OF THE CITY OF RICHMOND, INDIANA, AUGUST 21, 1980 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session August 21, 1980 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr . Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 APPROVAL OF MINUTES 7 8 Mr. Webb moved to approve the minutes of the August 14, 1980 meeting as pre- 9 pared, seconded by Mr. Anderson and on unanimous voice vote the motion was , 10 carried. 11 12 RECEIVE BIDS ON DUMP TRUCKS 13 14 Mr. Anderson examined proof of publication for two (2) 2 -22 ton dump trucks 15 with dump bed, snow plow/hitch and material spreader and moved it be accepted, 16 seconded by Mr. Webb and on unanimous voice vote the motion was carried. 17 18 The following bids were received and recorded: 19 20 Studebaker Buick - 1 ea. 1981 IHC $25,110.20. Mr. Meredith noted there 21 are various bid prices for change in equipment depending on the type of 22 snow plow. 23 24 1 ea. 1981 Allied $25,610.00 25 26 Tri State Ford Truck Sales, Inc. - 2 1980 Fords $45,054.80 27 28 Mr. Anderson moved the bids be taken under advisement, seconded by Mr. Webb 29 and on unanimous voice vote the motion was carried. 30 31 DRIVEWAY PETITION III 32 33 Mr. Webb presented a driveway petition from Mr. Darrell Ronan for a driveway 34 at 1820 W. Main. This request has been checked by Traffic, Plan and Engineer- 35 ing Departments and all recommend approval. Mr. Webb moved for approval of the 36 subject driveway petition, seconded by Mr. Anderson and on unanimous voice vote 37 the motion was carried. 38 39 STREET LIGHT REQUEST 40 41 Mr. Webb presented the following request for street lights as requested by Mr. 42 R. L. Rees, commercial manager for RP&L on recommendation of the Street Light 43 Committee: 44 45 One (1) 250 watt Mercury Vapor Street Light on wood pole on South 21st 46 Street south of "L" at a cost of $6.07 per month. 47 48 Mr. Webb moved for approval of the subject request, seconded by Mr. Anderson 49 and on unanimous voice vote the motion was carried. 50 51 Two (2) 250 watt Mercury Vapor Street Lights on wood poles along West 52 Eaton Pike between U.S. 40 south to City Limits at a cost of $12.14 53 per month. 54 55 Mr. Webb moved for approval of the subject request, seconded by Mr. Anderson 56 and on unanimous voice vote the motion was carried. III 57 58 Ten (10) 250 watt Mercury Vapor Street Lights on wood poles along Wood- 59 side Drive and on Hayes Arboretum Road, Sycamore Drive, and Gravel Pit 60 Road at a cost of $60.70 per month. 61 62 Mr. Anderson moved to approve the request but eliminate the one (1) light on 63 Hayes Arboretum Road, therefore, approving nine (9) lights, seconded by Mr. 64 Webb and on unanimous voice vote the motion was carried. Page 2 1 ANNEXATION FISCAL PLAN 2 3 Director of City Planning Bob Goodwin stated he had furnished a copy of the 4 fiscal plan to Attorney Robert Burton, who represents the Citizens Against 5 Annexation. There is a copy for the public in the Plan Office and one in 6 the Office of the City Clerk. The plan was posted in the area last Tuesday. 7 To date no comments have been received. Mr. Goodwin recommended the following 8 changes: (1) deletion of reference to the Barrett Law on pages 2 and 4 9 (2) page 3 item d insert word "average" between total and population 10 (3) page 13 last paragraph insert "the Administration and" between if and 11 Council. He stated he hoped the Board would make any other changes after 12 hearing comments from the public and adopt the amended version through reso- 13 lution and minutes. 14 15 Mr. Anderson stated he feels on page 2 there should be some reference made to 16 services being made available to the area in conformance with relevant State 17 law and utility policy. There are certain services the City does not auto- 18 matically furnish, these must be by petition. On page 4 something should be 19 put in to the effect that the exact detail as outlined in the reports may 20 change as needs are re-evaluated and services re-allocated through the entire 21 City. Regardless of the change in details, the services will be provided to 22 this annexed area in the same manner and level that they are provided else- 23 where in the City. Mr. Anderson noted he checked to see if the final plan 24 meets certain tests, such as cost estimates of planned services, method of 25 financing planned services, plan for organization and extension of services, 26 services of noncapital nature (fire, police, etc.) (Mr. Anderson recommended 27 these be equivalent in standard and scope as available within the City) , ser- 28 vices of a capital improvement nature (he would include in a manner consis- 29 tent with federal, state and local laws, proceedures and planning criteria) . 30 He recommended being more specific in the police duties describing the ser- 31 vices. Attorney Robert Burton asked a detailed explanation of how the City 32 is providing fire service to the area in question. 33 34 Mr. Anderson moved, along with Mr. Goodwin's suggestions, that the present111 35 page 2 be removed in the plan and the revised page 2 be substituted therein 36 and that in addition on page 2 by the elimination of the reference to the 37 Barrett Law the following paragraph be substituted "Services will be made 38 available to the area in conformance with relevant state law and utility 39 policies". I would move then as requested by Mr. Goodwin on page 3 that in 40 item 4 d the word average be placed after total and before the word population. 41 I would move as recommended by Mr. Goodwin that page 4 be stricken from the 42 plan and the substituted page 4 be placed therein and by elimination of the 43 third paragraph on page 4 that there be substituted .therefor the following: 44 the exact detail as outlined in the following report may change as needs are 45 re-evaluated and services re-allocated throughout the entire City regardless 46 of the change in detail, the services will be provided to the annexed area 47 in the same manner and level that they are provided elsewhere in the City of 48 Richmond. I would urge and suggest and recommend that the Planning Depart- 49 ment perhaps elaborate more under police protection as to the services pro- 50 vided by the Police Department along those lines as I earlier suggested. I 51 would move on page 13 that the word Council be stricken and the word City be 52 substituted therefor. I would move that on the unnumbered page following 16 53 probably being page 17 of said report that in paragraph 1 there be specific 54 reference to those services exceeding the requirements of state statute and 55 that in paragraph 3 that there be specific reference to those residents re- 56 ceiving this improvement in service and further that again some reference be 57 made by adding a paragraph thereto again to the effect that the services in 58 this area will be the same as those provided to the City of Richmond, seconded 59 by Mr. Webb and on unanimous voice vote the motion was carried. 60 III 61 Mr. Anderson moved that with these changes the Board now having reviewed said 62 fiscal plan and making changes and amendments thereto approves said fiscal 63 plan, seconded by Mr. Webb and on unanimous voice vote the motion was carried. /7 7 Board of Works Minutes Cont'd. August 21, 1980 Page 3 1 MONTHLY REPORT - RADIO TECHNICAN 2 3 Mr. Anderson moved that the June and July monthly report of the Radio 4 Technican be accepted, seconded by Mr. Webb and on unanimous voice vote 5 the motion was carried. 6 7 SET DATE FOR UNSAFE BUILDING HEARING- 8 9 Mr. Meredith set 10:00 a.m. September 4, 1980 to hear the property located 10 at 1910 North "E" Street 11 Mr. Meredith set 10:00 a.m. October 2, 1980 to hear the property located at 12 1803 East Main. 13 14 NOTICE FROM STATE HIGHWAY 15 16 Mr. Meredith read a communique from the State Highway Commission concerning 17 the crossing at Main Street and N. W. 5th as requested by Attorney Paul 18 Vertesch representing Interfaith Housing. The State agreed to check the 19 timing on traffic signals for pedestrian crossing on the "walk" and "don't 20 walk" signs, and, they have also issued a work order to apply new markings 21 at this intersection as soon as work load permits. They requested the City 22 concur with them for a "no turn on red" being on the north, east and west 23 approaches but continue to allow a "turn right on red" on the south approach, 24 which would permit a turn to the east. Traffic Capt. Dan Wogoman recommended 25 the Board concur with this. 26 27 Mr. Anderson moved to concur, seconded by Mr. Webb and on unanimous voice 28 vote the motion was carried. 29 30 DUMP TRUCK BIDS 31 32 The Clerk brought to the attention of the Board that the legal ad requesting 33 bids for the dump trucks for the Department of Transportation stated that 34 bids would be received at 9:00; however, a letter which accompanied the specs 35 went out over the signature of the Clerk that the bids would be received at 36 10:00 a.m. , a copy of which follows: 37 38 August 4, 1980 39 40 Gentlemen: 41 42 The Board of Public Works and Safety of the City of Richmond, Indiana will 43 receive bids for one (1) dump truck 2-22 tons complete with dump bed, snow 44 plow/hitch and material spreader until the hour of 10:00 a.m. on Thursday, 45 August 21, 1980. Enclosed please find specifications. 46 47 All proposals should be on Form No. 95 and accompanied by a Bidder's Bond, 48 Certified Check, or Cashier's Check in the amount of not less than 5% of 49 the total proposal price. 50 51 Thank you for your interest in bidding for the City of Richmond. Mr. Meredith asked City Attorney Ed Anderson for an opinion. Mr. 62 Anderson stated it is his opinion that the purpose of the legal,ad is to put 63 the world on notice that we are going to be spending public funds for a pur- 64 " pose and to designate the time and place so the public knows. I 2 see how no one has been harmed as they are under advisement and it is to 3 the benefit of the City to get all the bids it can; . therefore, it is my 4 opinion that it should be an informality waived. Mr. Webb questioned that 5 a bid may have been changed since the 9:00 a.m. opening. Mr. Meredith noted 6 that the non collusion affidavit must be signed and anyone so doing would 7 perjure themselves. Mr. Haynes said he thought the bid opening was at 8 10:00. Mr. Ron Hahn, Tri State Ford of Cincinnati, objected stating that 9 his firm based their bid on the 9:00 o'clock opening and recommended the 10 bids all be rejected and re-bid. Mr. Ed Callis, Tom Brookbank Chevrolet, 11 pointed out that he and the Fred First Ford representative, along with 12 Director of the Department of Transportation Jerry Haynes all thought 13 the opening would be at 10:00 and were all there before this time. Mr. 14 Anderson stated he feels no element of the competitiveness has been destroyed. 15 16 Mr. Anderson stated that recognizing this as an informality and an error in 17 no way, in his opinion, jeopardizing the bidding requirements, and moved that 18 the informality, be waived and the Board receive additional bids, seconded 19 by Mr. Webb and on unanimous voice vote the motion was carried. 20 21 The following bids were received and recorded: 22 23 Fred First Ford - 2 1980 Fords $30,364. The complete price with western 24 plow from Gentry $23,714.50; Robinson Flick $25,809. western $23,781; 25 Allied flick $26,308.20 western $23,808.20 26 27 Tom Brookbank Chevrolet Inc. - total price per unit (no taxes) $21,490.52 28 29 Mr. Webb moved that these bids also be taken under advisement, seconded by 30 Mr. Anderson and on unanimous voice vote the motion was carried. 31 32 RECEIVE BIDS ON PARKING GARAGE RESURFACING 33 34 Mr. Anderson examined proof of publication for repair and renovation of the 35 parking garage and found it to be in order. Mr. Webb moved the proof be11/ 36 accepted and placed on file, seconded by Mr. Anderson and on unanimous voice 37 vote the motion was carried. 38 39 The following bids were received and recorded: 40 41 Oberle & Associates - clean, prime and seal $51,450.00 42 43 Bridgedeck Protection & Sealing Co. , Inc. - $77,175.00 44 45 J. S. Sweet Co. , Inc. - $101,675.00 46 47 Ben Dee Inc. - $98,000.00 48 49 Mr. Anderson moved that the bids be taken under advisement, seconded by Mr. 50 Webb and on unanimous voice vote the motion was carried. 51 52 There being no further business the meeting was adjourned. 53 54 Donald E.
