HomeMy Public PortalAbout10-23-1980 / 7 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, OCTOBER 23, 1980 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in 2 regular session October 23, 1980 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 APPROVAL OF MINUTES 7 11/ 8 Mr. Webb moved to approve the minutes of the previous meeting as prepared, 9 seconded by Mr. Anderson and on unanimous voice vote the motion was carried. 10 11 BIDS SUBMITTED 12 13 Mr. Anderson examined proof of publication for a membrane roof for the Municipal 14 Building and moved it be accepted, seconded by Mr. Webb and on unanimous voice 15 vote the motion was carried. 16 17 The following bids were received and recorded: 18 19 Bailey Roofing $56,043.54 20 21 Chomel & Sons Roofing $52,060.39 22 Alternate for ballasted portion deduct $4,881.01 23 24 Mr. Anderson moved the bids be taken under advisement, seconded by Mr. Webb 25 and on unanimous voice vote the motion was carried. 26 27 MORTGAGE RELEASE - Community Development 28 29 Mr. Ron Cheek of Community Development, presented a mortgage release for 30 property located at 317 South 5th in the amount of $4,127.25. This is the 31 first loan on the revolving fund paid on a monthly basis that has been paid 32 in full. III 33 34 Mr. Anderson moved to execute the satisfaction of the mortgage, seconded by 35 Mr. Webb and on unanimous voice vote the motion was carried. 36 37 REPORT ON DEMOLITION - 1910 North "E" 38 39 The Board gave a time in which this building was to be removed which has 40 lapsed. Mr. Roberts presented pictures taken in September and this morning 41 showing nothing has been done. On September 4 Mr. Stone was allowed forty- 42 five (45) days. Mr. Meredith noted he talked with Mr. \Stone last week who 43 at that time requested to appear before the Board today to request a ten (10) 44 day extension. He was granted this request. Mr. Anderson suggested' enforcing 45 the order of the Board that Mr. Roberts be instructed to comply with the 46 ordinance. Mr. Stone must be given ten (10) days notice then Mr. Roberts 47 should arrange to have it done and it would become a lien upon the property. 48 49 Mr. Meredith moved that the Building Commissioner be instructed to proceed 50 under the terms of the Ordinance and have the building removed, seconded 51 by Mr. Webb and on unanimous voice vote the motion was carried. 52 53 FIRE DEPARTMENT 54 55 Chief Paul Mullin recommended the appointment of Mr. David Stout to-the_ 56 Department as a probationary firefighter effective Saturday,' October 25, 1980. 57 58 Mr. Anderson moved to accept the recommendation, seconded by Mr. Webb and 59 on unanimous voice vote the motion was carried. 60 61 Chief Mullin recommended the installation of fire hydrants at Quail Ridge, 62 approximately 150 feet southwest of the intersection of Hunters Pointe Drive 63 and at the southwest corner of Hodgin Road and Hunters Pointe Drive. October 23, 1980 Page 2 1 Mr. Anderson moved to authorize the installation of the fire hydrants at 2 the locations indicated, seconded by Mr. Webb and on unanimous voice vote 3 the motion was carried. 4 5 POLICE DEPARTMENT 6 7 Major Ron Chestnut presented a letter from Chief Charles Chris requesting 8 the Special Police Powers of Richmond Police Department Reserve Officer 9 Marilyn Murray be revoked effective kmmediately as she has resigned for 10 personal reasons. 11 12 Mr. Webb moved the Police Power of Marilyn Murray be revoked effectively 13 immediately, seconded by Mr. Anderson and on unanimous voice vote the 14 motion was carried. 15 16 Major Chestnut presented a letter from Chief Chris recommending the hiring 17 of three (3) applicants for the position of Probationary Police Officers 18 effective October 27, 1980. The applicants are Martin Hurst, Kris Wolski 19 and James D. Rice. 20 21 Mr. Anderson moved to accept the recommendation of the Chief of Police for 22 the hiring of these three (3) Probationary Police Officers, seconded by Mr. 23 Webb and on unanimous voice vote the motion was carried. 24 25 REQUEST FOR STREET LIGHTING 26 27 Mr. Webb presented requests for street lighting for the following locations : 28 Meadowbrook Road and Meadowbrook Lane; Hibberd Drive; S. W. 19th and N. W. 29 18th. 30 31 Mr. Anderson moved they be taken under advisement, seconded by Mr. Webb and 32 on unanimous voice vote the motion was carried. 33 34 LIMB & BRUSH REMOVAL POLICY 35 36 Mr. Meredith read the following policy: 37 38 LIMB AND BRUSH REMOVAL POLICY 39 40 The Sanitation Department will pick up any limbs, brush or garden waste 41 that does not exceed 4' in length and is tied in bundles of 25# or less. 42 It will only be picked up on your regular route schedule. 43 44 The Department of Transportation will pick up limbs that have fallen or 45 have been cut from trees that are located on public right-or-way. Such 46 locations include between sidewalk and curb, alleys and public easements. 47 It is not necessary for these limbs to be cut to a smaller size for pickup. 48 49 The Park Department is responsible for the removal of dead or unsafe 50 trees from public property. Only those limbs which create a safety hazard 51 will be cut by the Park Department. The trimming ;of trees located in 52 public right-of-ways is the responsibility of the property owner. 53 54 Anyone planting, trimming or cutting of trees located in public right-of- 55 ways must have permission from the Park Superintendent before doing so. 56 57 Trees, limbs, brush or garden waste originating from private property 58 will not be picked up unless cut to proper size and weight and placed 59 for your regular trash collection day pickup. 60 61 If you do not wish to cut and bundle these materials, you must move them 62 at your expense. They may be taken to the landfill located on New Paris 63 Pike. The landfill is open Monday through Friday - 8:00 AM to 3:30 PM. Board of Works Minutes Cont'd. October 23, 1980 Page 3 1 These rules will not necessarily be followed should a storm or cata- 2 strophic condition occur. At that time all city departments will respond 3 as needed. 4 5 Again, trees, limbs or brush that originates on private property will 6 not be picked up unless properly cut to 4' lengths or less and bundled 7 not to exceed 25# in weight. 8 9 UNSAFE BUILDING HEARING - 1611 North "B" 111 10 11 City Attorney Ed Anderson conducted the hearing, noting this hearing is held 12 pursuant to Ordinance No. 100-1979. Mr. Roberts has issued the order pursuant 13 to Section 4. Service of the order was in accordance with Section 8 by 14 certified mail and the return receipt was entered in the record. This hearing 15 is held pursuant to Section 9 of the Ordinance. The Defendant, Mary Siegrist, 16 was not present nor represented by counsel. 17 18 The Clerk read the following order: 19 20 Order Issued Pursuant to 21 City of Richmond 22 Ordinance No. 100-1979 23 24 Order Issued to: Mary Siegrist September 19, 1980 25 5845 Joshua Street 26 Lansing, Michigan 48910 27 28 RE: Lot 20C, Price & Ferguson Addition 29 1611 North B Street 30 31 The building or structure, or part thereof, located on the real estate 32 described above has, as a result of inspection and investigation by the 33 Building Commissioner of the City of Richmond, been found to be in an III34 impaired structural condition or state which renders it unsafe or dan- 35 gerous to persons and property. Said findings are according to the 36 specifications of an unsafe building as set forth in Section 2 (b)- 37 (4) (5) (6) (7) (9) (11-1) (12) (15) (16) of City of Richmond Ordinance No. 38 100-1979. 39 40 Therefore, it is hereby ordered that the following action be accomplished 41 in regard to this property: 42 43 Remove unsafe building (According to Section 3, Paragraph 6, 44 City of Richmond Ordinance No. 100-1979. 45 46 The above stated order of action shall be accomplished no later than 47 November 20, 1980. 48 49 A hearing regarding this order will be held in the Board of Works Room 50 at the Municipal Building, 50 North 5th Street, Richmond, Indiana, at 51 10:00 a.m. on October 23, 1980. You may appear at the above said hear- 52 ing to show cause why this order should not be complied with; you may 53 be represented by an attorney, present evidence, call witnesses and 54 make arguments at the hearing. If you fail to appear, the hearing:•, 55 will be held in your absence. If the order is affirmed, the Building 56 Commissioner will cause said action to be taken pursuant to this order. 57 The costs thereof will be assessed against you on the real estate tax 58 duplicate. Further, failure to comply with this order will subject 59 you to litigation. 60 61 You have an obligation according to Section 12 or Ordinance No. 100- 62 1979 to supply full information regarding this order to any person 63 who may take or agree to take a substantial property interest in the 64 unsafe premises, prior to such transfer or agreement to transfer; also Board of Works Minutes Cont'd. October 23, 1980 Page 4 1 to supply to the Building Commissioner, within five (5) calendar days 2 of the transfer or agreement to transfer, (a) the full name, address 3 and telephone number of the person acquiring substantial property 4 interest, and (b) a true and accurate copy of the legal instrument 5 under which the transfer or agreement to transfer is accomplished. 6 7 Charles E. Roberts 8 Building Commissioner 9 10 Mr. Roberts presented evidence and had a report of findings made by his in- 11 spectors which is quite lengthy. He presented pictures of the structure 12 noting it has had two (2) fires and is very accessible. It has been an eye 13 sore to the City. The first contact was made in May of 1976 at which time 14 Community Development offered to remove the house at no cost to the owner. 15 There is severe wood rotting, windows broken, loose brick in chimney and 16 deteriorating foundation. The record shows some of the pictures were taken 17 in July 1978 and January of 1980. The finding of facts of his department 18 should be entered into the record. Bureau of Buildings Inspector Gerald 19 Smith confirmed Mr. Roberts findings and stated he wrote the finding of facts. 20 Mr. Roberts stated it is not feasible to repair the structure. 21 22 Mr. Roberts stated the owner has never indicated she intends to repair or 23 sell the structure. The lot is less than 40' wide and nothing could be 24 rebuilt on it. 25 26 Mr. Meredith moved that the Board find an unsafe building in accordance with 27 the Unsafe Building Ordinance No. 100-1979 on the property located at 1611 28 North "B", Lot 20C, Price & Ferguson Addition and that the Board affirm the 29 order of the Building Commissioner and that the property be razed no later 30 than November 20, 1980 and, if not so done by the owner of the property, 31 that he proceed with demolition under the Ordinance mentioned above, 32 seconded by Mr. Webb and on unanimous voice vote the motion was carried. 33 34 There being no further business the meeting was adjourned. 35 36 Donald E.
