CITY OF RICHMOND, INDIANA, APRIL 24, 1980
1 The Board of Public Works and Safety of the City of Richmond, Indiana met
2 in regular session April 24, 1980 at the hour of 9:00 a.m. in the Municipal
3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb
4 present. The following business was had, to-wit:

6 Mr. Webb moved to approve the minutes of the previous meeting as prepared,
7 seconded by Mr. Anderson and on unanimous voice vote the motion was carried.

9 Ms. Mary Lou Binnig requested closing of Idlewild Drive from Keyser Lane
10 to Capri Lane on May 25, July 4 and August 31 for neighborhood block parties
11 from 10:00 a.m. to 8:00 p.m. The Street Department has furnished barricades
12 in the past. Traffic Captain Dan Wogoman stated there has been no problem in
13 the past. Mr. Anderson moved to authorize.: the closing of Idlewild Drive for
14 neighborhood block parties on May 25, July 4 and August 31 between the hours
15 of 10:00 a.m. and 8:00 p.m. for the purpose of the neighborhood get-together,
16 seconded by Mr. Webb and on unanimous voice vote the motion was carried.

18 Everett and Joanna Allen, 1221 South 4th Street, requested permission to
19 construct a fence across the front of their residence on City-owned right
20 of way. The City owns a sixty foot (60') right of way and there is approxi-
21 mately fifteen feet plus (15T+) from the curb to the property line of the
22 Allens. The remainder of their yard is fenced and they would like to fence
23 the front for dogs and privacy. Mrs. Allen stated she has lived at this
24 address for twenty-three (23) years. Mr. Allen stated he would remove the
25 fence at any time the City requested him to do so. He would like to set the
26 fence back two feet (2') from the curb. Community Development Director Tim
27 Ryder stated his Department recently installed curbs and roadway and he sees
28 no future improvements to the dead-end street. He stated the sixty feet (60')
29 is obviously not needed and this serves as the property owner's front yard.
30 He stated he sees no problem with the fence being installed, except it is a
31 technical matter and could set a precedent. Mr. Ryder noted there are other
32 areas which have fences on the right of way. He posed the questions of
33 setting a precedent and determination on merits alone.

35 Mr. Anderson asked Mr. Allen if they would sign a paper so if the City wants
36 the right of way they can just inform the Allens. Mr. Allen stated he would
37 sign such a paper and agreed to remove the fence in the event the property
38 was sold. Mr. Anderson stated he would like time to draft documents and
39 explore the proper procedure. Mr. Anderson moved the matter be taken under
40 advisement to look into the question of necessary documents for right of the
41 City to grant this right to the Allens to use the land, seconded by Mr. Webb
42 and on unanimous voice vote the motion was carried.

44 Ms. Erma Cottongim, 461 S. W. 4th, appeared concerning traffic around the
45 High School with drag racing on S. W. "E", which is a through street, be-
46 tween S. W. 2nd and College Avenue. She expressed concern over small
47 children going to and from school. Chief of Police Charles Chris noted
48 whatever sign you put up doesn't always deter violators. He noted an in-
49 depth survey would include speed control, four-way stop signs and selective
50 enforcement. He recommended selective enforcement for the present time
51 and see if the Traffic Division has any other recommendations, as the
52 number of complaints recommend it become a Traffic assignment. Mr. Anderson
53 moved that this matter be referred to the Traffic Department for assignment
54 for selective enforcement, survey of traffic regulations in the area, ob-
55 servance of the situation and back to this Board with recommendations for
56 any corrective measures, seconded by Mr. Webb and on unanimous voice vote
57 the motion was carried.

59 Mr. Anderson noted on March 20 Attorney Andrew Cecere presented an agree-
60 ment between Mr. & Mrs. George Reifenberg and the City calling for improve-
61 ments to be made at Flatley Road and Dana Parkway extended. At that time
62 the agreement could not be executed because this matter had not come before
63 the State Board of Tax Commissioners. The appropriation has not been ap-
64 proved. Mr. Anderson moved to execute such agreement as previously discussed,
65 seconded by Mr. Webb and on unanimous voice vote the motion was carried.

1 Mr. Anderson stated he has drafted an addendum to an agreement dated 12-20-
2 79 between the City and Richmond 140 Ltd. in which the sanitary sewer along
3 Flatley Road was to be 430' . It is now requested the distance be 395' ;
4 therefore, the addendum has been drawn to cause this to be corrected. Mr.
5 Anderson moved to execute such addendum to the agreement, seconded by Mr.
6 Webb and on unanimous voice vote the motion was carried.

8 Mr. Webb stated he has not received the Water Works contract for Dana
9 Parkway extension.

11 Mr. Anderson stated the Board is waiting on three (3) easements concerning
12 the USARC site: (1) from Reifenbergs (which will be delivered when the
13 agreement is executed) (2) Dana Corporation will execute an easement that
14 is needed for the water line (3) Jaffee easement (which should be given
15 in a week) . All these easements are necessary to do this work.

17 Mr. Anderson recommended a contract dated October 25, 1980 between the Town-
18 ship Trustee and the City for operating of RAT should be. amended. The
19 amendment would eliminate the Department of Parks and Recreation, substi-
20 tuting the Department of Transportation and eliminate the word "aging" from
21 the contract and substituting "elderly". Mr. Anderson moved to execute the
22 agreement with the changes as recited, seconded by Mr. Webb and on unanimous
23 voice vote the motion was carried.

25 Mr. Anderson requested a hearing date be set to hear a nuisance at 607 South
26 8th Street. Mr. Meredith set May 15 at 10:00 a.m. to hear the complaint
27 under the nuisance ordinance.
