HomeMy Public PortalAbout05-01-1980 / 3 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, MAY 1, 1980 1 The Board of Public Works and Safety of the City of Richmond, Indiana met 2 in regular session May 1, 1980 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. 4 Webb present. The following business was had, to-wit: 5 6 Mr. Anderson moved to approve the minutes of the previous meeting as pre- 7 pared, seconded by Mr. Webb and on unanimous voice vote the motion was carried. 8 9 At the previous meeting a request for constructing a fence on City-owned right- 10 of-way from Mr. & Mrs. Everett Allen was taken under advisement for Mr. Ander- 11 son to study. Mr. Anderson reported that from his research the Board has two 12 choices: they could grant an easement for right-of-way but its use must be in 13 the best interest of the public, or if there is no longer any use of the land 14 as public property, it could be vacated if the Alleng would petition. 15 16 Mr. Meredith noted Mr. Webb had stated in the previous meeting that only five 17 feet (5') would be the maximum that could be vacated. Mr. Webb noted the pre- 18 sent right of way -requirement is fifty feet (50') and this right of way is 19 sixty feet (60') . Mr. Anderson noted he feels this request is not in the 20 public interest as it serves only one resident. Mr. Anderson moved that the 21 request be denied, seconded by Mr. Webb. 22 23 Mrs. Allen asked if it is possible for them to buy or lease the right-of-way 24 to which Mr. Webb stated this is not possible as the right-of-way is dedicated 25 for the public and the City does not hold title to that land. Mr. Allen noted 26 trucks, including City trucks, are using his land on South 3rd Street as an 27 alley. Mr. Meredith noted the City would be opening itself to liability if 28 permission is given for this request. . Mr. Anderson called for the question 29 and on unanimous voice vote the motion was carried. 30 31 Mr. Meredith requested Mr. Webb get with the Allens and figure out the alley 32 situation. He requested Mr. Goodwin check an existing fence of the Allen's 33 neighbor for encroachment on right-of-way. 34 35 Ms. Martha Kutche, representing the Church of Jesus Christ of the Latter Day 36 Saints, appeared to request permission to hold a Trail Run on May 26 in cele- 37 bration of the Church's sesquicentenniel and improve physical fitness. In 1830 38 the Church moved west on National Trail and they want to recreate this west- 39 ward movement. They already have State Highway approval. Traffic Capt. Dan 40 Wogoman had no objections and Chief of Police Charles Chris stated his depart- 41 ment will provide a police escort. 42 43 Mr. Anderson moved to approve the request of the Church of Jesus Christ of the 44 Latter Day Saints for a marathon Trail Run on U. S. 40 through the City of 45 Richmond on Memorial Day, 1980, subject to approval by the Traffic Department 46 with proper escort and proper identification as might be required for protec- 47 tion of the runners, seconded by Mr. Webb and on unanimous voice vote the 48 motion was carried. 49 50 Capt. Wogoman reported concerning the report of drag racing, reckless driving, 51 etc. around the High School on S. W. "E" Street that his Department has been 52 in the area for the past week at the morning school period, noon period and 53 school let-out time. As of this time, they find no drag racing or other forms 54 of reckless driving going on during their times in the area. They will con- 55 tinue to make this area part of their selective enforcement area and keep an 56 eye on the driving in this area as much as possible. 57 58 Mr. Webb moved the report be accepted and placed on file, seconded by Mr. 59 Anderson and on unanimous voice vote the motion was carried. 60 61 Capt. Wogoman represented the following request: 62 63 "I would like to change the intersection of N. W. 2nd and Richmond Ave. (N. W. 64 2nd - North approach) , from its present two lanes, to that of three lanes. Board of Works Minutes Cont'd. May 1, 1980 Page 2 1 At the present time, there is a 12 ft. Northbound lane on N. W. 2nd, for 2 traffic turning off Richmond Ave. , and a 24 ft. lane for traffic, either 3 turning onto Richmond Ave. , or going straight ahead on N. W. 2nd Street. 4 5 The change would not affect the 12 ft. lane for Northbound traffic. It would 6 enable the traffic approaching Richmond Ave. , from the North, on N. W. 2nd 7 Street to utilize a LEFT TURN ONLY lane and a thru and right turn lane, both 8 being 12 ft. wide. 9 10 We would have a yellow curb from the present crosswalk, extending 95 ft. on 11 the West side of the street, which would stage approximately five (5) ve- 12 hicles. There is no parking on the East side of N. W. 2nd. Street at this time. 13 14 I have checked with Mr. Paul Laudeman, 200 Richmond Ave. , and he has ample 15 off-street parking and does not use the street for parking. This area is 16 heavily traveled and would greatly aid the motorists in this area, as they 17 come from the northern industrial area." 18 19 Mr. Anderson stated this requires a change in traffic pattern and moved that 20 this matter be taken under advisement, seconded by Mr. Webb and on unanimous 21 voice vote the motion was carried. 22 23 Chief of Police Charles Chris presented a letter of resignation from Proba- 24 tionary Patrolman Melody Truitt, effective at the close of duty on May 2, 25 1980 due to her husband accepting employment outside of the City. He recom- 26 mended acceptance of Officer Truitt's resignation from the Richmond Police 27 Department. Mr. Webb moved the resignation of Officer Truitt as of May 2 28 be approved, seconded by Mr. Anderson and on unanimous voice vote the motion 29 was carried. 30 31 Director of City Planning Bob Goodwin stated the State Department of Natural 32 Resources Division of Outdoor Recreation has requested the following route 33 be designated as an official bike trail which will tie in with Ohio's 34 Cardinal Trail which currently terminates at our eastern boundary on S. R. 121. 3511/ 36 S. R. 121 west to Arboretum Road thence west and south along Elks 37 Country Club Road thence south to the east entrance to the Glen Miller 38 Park. Thence west and south along the Park's main road to 22nd & 39 East Main. From this point south to South "B" Street thence west 40 on South "B" Street to South 12th Street, thence south to South "G" 41 Street, thence west along South "G" Street to Abington Pike and a 42 link-up at this point with the State's Whitewater Valley Trail which 43 goes south to Brookville, Indiana. 44 45 This proposed trail would be signed by the State and these signs would be 46 maintained by them in the future. Mr. Goodwin noted if approval is. given 47 by this Board, he will go to the Park Board and ask for their approval. 48 49 Mr. Anderson moved to give temporary approval for the Bike Trail request from 50 the State Department of Natural Resources subject to approval of the Board of 51 Parks and Recreation, seconded by Mr. Webb. Mr. Goodwin was told to report 52 back to this Board after appearing before the Park Board. On voice vote Mr. 53 Anderson's motion was carried with Mr. Meredith voting no. 54 55 Mr. Webb presented a Water Main Extension and Deposit Agreement from the 56 Richmond Water Works Corporation covering the cost of an 8" water main ex- 57 tension in Dana Parkway from the existing main at the Dana Corporation 58 complex to a point west of Flatley Road. The total cost of this main 59 extension is $12,938 which is based on an estimate of 1,370' of 8" water main. 60 The Water Works will be installing a 12" main with the difference of cost 61 between the 8" and 12" water main being absorbed by the Water Works. 62 63 Mr. Anderson stated he has reviewed the contract and feels it is necessary 64 to first have the easements. Mr. Webb noted there is a section which deals with 65 the easements; however, it can be deferred until the easements are given. /. Board of Works Minutes Cont'd. May 1, 1980 Page 3 1 Mr. Anderson moved to approve the Water Works contract subject to the pro- 2 curement of the necessary easements, seconded by Mr. Webb. Mr. Meredith 3 stated we are paying for an 8" and they are installing a 12" and asked what 4 the per foot charge per year will be based on. Mr. Anderson withdrew his 5 motion for further study and Mr. Webb withdrew his second.. Mr. Anderson 6 moved• to defer consideration of this contract, seconded by Mr. Webb and on 7 unanimous voice vote the motion was carried. 8 9 Mr. Webb presented a driveway petition request from Mr . Rhett Baumgartner, 10 632 Richmond Avenue, for N. W. 7th Street to the rear of his property. Plan, 11 Traffic and Engineering Departments all recommend approval. Mr. Webb moved 12 for approval of the subject driveway petition, seconded by Mr. Anderson and 13 on unanimous voice vote the motion was carried. 14 15 Mr. Anderson presented a Fire Department service agreement submitted by 16 Attorney Willard Bowen between Spring Grove and the City for 1980. Mr. 17 Anderson has checked the agreement and noted in Item 6 the cost was to be 18 the same as 1979, which is $11,865.00. Mr. Anderson moved for execution 19 of the fire contract between the City of Richmond and the town of Spring 20 Grove for the year 1980, seconded by Mr. Webb and on unanimous voice vote 21 the motion was carried. 22 23 Mr. Anderson moved the March monthly report of the Radio Technician be 24 accepted, seconded by Mr. Webb and on unanimous voice vote the motion was 25 carried. 26 27 Mr. Anderson moved the April report from the Bureau of Buildings be ac- 28 cepted, seconded by Mr. Webb and on unanimous voice vote the motion was 29 carried. 30 31 Mr. Meredith turned the meeting over to Mr. Anderson to conduct the following 32 two scheduled nuisance hearings: William Hobbs, 1821 N. W. "C" and Mae Davis, 33 1811 N. W. "C". Mr. Dennis Bronston, the complaintant, requested the complaint III34 for the property at 1811 N. W. "C" be dismissed. Mr. Webb so moved, seconded 35 by Mr. Meredith and on unanimous voice vote the motion was carried. 36 37 It was noted Mr. Hobbs was not present. The Board did send notice of this 38 hearing and the return receipt was presented. Mr. Bronston stated he sent 39 a form letter .on April 3 requesting removal or he would file a complaint. 40 He filed his complaint on April 10 for two (2) inoperable vehicles neither 41 of which have license or motor. Mr. Hobbs was not present to show why the 42 nuisance should not be removed. Mr. Bronston noted he agreed to remove the 43 inoperable vehicles when he talked with him. Mr. Bronston presented photo- 44 graphs taken this morning. Mr. Meredith moved that a nuisance does exist at 45 the William Hobbs property located at .1821 N. W. "C" and further moved that 46 all such nuisances be removed from said property within thirty (30) days . 47 and if William Hobbs fails to comply that. the Board of Public Works and 48 Safety will cause said nuisance to be removed and the cost thereof accessed 49 the Defendant, seconded by Mr. Webb and on unanimous voice vote the motion 50 was carried. 51 52 There being no further business the meeting was adjourned. 53 54 Donald Meredith 55 President 56 57 ATTEST: JoEllen Trimble 58 Clerk of the Board
