Indiana, met 2 in regular session July 16, 1981 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 APPROVAL OF MINUTES OF JULY 9, 1981 7 8 Mr. Webb moved to.approve the minutes of the previous meeting as prepared, 9 seconded by Mr. Anderson .and on unanimous voice vote the motion was carried. 111 10 11 CHANGE IN CONSTRUCTION FOR NORTH RICHMOND PROJECT (Continued from last week) 12 REQUEST TO CLOSE CURB CUT ON NORTH 8TH STREET (Continued from last week) 13 14 Mr. Meredith stated he requested Mr. Ryder to circulate a petition to residents 15 of the area of North 8th Street from "G" to "H", on No. "H" Street from 8th to 16 10th and on No. "I" Street from 8th to 10th. Mr. Goodwin in the absence of 17 Mr. Ryder presented the petitions. He noted 12 individuals were in favor of 18 blocking off the street, 11 in favor of leaving the road unblocked and 2 19 leaving it unblocked but posted "no truck traffic". Mr. Cecere presented 20 petitions circulated in the area stating over 90% of the people on 8th 21 between "H" and "I" preferred not to solve the problem by closing the street. 22 Mr. Cecere noted there could be a traffic problem with turning large trucks 23 around if the street is blocked. Mr. Meredith stated Mr. Ryder indicated a 24 previous meeting he had held with residents, mainly those on "I" Street, 25 indicated those residents did want the street blocked and that was one of 26 his reasons for presenting the change order. Also, the blocking would separate 27 the residential area from the industrial area, preserving the neighborhood and 28 adding life to the streets. Mr. Anderson noted Council must pass an ordinance 29 if the streets are to be posted "no truck traffic". 30 31 Mr. Anderson moved to deny the proposed change order in construction of the 32 north Richmond project, seconded by Mr. Webb and on unanimous voice vote the 33 motion was carried. 34 35 Mr. Goodwin requested the Board of Works present an ordinance to Council post- 36 ing "H", "I" and "J" "no truck traffic". Mr. Goodwin suggested a truck could 37 be defined as one with a 12 ton limit. Mr. Anderson stated he feels it is 38 not up to this body to initiate this ordinance. Capt. Wogoman stated the 39 present ordinance states through trucks cannot run on a residential street; 40 however, it is necessary to travel on some residential street to get to this 41 area. Capt. Wogoman pointed out the difficulty in enforcing these postings. 42 Mr. Glazer stated his trucks have been instructed to use the other streets; 43 but, the complaints come from vendors coming to him. Mr. Webb suggested Mr. 44 Glazer give notice to vendors to use other streets. 45 46 Mr. Anderson moved that this body, at the request of Mr. Goodwin, petition 47 Council for an ordinance for "no truck"posting on the streets in the north 48 Richmond project. The motion died for lack of a second. Mr. Webb stated he 49 does not feel he has enough information to inititate any action. 50 51 Mr. Meredith stated the request is taken under advisement. 52 53 Mr. Meredith stated a request to close a curb cut on North 8th came from Mr. 54 Goodwin because the zoning in his interpretation was R3. Mr. Cecere has made 55 arguments that it is R3 non-conforming use which he says is still in existence. 56 Mr. Goodwin has not formally in writing informed the owners of the property 57 that they are in violation of his interpretation; therefore, this item is 58 continued under advisement. 59 60 REQUEST TO BLOCK STREET FOR CHURCH PARTY 61 62 Mr. Meredith presented a request from Shiloh Baptist Church to block the 700 63 block of North 15th on Saturday, July 18 from 10:00 a.m. to 6:00 p.m. This 64 was done in the past and Capt. Wogoman stated there had been no problems. 65 66 Mr. Webb moved for approval of the subject request, seconded by Mr. Anderson 67 and on unanimous voice vote the motion was carried. /3,Z Board of Works Minutes Cont'd. July 16, 1981 Page 2 1 REQUEST TO PAINT HOUSE NUMBERS ON CURBS 2 3 Messrs. Robert Clark, 1040 S. W. 1st and Gerald Kuhlman, 1028 S. W. 1st, 4 requested permission to paint house numbers on curbs. Mr. Kuhlman stated 5 this makes identification easier for police and emergency equipment in 6 locating addresses. They will not solicit, but will request a contribution. 7 8 Mr. Anderson moved to grant the request of Gerald Kuhlman and Robert Clark, 9 painters, to paint house numbers on curbs within the City of Richmond with 10 no solicitation, seconded by Mr. Webb and on unanimous voice vote the motion 11 was carried. 12 13 POLICE DEPARTMENT RESIGNATION OF OFFICER - Major Chesnut 14 15 Major Chesnut presented a recommendation from Chief of Police Charles Chris 16 to accept the resignation of Patrolman/Tech. L. Otto Schell, effective 17 July 17, 1981. Officer Schell's resignation is due to his returning to 18 school. 19 20 Mr. Webb moved for approval of the subject request, seconded by Mr. Anderson 21 and on unanimous voice vote the motion was carried. 22 23 SIGNALIZATION AGREEMENTS - George Webb 24 25 Mr. Webb presented the last utility agreement for the signalization project. 26 He moved that the Board of Works approve the utility agreements for the up- 27 coming signal project with Richmond Gas, Water Company and RP&L, seconded 28 by Mr. Anderson and on unanimous voice vote the motion was carried. 29 30 Mr. Anderson presented the revised agreement between the City and the State 31 for the installation of signals. He moved to execute the agreement for the 32 modernization, interconnection and pre-emption of traffic signal installa- 33 tions on certain streets as designated in the exhibit attached to the agree- 34 ment subject to two (2) revisions: page 2 item 3 be changed to properly 35 read that the energy required to operate the signal facilities is paid for 36 by the Department of Highway and not the City of Richmond; and that item 18 37 be added to such agreement which specifically shows that the cost of this 38 is coming from federal aid being in the amount of 100% whereas the agreement 39 was silent on this cost. Subject to those two revisions, he moved the agree- 40 ment be executed, seconded by Mr. Webb and on unanimous voice vote the motion 41 was carried. 42 43 UNSAFE BUILDING HEARING FOR 106 S. W. "F" STREET 44 45 City Attorney Ed Anderson conducted the hearing, noting this hearing is held 46 pursuant to Ordinance No. 100-1979. Building Commissioner Charles Roberts 47 has issued the order pursuant to Section 4. Service of the order was in 48 accordance with Section 8 by certified mail and the return receipt was entered 49 in the record. The defendants, Patty L. Winn & Betty J. Winn, were not 50 present nor represented by Counsel. 51 52 The Clerk read the following order: 53 54 Order Issued Pursuant to 55 City of Richmond 56 Ordinance No. 100-1979 57 58 June 10, 1981 59 11/ 60 Order Issued to: Patty L. July 16, 1981 Page 3 1 The building or structure, or part thereof, located on the real estate 2 described above had, as a result of inspection and investigation by the 3 Building Commissioner of the City of Richmond, been found to be in an 4 impaired structural condition or state which renders it unsafe or dan- 5 gerous to persons and property. Said findings are according to the 6 specifications of an unsafe building as set forth in Section 2(b) (4) (12) . 7 8 Therefore, it is hereby ordered that the following action be accomplished 9 in regard to this property: 111 10 11 Repair unsafe building to bring it into compliance with standards 12 for building condition or maintenance found in ordinances enacted 13 by the city council or state laws, According to Section 3, Para- 14 graph 4, City of Richmond Ordinance No. 100-1979. 15 16 The above stated action shall be accomplished no later than August 10, 1981. 17 18 A hearing regarding this order will be held in the Board of Works Room at 19 the Municipal Building, 50 North 5th Street, Richmond, Indiana, at 10:00 20 a.m. on July 16, 1981. You may appear at the above said hearing to show 21 cause why this order should not be complied with; you may be represented 22 by an attorney, present evidence, call witnesses and make arguments at the 23 hearing. If you fail to appear, the hearing will be held in your absence. 24 If the order is affirmed, the Building Commissioner will cause said action 25 to be taken pursuant to this order. The costs thereof will be assessed 26 against you on the real estate tax duplicate. Further, failure to comply 27 with this order will subject you to litigation. 28 29 You have an obligation according to Section 12 of Ordinance No. 100-1979 30 to supply full information regarding_ this order to any person who may 31 take or agree to take a substantial property interest in the unsafe pre- 32 wises, prior to such transfer or agreement to transfer; also to supply to 33 the Building Commissioner, within five (5) calendar days of the transfer or 111 34 agreement to transfer, (a) the full name, address and telephone number of 35 the person acquiring substantial property interest, and (b) a true and 36 accurate copy of the legal instrument under which the transfer or agreement 37 to transfer is accomplished. 38 39 Charles E. Roberts 40 Building Commissioner 41 Bureau of Buildings 42 50 North 5th Street 43 Richmond, Indiana 47374 44 (317) 966-5561, Ext. 233/234 45 46 Mr. Roberts stated he has a title search showing the Winns as the owners. 47 Mr. Roberts presented pictures, noting the structure needs paint or siding. 48 He has not been inside the structure. The owner had contracted to have 49 siding put on as the contractor came in and talked with Mr. Roberts concern- 50 ing a permit; however, the contract was revoked before the work was started. 51 Mr. Roberts has been involved in this property for five (5) years. The 52 structure is good, but there has been no outside maintenance. The order 53 requests repair of the siding. Mr. Roberts has had no response to his order. 54 55 Mr. Meredith moved that the Board does find a public nuisance and confirm 56 the order of Mr. Roberts and, if the owners have not taken action to start 57 the process of fixing up and repairing the property within a thirty (30) 58 day period, that the Building Commissioner proceed, seconded by Mr. Webb. 111 59 The procedure would be to repair the property. On unanimous voice vote 60 the motion was carried. 61 62 ADJOURNMENT 63 64 There being no further business the meeting was adjourned. 65 66 Donald E.
