HomeMy Public PortalAbout06-05-1980 /37 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JUNE 5, 1980 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in 2 regular session June 5, 1980 at the hour of 9 :00 a.m. in the Municipal Build- 3 ing of said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 Mr. Webb moved the minutes of the previous meeting be approved and placed on 7 file as prepared, seconded by Mr. Anderson and on unanimous voice vote the 11/ 8 motion was carried. 9 10 Mr. Meredith announced a public hearing will be held June 9 from 8:30 to noon 11 at McGuire Hall by the Indiana Public Service Commission. The purpose is to 12 discuss the proposed General Telephone of Indiana rate increases. He urged 13 all citizens of the community to attend this meeting and discuss their views 14 of the increase. The City of Fort Wayne is a formal intervenor in this case, 15 which is now before the PSCI. 16 17 Ms. Cynthia Renz, representing the City's Energy Program, requested approval 18 of a public meeting to be held Tuesday:,, June 10 at 7:00 p.m. in Council 19 Chambers for citizen comment. They are applying for one half million dollars 20 in loan grant money for the Richmond community for improvements on business 21 buildings or homes. Target groups are low to moderate income and small busi- 22 ness owners. There is also money set aside for people of any income to install 23 new technology for testing. Mr. Meredith set Tuesday, June 10 at 7:00 p.m. 24 for this meeting. 25 26 Fire Chief Paul Mullin recommended the acceptance of the retirement of Lt. 27 Larry Heathcoe from the Fire Department effective June 1, 1980 and that he 28 be placed on pension. Mr. Webb so moved, seconded by Mr. Anderson and on 29 unanimous voice vote the motion was carried. 30 31 Chief Mullin recommended the appointment of Mr. Allen Chamberlain to the de- 32 partment as a probationary firefighter effective June 6, 1980. Mr. Webb 111 33 moved the subject appointment be approved, seconded by Mr. Anderson and on 34 unanimous voice vote the motion was carried. 35 36 Chief Mullin requested a date be set to accept bids on two (2) department 37 vehicles. Mr. Meredith set July 3 at 9:00 a.m. to receive these bids. 38 39 Concerning a request for temporary closing of the Conrail crossing on N. W. 40 5th, Capt. Dan Wogoman, Traffic Department, stated he has contacted all the 41 trucking companies and advised them. Mr. Meredith stated it is necessary to 42 close this crossing to remove the north tracks and to move the signalization 43 for widening of the crossing in connection with widening N. W. 5th. Mr. 44 Meredith noted they are requesting the closing for four (4) days starting 45 Monday, June 9. Mr. Webb noted the four days are for physical removal and 46 the crossing will not be finished at the end of that time. A detour route 47 was outlined for traffic during this time as follows: Large trucks will 48 use N. W. "L" west to Salisbury Rd. , south to Main and back to town. Cars 49 will use N. W. "F" to 2nd to Richmond Avenue or N. W. "E". 50 51 Mr. Webb moved that the Board of Works grant approval for closing the N. W. 52 5th Street Conrail crossing for the proposed widening starting Monday, June 53 9, seconded by Mr. Anderson. Mr. Anderson asked Mr. Webb if he was including 54 a time period in his motion and Mr. Webb stated he was not. Discussion was 55 held on weather conditions and unforeseen problems which..might occur. Mr. 56 Meredith stated he would hope the crossing would be open for the week-end 57 and without that included in the motion, he will be voting against the motion. 58 Mr. Webb voted in favor of the motion with Mr. Anderson and Mr. Meredith 59 voting against the motion. 60 61 Mr. Anderson moved that the Conrail crossing on N. W. 5th be temporarily 62 clsoed for the purpose of removing tracks, making other necessary repairs, 63 widening, moving the signalization commencing Monday, June 9 for a period 64 of four days, seconded by Mr. Webb. June 5, 1980 Page 2 1 the signalization being done in four (4) days, so Mr. Anderson amended his 2 motion to remove signalization, seconded by Mr. Webb. Following discussion, 3 Mr. Meredith requested that, if the motion passes, the Traffic Captain check 4 to see the progress and report back to this Board at next. week's meeting. 5 Mr. Meredith announced voting on the amendment and on unanimous voice vote 6 the motion was carried. Mr. Meredith announced voting on the motion as 7 amended and on unanimous voice vote the motion was carried. 8 9 Mr. Meredith set 9:00 a.m. June 19, 1980 to receive bids on Street Depart- 10 ment materials and gasoline & diesel fuel. 11 12 Mr. Meredith announced the fiscal plan for the proposed annexation is post- 13 poned until the meeting next week. 14 15 Mr. Anderson moved the report of the Department of Weights & Measures for 16 May, 1980 be accepted, seconded by Mr. Webb and on unanimous voice vote the 17 motion was carried. 18 19 Mr. Anderson moved the report of the Bureau of Buildings for May 1980 be 20 accepted, seconded by Mr. Webb and on unanimous voice vote the motion was 21 carried. 22 23 Mr. Meredith set Thursday, July 3 to hear the following two (2) nuisance 24 complaints: David Dilley, owner and Charles Stikeleather, resident, 1109 25 Parry; Donald & Cuba Duckett, 1217 So. 5th. 26 27 Mr. Meredith recessed until 10:00 a.m. 28 29 The Board reconvened at 10:00 a.m. to hold a nuisance hearing for Mervin 30 Sheets, 1107 Sheridan. Mr. Meredith relinquished the Chair to Mr. Anderson, 31 who presided at the hearing. Mr. Anderson noted the defendant is not pre- 32 sent. The record will show that the Defendant was served with a notice of 33 the complaint by certified mail, that the notice was refused by the Defen- 34 dant, that by the notice he was ordered to appear at this time and that 35 within our knowledge the Defendant is not under any legal disability and 36 has sufficient understanding to realize the nature and effect of the notice. 37 The City of Richmond or the Complaintant, Mr. Bronston, has sufficient 38 evidence which could be introduced in support of the claim with which to 39 establish prima facie case even with the Defendant not present. Mr. Anderson 40 presented the notice unclaimed - that he refused to accept it. Mr. Meredith 41 asked if the address was proper on the envelope that was returned. Mr. 42 Anderson stated it is his last known address. 43 44 Mr. Bronston stated he received the complaint in March about an inoperable 45 vehicle and other associated complaints, which were not presented. He con- 46; tacted•_ Mr. Sheets at his home at 1107 Sheridan in the early part of April 47 and told him about the complaint of the inoperable vehicle being stored there. 48 He explained to him what the procedure was and told him he would have to. 49 have it removed or a complaint would be filed. Mr. Bronston then sent him 50 the customary form letter with a copy of the ordinance. Mr. Bronston filed 51 the complaint on May 15. He was back at the site today and the vehicle is 52 still on the property. Tax records at the Court House show Mr. Sheets is the 53 owner of the property and he was seen at this address as early as last week. 54 Mr. Bronston submitted a picture of the vehicle which was taken this morning, 55 showing the vehicle in the same location and appearing to be inoperable as 56 some of the tires are flat. At the time he was there earlier, the vehicle 57 did not have plates on it. During his earlier conversation with Mr. Sheets, 58 Mr. Sheets stated the car did need a battery. Mr. Meredith noted in the 59 picture there was a refrigerator and Mr. Bronston stated the refrigerator 60 has been removed. 61 62 Mr. Anderson stated the Board must now determine if the inoperable vehicle 63 is a nuisance under the ordinance. /.37 Board of Works Minutes Cont'd. June 5, 1980 Page 3 1 Mr. Meredith moved that a nuisance does in fact exist on the premises at 2 1107 Sheridan Street and that the Defendant, Mervin Sheets, does own the 3 premises on which the nuisance does exist and that the nuisance be removed 4 within a thirty day period and failure to do that the Board of Works and 5 Public Safety will have that nuisance removed and the cost assessed against 6 the Defendant and placed on the real estate tax duplicate for collection, 7 seconded by Mr. Webb. On voice vote of Mr. Meredith and Mr. Webb the 8 motion was carried. 9 111 10 Mr. Anderson stated the next matter before the Board if whether the order 11 issued by this Board on May 5 for a Defendant by the name of William Hobbs 12 at 1821 N. W. "C" has been executed. The Board had found a nuisance and 13 issued an order to remove. It has now been thirty (30) days. 14 15 Mr. Bronston stated he was there yesterday and the order has been complied 16 with entirely. 17 18 Mr. Anderson therefore asked that the Board dismiss its order. Mr. Webb 19 so moved, seconded by Mr. Meredith and on voice vote of Mr. Meredith and 20 Mr. Webb the motion was carried. 21 22 Mr. Anderson turned the Chair back to Mr. Meredith. 23 24 Mr. Anderson noted that under the Unsafe Building Law Charles Roberts 25 issued an order after finding basis for an unsafe building under one of the 26 ordinance situations. They have ten (10) days to comply. If they do not 27 comply, Mr. Roberts will be bringing this to the Board to set for hearing 28 and this can be set within five (5) days and the same hearing process as 29 the nuisance ordinance will be used. 30 31 There being no further business the meeting was adjourned. 32 33 Donald E.
