HomeMy Public PortalAbout07-09-1981 �a 7 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JULY 9, , 1981 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session July 9, 1981 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. 4 Webb present. The following business was had, to-wit: 5 6 APPROVAL OF MINUTES OF JULY 2, 1981 111 7 8 Mr. Webb moved to approve the minutes of the previous meeting as prepared, 9 seconded by Mr. Anderson and on unanimous voice vote the motion was carried. 10 11 AWARD OF BID FOR PARKING GATES - Jerry Haynes 12 13 Director of Department of Transportation Jerry Haynes presented a letter 14 stating the one bid meets or exceeds all requested specifications. The 15 Department recommends that this bid from Dayton Stencil Works Co. in the 16 amount of nine (9) gates at $17,337.00 and overhaul of five (5) ticket 17 printers at $4,204.00 for a total bid of $21,541.00 be accepted. This 18 amount is within appropriated funds. 19 20 Mr. Anderson moved to accept the recommendation of the Director of the 21 Department of Transportation, seconded by Mr. Webb and on unanimous voice 22 vote the motion was carried. 23 24 FIRE DEPARTMENT PROMOTION TO FIREFIGHTER - Chief Mullin 25 - 26 Chief Paul Mullin recommended-Floyd Potter be advanced to the rank of 27 firefighter, effective July 11, 1981 as he will have completed his one 28 (1) year probationary-period. 29 30 Mr. Webb moved that the recommendation of the Chief be approved, seconded 31 by Mr. Anderson and on unanimous voice vote the motion was carried. III 32 33 REQUEST TO CLOSE CURB CUT ON NORTH 8TH STREET -(Continued from last week) 34 CHANGE IN CONSTRUCTION FOR NORTH RICHMOND PROJECT (Continued from last week) 35 - 36 Mr. Meredith stated he has not received enough information to make a de- 37 termination on these matters so they will be continued under advisement. 38 There was no one in the audience to speak on these matters. 39 40 UNSAFE BUILDING HEARING FOR 214 SOUTH 16TH STREET 41 42 City Attorney Ed Anderson conducted the hearing, noting this hearing is 43 held pursuant to Ordinance No. 100-1979. Building Commissioner Charles 44 Roberts has issued the order pursuant to Section 4. Service of the order 45 was in accordance with Section 8 by certified mail arid the return receipt 46 was entered in the record. The Defendants Richard and Janice Mae Smith 47 were not present nor represented by Counsel. - 48 V 49 The Clerk read the following order: 50 51 Order Issued Pursuant to 52 City of Richmond 53 Ordinance No. 100-1979 54 55 - June 10, 198;1 56 - 57 Order Issued to: Richard W. Smith 58 - Janice Mae Smith - V 59 214 So. 16th Street 60 Richmond, Indiana 47374 61 62 RE: Mendenhall and Price, Block 2, Lot 55 63 214 So. 16th Street 64 Richmond, Indiana 47374 /X Board of Public Works & Safety Minutes Cont'd. July 9, 1981 Page 2 1 The building or structure, or part thereof, located on the real 2 estate described above has, as a result of inspection and inves- 3 tigation by the Building Commissioner of the City of Richmond, 4 been found to be in an impaired structural condition or state which 5 renders it unsafe or dangerous to persons and property. Said find- 6 ings are according to the specifications of an unsafe building as 7 set forth in Section 2(b) (4) (12) . 8 9 Therefore, it is hereby ordered that the following action be ac- 10 complished in regard to this property: 11 12 Repair unsafe building to bring it into compliance with 13 standards for building condition or maintenance found in 14 ordinances enacted by the city council or state laws, Ac- 15 cording to Section 3, Paragraph 4, City of Richmond 16 Ordinance No. 100-1979. 17 18 The above stated action shall be accomplished no later than August 19 10, 1981. 20 21 A hearing regarding this order will be held in the Board of Works 22 Room at the Municipal Building, 50 North 5th Street, Richmond, 23 Indiana, at 10:00 a.m. on July 9, 1981. You may appear at the 24 above said hearing to show cause why this order should not be 25 complied with; you may be represented by an attorney, present 26 evidence, call witnesses and make arguments at the hearing. If 27 you fail to appear, the hearing will be held in your absence. If 28 the order is affirmed, the Building Commissioner will cause said 29 action to be taken pursuant to this order. The costs thereof will 30 be assessed against you on the real estate tax duplicate. Further, 31 failure to comply with this order will subject you to litigation. 32 33 You have an obligation according to Section 12 of Ordinance No. 34 100-1979 to supply full information regarding this order to any 35 person who may take or agree to take a substantial property in- 36 terest in the unsafe premises, prior to such transfer or agree- 37 ment to transfer; also to supply to the Building Commissioner, 37 within five (5) calendar days of the transfer or agreement to 38 _ _ transfer, (a) the full name, address and telephone number of the per- 39 ! son _acquiring substantial property interest, and (b) a true and 40 accurate copy of the legal instrument under which the transfer or 41 agreement to transfer is accomplished. 42 43 Charles E. Roberts 44 Building Commissioner 45 46 Mr. Roberts stated he has a title search showing the Smiths as the owners. 47 Mr. Roberts presented pictures of the property, noting the roof is in a bad 48 state of repair and showing water damage due to bad gutters. He noted it 49 is a blight to the neighborhood. Mr. Roberts presented a copy of a building 50 permit written this morning for repair to the roof. He stated Mr. Smith 51 indicated he would comply with the order. 52 53 Mr. Anderson recommended the order be amended to cite other violations and 54 continuing- the hearing. 55 56 Mr. Meredith moved that due to the fact that the order has been issued and the 57 one to whom the order was issued has shown good faith in attempting to comply 58 with the order by taking out a building permit and the order also stated this 59 would be accomplished no later than August 10, he would have the Building Com- 60 missioner report back on the progress at the regular Board of Works meeting 61 on August 6-. regarding repairs7and the possibility of any additional intent 62 of Mr. Smith at that time, seconded by Mr. Webb and on unanimous voice vote 63 the motion was carried. / 7 Board of Public Works & Safety Minutes Cont'd.
