ADDENDUM
THIS ADDS UM, (Number 1 to Contract No. 8-2022) is made and entered into this
day of , 2022, by and between Richmond, Indiana, a municipal
corporation acting thro gh its Board of Public Works and Safety with its office at 50 North 5th Street,
Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Mikesell Excavating, Inc., 652
New Garden Road,New Paris, Ohio, 45347(hereinafter referred to as "Contractor").
WHEREAS, City and Contractor entered into Contract No. 8-2022 on March 4, 2022, which
Agreement retains Contractor to provide services in connection with the demolition
of certain structures previously deemed by the Richmond Unsafe Building
Commission to be unsafe properties, for the Code Enforcement Department of the
City of Richmond,Indiana; and
WHEREAS, The Parties have agreed the Contractor shall perform a house demolition of a
property which had previously been deliberately omitted from the original Agreement
and which property continues to be in a state of a need of abatement in accordance
with the previously-affirmed Unsafe Building Order (Instrument Number
2021006097).
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained,
including the above stated recitals, City and Contractor hereby agree as follows:
1. The City and Contractor executed and entered into Contract No. 8-2022, on March
4, 2022, which Agreement is incorporated herein by reference. Pursuant to Contract
No. 8-2022, Section XI (Miscellaneous), the Parties may alter or amend the
Agreement in whole or in part at any time by filing with the Agreement a written
instrument setting forth such changes signed by both Parties. The Parties agree that
upon the issuance of the City's notice to proceed, the Contractor shall also demolish
the house structure located at 44 South 18th Street in Richmond, Indiana, in
accordance with the scope of said Agreement. Compensation paid to Contractor as
described in accordance with Section III (Compensation) of said Agreement for said
additional services shall be increased by an amount not to exceed Eleven Thousand
Two Hundred Dollars and Zero Cents ($11,200.00) as reflected within Contractor's
quote which Contractor has agreed to continue to honor for said property, which
quote is dated December 16, 2021, and attached hereto as Exhibit A to this
Addendum, and which quote is incorporated herein by reference. The new total
amount to be paid to Contractor under the Agreement shall be an amount not to
exceed Seventy-one Thousand Nine Hundred Dollars and Zero Cents
($71,900.00).
2. City and Contractor expressly agree that all other terms, conditions, and covenants
contained in Contract No. 8-2022, shall be applicable to this Addendum, unless such
term, condition or covenant conflicts with this Addendum Number 1, in which case
this Addendum Number 1 shall be controlling.

3. Both Parties hereby agree that with the exception of the additional house demolition
at the property described above, and with the exception of the corresponding
compensation increase, Contract No. 8-2022 shall remain intact and unchanged and
in full force and effect.
4. Both Parties agree that any person executing this Contract in a representative capacity
hereby warrants that he or she has been duly authorized by his or her principal to
execute this Addendum.
