CITY OF RICHMOND, .INDIANA, OCTOBER 8, 1981 . . -1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session October 8, 1981 at the hour of 9:00 a.m. in the Municipal 3 Building .in said City.. Mr. Meredith. presided with Mr. Ryder and Mr. Webb 4 present. . The following business was had, to-wit: 5 . 6 APPROVAL OF MINUTES OF OCTOBER 1 , 1981 7 . 8 Mr. Webb moved the .minutes of the previous meeting be.approved and placed 9 - on file as prepared, seconded by Mr.- Ryder and on unanimous voice vote the 10 motion was carried. . 11 . 12 REQUEST FOR STREET FAIR ON SOUTH 4TH STREET - Gertrude Ward 13 . 14 Mr. Ward presented a flyer noting the Arts Fair is going to be in two (2) 15 major buildings, St. John's Apartments and the FIND Material .Center, on 16 Sunday, October 25 from 12 noon to 6:00 p.m. She noted they are not empha- 17 sizing_.a flea market. If the weather should be nice that day, they may move 18 the fair outside, but it will be confined. to the sidewalks and on private 19 property. She noted they are attempting to get a surry for rides which would 20 probably start near the FIND Center on 4th, go west on "B", north on 3rd to 21 "A", east on "A" to 4th and back to FIND Center. The sponsor for the Fair 22 is Neighborhood Preservations Services. 23 . • 24 Mr. Ryder moved to approve the Street Fair, .ap.proving the booths be allowed 25 on the sidewalks and also approving, if needed, the necessary parking - 26 area•on the east side of 4th at the old Finley School Building, seconded 27 by Mr. Webb and on unanimous voice vote the motion was carried. .Lt. Williams 28 of Traffic requested Dr. Ward- contact the Traffic Department a few days before 29 • the Fair to work out final details. . 30 , . 31 REQUEST TO ADOPT STREET. SPECIFICATIONS - .George Webb 32 III33 City Engineer.George Webb noted .that .change.s, ,such as color .code of utilities, 34 occured the first of .this year. Due to the changes and methods used to re- 35 pair utility cuts, he recommended that the Standard Street Repair Specifica- 36 tions, which he presented, be adopted by the Board of Works. 37 .. 38 Mr. Webb moved that the .subject Standard Street Repair Specifications-be 39 adopted by, the Board .of Public .Works and Safety, seconded by Mr. Ryder and 40 on unanimous voice vote the motion was carried. 41 42 RADIO MAINTENANCE REPORT FOR.SEPTEMBER, • 1981 • . 43 . . - 44 Mr. Webb moved that the Radio Maintenance.Repo.rt be accepted. and:placed on 45 file, seconded by Mr. Ryder and. on. unanimous voice vote .the motion was carried. . 46 47 UNSAFE BUILDING HEARING FOR 515 NORTH 17TH STREET 48 49 Mr. Meredith stated this hearing is held pursuant to Ordinance #100-1979 • 50 adopting the Unsafe Building Law as provided in IC 18-3-5.5-1. The Building 51 Commissioner has issued his Order pursuant to Sec. 4 of the ordinance. Service 52 of the Order has been .in accordance with Sec. 8 of the ordinance. Mr. Roberts 53 presented return .receipts for letters sent to Mr. Dilley and Mr. King (signed • 54 by Sandra L. King) . This hearing is pursuant to Sec. 9 of the ordinance. Mr. . 55 King was present and represented by Attorney Robert Hudson. Mr. Dilley was 56. not present :nor represented by counsel. Lot 33C 8 Woodnut Addition 9 515 North 17th St. 10 Richmond, Indiana 11 12 The building or structure, or part thereof, located on thereal estate 13 described above has, as a result of inspection and investigation. by the 14 Building Commissioner of .the. City of Richmond, been found to be in an 15 impaired structural condition or state which renders it unsafe or dan- 16 gerous to persons and. property. Said findings are according to the 17 specifications of an unsafe building as set forth in Section 2(b) (4) . 18 19 Therefore, it• is hereby ordered that the following action be 20 accomplished in regard to this property: 21 22 Remove unsafe building According to Section 3, Paragraph 6, 23 City of Richmond Ordinance No. 100-1979. 24 25 The above stated action shall be accomplished no later than October 26 11, 1981. 27 28 A hearing regarding this order will be held in the Board of Works Room 29 at the Municipal Building, 50 North 5th Street, Richmond; Indiana, at 30 10:00 a.m.. on October 8, 1981. You may appear• at the above said hearing 31 to show cause why this order should not be complied with; you may be 32 . represented by an attorney, present evidence, call witnesses and make 33- arguments at the hearing. If you fail to appear.., the hearing will be 34 held in your absence. If the order is affirmed, the Building Commissioner 35 will cause staid. action to be taken pursuant to this order. The costs 36 thereof will be assessed against you on the real estate tax duplicate. 37 Further, failure to comply with this order will subject you to litigation. 38 39 You have an obligation according to Section 12 of Ordinance No. 100-1979 40 to supply full information-regarding this order to any person who may 41 take or agree to take a substantial property interest in the unsafe 42 premises, prior to such transfer or agreement to transfer; also to 43 supply to the Building Commissioner, within five (5) calendar days of 44 the transfer or agreement to transfer, (a) the full name, address and 45 telephone number of the person acquiring substantial property interest, 46 and (b) a true and accurate copy of the legal instrument under which 47 the transfer or agreement to transfer is accomplished. 48 49 Charles E. Roberts _ 50 Building Commissioner 51 52 Mr. King acknowledged receipt of the order and said he understood it. Mr. Hudson 53 noted Mr. Dilley is the owner of record of the property and Mr. King has the 54 right to tax deed in 1982. Mr. King does have an interest in it, but not one 55 that is complete yet. Mr. King purchased the tax certificate in August of 1980 56 but Mr. Dilly has the right of redemption until 1982. 57 .. 58 Mr. Hudson stated Mr. King's position is that he does not question the correct- 59 ness of the findings and requested seven (7) days from today within which to 60 make arrangements to have the property removed in order to protect Mr. King's 61 interest. 62 63 Mr. Roberts stated he sent Mr. Dilley a letter on September 29 telling him 64 the City would demolish this building at no cost to Mr. Dilley; however, i 7.S Board of Public Works & Safety Minutes Cont'd. October 8, 1981 Page 3 1 the money available now does not take in this territory, so Mr. Dilley was 2 notified this was not possible. Other than that, there has been no corres- 3 pondence with Mr. Dilley. 4 5 Mr. Hudson stated he feels it would be proper for the Board to order the 6 building demolished at this time and requested Mr. Roberts give seven (7) 7 days in which Mr. King can endeavor to make arrangements with. Mr. Dilley to 8 protect King's interest in the lot and obtain proper insurance. In so doing, 9 Mr. King will seek a permit to demolish the building himself. He cannot do 10 this directly to the Board because of Mr. .Dilley's .interest. Mr. Hudson 11 stated he thought this could be accomplished in thirty (30) days. Mr. 12 Roberts noted demolition permits allow forty-five (45) days. 13 14 Mr. Hudson noted that if Mr. King proceeds to demolish the building as an 15 interested owner, Mr. Dilley could reap the benefits without paying Mr. King 16 anything; however, if the Board will order it down, Mr. King makes a. contract 17 with the Bureau of Buildings to tear it down, then there will be a lein against 18 the property for the cost of tearing it down but the lein will be payable to 19 Mr. King so it would wash itself out as far as he's concerned and he would 20 then be able to preserve his interest in that lot without having encumbered 21 an addition to what it already has against it. In response to Mr. Ryder's 22 question, Mr. King..stated he has worked in demolition and can meet the City's 23 demolition specifications. Mr. Hudson stated the property has been scavaged 24 and everything of any value has been removed. 25 26 Mr. Meredith stated the record is to show that Mr. King does agree with the 27 findings in the order; however, as Mr. Dilley is owner of record and is not 28 here nor represented, the Board should proceed and have Mr.. Roberts give his 29 findings so they can determine if this is an unsafe building and should be 30 demolished. 31 32 Mr. Roberts stated his findings are evidenced by pictures he presented. He - 33 noted the initial write up was in 1979 and presented pictures taken in 1979 34 and those taken a few years ago. The back part of the house has been burned, 35 all the walls are bad, and the ceilings need to be replaced. All code items 36 are violated. There is extensive damage done by the fire plus vandalism. 37 Mr. Roberts stated he would be willing to go along with seven (7) days for 38 Mr. King to secure insurance. It was noted that if Mr. Roberts received an 39 offer for demolition for less than Mr. King's he should take the low offer. 40 If Mr.. King is unable to obtain insurance within seven (7) days, Mr. Roberts 41 could get another contractor to tear it down. Mr. King stated he would have 42 it torn down within forty-five (45) days after receiving the permit. 43 44 Mr. Ryder moved that the Board declare the building unsafe and affirm Mr. 45 Robert's order of demolition, seconded by Mr. Webb and on unanimous voice 46 vote the motion was .carried. 47 48 ADJOURNMENT 49 50 There being no further business the meeting was adjourned. 51 52 Donald E.
