BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, SEPTEMBER 4, 1980'
1 The Board of Public Works and Safety of the City of Richmond, Indiana met
2 in regular session September 4, 1980 at the hour of 9:00 a.m. in the Municipal
3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb
4 present. The following business was had, to-wit;

6 APPROVAL OF MINUTES

8 Mr. Webb moved to approve the minutes of the previous meeting as prepared,
9 seconded by Mr. Anderson and on unanimous voice vote the motion was carried.

11 RETIREMENT - WILLIAM SPARKS
12
13 Fire Chief Paul Mullin recommended acceptance of a letter of retirement from
14 Deputy Fire Marshal William F. Sparks and requested that he be placed on
15 pension effective September 3, 1980. Chief Mullin, Mr. Meredith and Mayor
16 Dickman praised Deputy Sparks for his service noting he had touched more
17 lives than anyone in the City of Richmond through his working with children
18 in the "Sparky" program for the prevention of fires.

20 Mr. Anderson moved to accept the recommendation of the Chief, seconded by
21 Mr. Webb and on unanimous voice vote the motion was carried.

23 BUREAU OF BUILDINGS REPORT

25 Building Commissioner Charles Roberts presented his report for August, 1980.
26 Mr. Anderson moved to accept the report of the Building Commissioner, second-
27 ed by Mr. Webb and on unanimous voice vote the motion was carried.

29 Mr. Meredith recessed the Board until 10:00 a.m. at which time the Board
30 will hold a hearing under the Unsafe Building Ordinance.

32 UNSAFE BUILDING HEARING - 1910 North "E"

34 The Board reconvened at 10:00.

36 Mr. Merdith turned the chair over to City Attorney Ed Anderson who explained
37 the procedure and ordinance under which this hearing is held. Building
38 Commissioner Charles Roberts has issued an order and presented a copy of
39 the certified receipt showing the acceptance of the order. Mr. Stone was
40 present.

57 The building or structure, or part thereof, located on the real
58 estate described above has, as a result of inspection and inves-
59 tigation by the Building Commissioner of the City of Richmond,
60 been found to be in an impaired structural condition or state which
61 renders it unsafe or dangerous to persons and property. Said find-
62 ings are according to the specifications of an unsafe building as
63 set forth in Section 2 (b) (4) (3) (4) (10) (11) (17) .

1 Therefore, it is hereby ordered that the following action be
2 accomplished in regard to this property:

4 Remove unsafe building (According to Section 3, Para-
5 graph 6, City of Richmond Ordinance No. 100-1979) .

7 A hearing regarding this order will be held in the Board of Works
8 Room at the Municipal Building, 50 North 5th Street, Richmond,
9 Indiana, at 10:00 a.m. on September 4, 1980. You may appear at
10 the above said hearing to show cause why this order should not be
11 complied with: you may be represented by an attorney, present
12 evidence, call witnesses and make arguments at the hearing. If
13 you fail to appear, the hearing will be held in your absence.
14 If the order is affirmed, the Building Commissioner will cause said
15 action to be taken pursuant to this order. The costs thereof will
16 be assessed against you on the real estate tax duplicate. Further,
17 failure to comply with this order willsubj-act you to litigation.

19 You have an obligation according to Section 12 of Ordinance No.
20 100-1979 to supply full information regarding this order to any
21 person who may take or agree to take a substantial property interest
22 in the unsafe premises, prior to such transfer or agreement to
23 transfer; also to supply to the Building Commissioner, within
24 five (5) calendar days of the transfer or agreement to transfer,
25 (a) the full name, address and telephone number of the person
26 acquiring substantial property interest, and (b) a true and acur-
27 ate copy of the legal instrument under which the transfer or
28 agreement to transfer is accomplished.

33 Mr. Stone acknowledged receipt of the order, understanding it, owning the
34 premises and agreeing with the findings of the Building Commissioner. Mr.
35 Roberts presented pictures taken this morning of the premises and noted
36 that a demolition permit was written six (6) months ago. Mr. Stone ac-
37 knowledged the pictures as being of his property. Mr. Stone acknowledged
38 understanding of the Ordinance under which the property is found unsafe.
39 Mr. Stone stated he has been doing the demolition himself as he does not
40 have the money at this time to hire someone to do it. Mr. Stone stated the
41 fire occurred on February 28, 1980, which was the date the wrecking permit
42 was required; however, the Fire Department would not release the building
43 until over thirty (30) days as they were investigating the cause of the
44 fire. Upon receiving the order, he has been working over the last week or
45 ten (10) days to level the building. He is negotiating with the adjoining
46 property owner to use the basement of the property for a garage for the
47 corner property as the lot is not sufficient for rebuilding under the current
48 zoning codes. He stated he is closing a property in mid October which would
49 give him the funds to complete his plans and requested sixty (60) days to
50 complete this work.

52 Mr. Anderson noted it was the concern of this Board whether or not an unsafe
53 building exists and they have the right to set the number of days to have it
54 demolished. If Mr. Stone does not have it completed in this period of time,
55 the City will have it done and place a lien against the property.

57 Mr. Roberts noted if the basement is going to be used, it would have to be
58 barricaded until such time as the work is completed. Hr further stated
59 that the charred lumber should not be used for construction in the City.
60 Mr. -Roberts questioned Mr. Stone concerning liability and Mr. Stone stated
61 his insurance is still in force.

63 Mr. Anderson stated the Board can confirm, rescind or modify the order of
64 the Commissioner.

1 Mr. Meredith moved that there is an unsafe building existing on property
2 located at 1910 North "E" Street and that the condition be removed by the
3 owner Ronald E. Stone on or before forty-five (45) days; if this is not
4 done then the City will cause it to be done under the Unsafe Building
5 Ordinance No. 100-1979 according to the terms of that ordinance, seconded
6 by Mr. Webb and on unanimous voice vote the motion was carried.

8 The completion date for demolition will be October 20, 1980 and Mr. Roberts
9 is to report back to this Board October 23, 1980.

11 Mr. Anderson returned the chair to Mr. Meredith and there being no further
12 business the meeting was adjourned.
