situation, as he is not sure he is aware of it at this point. 16 Mr. Bronston does not go on the property so would not have an I.D. number off 17 the car. The property does appear to be. occupied. He presented a picture taken 18 from the alley this morning. 19 20 Mr. Meredith moved that a nuisance does exist at 402 South llth on the property 21 with the owner of record Joseph Hesson and that the Board request the Police 22 Department check the automobile for an identification number and attempt to 23 find the owner (name and address) and if such owner is found, he be so notified 24 and if the vehicle is not removed within a period of two (2) weeks that the 25 City cause it to be removed, seconded by Mr. Webb and on unanimous voice vote 26 the motion was carried. 27 28 ADJOURNMENT 29 30 There being no further business the meeting was adjourned. 31 32 Donald E.
