BOARD OF .PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, OCTOBER 2, 1980
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met
2 in regular session October 2, 1980 at the hour of 9:00 a.m. in the Municipal
3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb
4 present. The following business was had, to-wit:

6 APPROVAL OF MINUTES

8 Mr. Webb moved to approve the minutes of the previous meeting as prepared,
9 seconded by Mr. Anderson and on unanimous voice vote the motion was carried.

11 BID OPENING - POLICE RADIOS

13 Mr. Anderson examined proof of publication for 53 portable radios, 2 mobile
14 two-way radios and 40 individual chargers for portable radios and moved it
15 be accepted, seconded by Mr. Webb and on unanimous voice vote the motion
16 was carried.

54 Mr. Anderson moved the bids be taken under advisement, seconded by Mr. Webb
55 and on unanimous voice vote the motion was carried.

57 FIRE DEPARTMENT - Chief Mullin .

59 Fire Chief Paul Mullin recommended Michael Foust be advanced to the rank of
60 Fire Fighter, First Class, effective as of October 4, 1980. Mr. Webb moved
61 for approval of the recommendation of the Fire Chief, seconded by Mr. Anderson .
62 and on unanimous voice vote the motion was carried.

64 PERMISSION TO USE FIRE TRUCK FOR HOMECOMING PARADE - Chief Mullin

1 Fire Chief Paul Mullin requested permission for Richmond Senior High School
2 Homecoming Committee to use two (2) aerial trucks in their annual Homecoming
3 Parade. He noted the trucks will be in service and a pumper will be at the
4 bonfire following the parade. Mr. Webb moved that the request be granted,
5 seconded by Mr. Anderson and on unanimous voice vote the motion was carried.

7 DRIVEWAY PETITION - 822 No. "I"

9 Mr. Webb presented a driveway petition request from Vilhairlal Damoni for
10 822 North "I" Street. The request has been checked by Traffic, Engineering
11 and Planning and all three (3) recommend approval. Mr. Webb moved for
12 approval of the subject petition, seconded by Mr. Anderson and on unanimous
13 voice vote the motion was carried.

15 PAVEMENT MARKING

17 Mr. Webb read in part a letter from the Indiana State Highway Commission
18 concerning pavement marking requesting the evaluation phase set out in our
19 LPA Consultant Agreement be eliminated as we have been notified that it is
20 not eligible to be performed with reimbursable funds. The other phases were
21 100% Federally funded. Mr. Webb moved to approve the elimination of the
22 evaluation phase of the subject project, seconded by Mr. Anderson and on
23 unanimous voice vote the motion was carried.

25 MONTHLY REPORT - Roberts

27 Building Commissioner Charles Roberts presented his monthly report for
28 September, 1980. Mr. Anderson moved it be approved, seconded by Mr. Webb and
29 on unanimous voice vote the motion was carried.

31 REPORT ON 1803 E. MAIN - Roberts

33 Mr. Roberts reported Mr. Tony Wilson was in his office last week and assured
34 Mr. Roberts he would have a contract within ten (10) days to tear down the
35 building at 1803 E. Main, including the house behind this one. A hearing
36 will be conducted on this property at 10:00 a.m. today.

38 REPORT RE: 323 North 16th St. - Roberts

40 Mr. Roberts reported Esther Rader did not appear for the unsafe building
41 hearing for property at 323 North 16th Street and was sent a letter requesting
42 a contract for demolition within ten (10) days. Yesterday was the deadline.
43 Mr. Roberts reported he has had no contact with Ms. Rader but she did receive
44 the letter September 20. Mr. Anderson stated the next step is to send her
45 notice he is going to demolish.

47 SET BID DATE FOR ROOF

49 Mr. Meredith set October 23, 1980 at 9:00 a.m. to receive bids for a new
50 roof on the Municipal Building.

52 SET DATE FOR NUISANCE HEARING

54 Mr. Meredith set October 30, 1980 at 10:00 a.m. to hear a nuisance complaint
55 against William Bishop and Connie Toole, 400 North 9th Street.

57 UNSAFE BUILDING HEARING - 1803 E. Main

59 City Attorney Ed Anderson conducted the hearing, noting this hearing is
60 held pursuant to Ordinance No. 100-1979. Mr. Roberts has issued the order
61 pursuant to Section 4. Service of the order was in accordance with Section
62 8 by certified mail and the return receipt was entered in the record. The
63 Defendant was not present.

14 The building or structure, or part thereof located on the real
15 estate described above has, as a result of inspection and inves-
16 tigation by the Building Commissioner of the City of Richmond, been
17 found to be in an impaired structural condition or state which
18 renders it unsafe or dangerous to persons and property. Said
19 findings are according to the specifications of an unsafe building
20 as set forth in Section 2(b) (4) (8) (11) (16) (17)

22 Therefore, it is hereby ordered that the following action be
23 accomplished in regard to this property:

25 Remove unsafe building (According to Section 3, Paragraph
26 6, City of Richmond Ordinance No. 100-1979) .

28 A hearing regarding this order will be held in the Board of
29 Works Room at the Municipal Building, 50 North 5th Street,
30 Richmond, Indiana, at 10:00 a.m. on September 25, 1980. You may
31 appear at the above said hearing to show cause why this order
32 should not be complied with; you may be represented by an
33 attorney, present evidence, call witnesses and make arguments
34 at the hearing. If you fail to appear, the hearing will be held
35 in your absence. If the order is affirmed, the Building Com-
36 missioner will cause said action to be taken pursuant to this
37 order. The costs thereof will be assessed against you on the real
38 estate tax duplicate. Further, failure to comply with this order
39 will subject you to litigation.

41 You have an obligation according to Section 12 of Ordinance No.
42 100-1979 to supply full information regarding this order to any
43 person who may take or agree to take a substantial property
44 interest in the unsafe premises, prior to such transfer or
45 agreement to transfer; also to supply to the Building Commissioner
46 within five (5) calendar days of the transfer or agreement to
47 transfer, (a) the full name, address and telephone number of
48 the person acquiring substantial property interest, and (b)
49 a true and accurate copy of the legal instrument under which
50 the transfer or agreement to transfer is accomplished.

55.____ Mr. _Anderson noted the record should show that the letter speaks of a hearing
56 __-_ date of September 25 but the minutes of the Board of Works show the hearing
57 date was set for October 2. The hearing could not have been held on the 25th
58 as the Board did not have its full membership. The ordinance provides that
59 the hearings can be continued and can be held in the Defendant's absence.
60 Mr. Roberts has been in touch with the-Defendant and he did not plan to ap-
61 pear. Mr. Wilson stated he will have a contract within ten (10) days of the
62 25th to demolish this building. Mr. Roberts stated the building is not
' 63 secured and is a potential fire hazard. The building has been abandoned.

1 Mr. Anderson stated the Board can affirm, revoke or modify the order of
2 the Commissioner.

4 Mr. Meredith moved that an unsafe building does exist at 1803 E. Main under
5 the terms of -.he ordinance as set forth in the order and to extend the hearing
6 until October 9 to review the contract that should be forthcoming, seconded
7 by Mr. Webb and on unanimous voice vote the motion was carried.

9 REPORT ON BENNETT NUISANCE - Bronston

11 On August 28 Ms. Lois Bennett was given thirty (30) days to have a van and
12 a Charger removed from property located on Horseshoe Court. She was further
13 given until October 30 to remove a 1973 Chevrolet. The period of time has
14 elapsed for the Charger and van and Mr. Bronston reported he was at the site
15 last Thursday and the van is gone but the Charger and Chevrolet are still
16 there. He considers both vehicles to be inoperable. Mr. Anderson suggested
17 the Board direct the zoning enforcement officer to cause the Charger to be
18 removed in compliance with the order. Mr. Meredith so moved that the Charger
19 be removed and the inspector cause it to be removed, seconded by Mr. Webb
20 and on unanimous voice vote the motion was carried.
