HomeMy Public PortalAbout12-20-1979 • 73 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, DECEMBER 20, 1979 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in 2 regular session December 20, 1979 at the hour of 9:00 a.m. in :the Municipal 3 Building of said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 Mr. Webb moved to approve the minutes of the previous meeting as prepared, III 7 seconded by Mr. Anderson and on unanimous voice vote the motion was carried. 8 9 Director of Community Development Tim Ryder requested the Board release a 10 mortgage for $10,500 for a loan to Wayne G. Cole and Kara Cole for property 11 located at 420 South 4th Street in Old Richmond. The property has not been 12 sold but they are going to do more improvements and borrow more money from 13 the bank. Since Community Development holds a second mortgage, the second 14 mortgage has to be released so the first mortgage can be increased. 15 . 16 Mr. Anderson moved to authorize the execution of the mortgage release subject 17 that said release beheld by Community Development until such time refinancing 18 is arranged and that said release be simultaneously released with the execution 91 of the second mortgage, seconded by Mr. Webb and on unanimous voice vote the 20 motion was carried. 21 22 Mr. Ryder presented a letter from Clyde Williams Associates who are presently 23 under contract for engineering of the street system in Needmore, which includes 24 areas llth through 16th Street and "U" through "V". He presneted an amendment 25 that they also be authorized on South 15th Street which was originally not •26 included in the contract as the design on 16th -and l5th need to be done to- 27 gether because of the lay of the land and storm sewers. He requested the 28 Board authorize a survey and subsequent design of South 15th-Street. 29 30 Mr. Webb moved for acceptance of the contract amendment with. Clyde Williams 31 to consider the drainage area on 15th Street as a part of the basic contract III32 for engineering services, seconded by Mr. Anderson and on unanimous voice 33 vote the motion was carried. 34 35 Mr. Meredith noted the letter was dated some time ago and Mr. Ryder stated he 36 has checked with Mr. Brady who stated this still holds. Mr. Ryder stated this 37 is coming out of Community Development funds and there are still funds available. 38 39 Attorney Willard Bowen presented an agreement between the Board of Works and 40 Richmond 140, LTD. which provides for extension of a sanitary sewer line, 41 water lines and a roadway from Flatley Road west along the northern boundary 42 of the new Armory site. This work is to be completed within one (1) year 43 after the agreement is signed by all parties with certain land being deeded 44 to the City for the proposed Armory site. Mr. Webb stated the purpose is to 45 provide a site for the Army Reserve Center which will untimately be built in 46 1981. There is a Resolution passed by Common Council to pursue this project. 47 The location is southwest of Dana and Flatley. The Army is willing to pay 48 the costs of extending the utilities, estimated at $30,000, so there is no 49 additional cost to the City to pursue this project. . . 50 51 Mr. Anderson suggested the Board only signing it subject to it being held 52 until the conveyancing documents are done. Mr., Bowen stated it is his under- 53 standing :that the City Attorney will hold the agreement signed by the Board of 54 Works, Mayor and Clerk until such time a deed can be delivered for the land 55 involved. Mr. Meredith noted the City is not buying this property, but it 56 is being given to the City for considerations as outlined. III 57 58 Mr. Anderson moved to authorize and execute the agreement subject that it being 59 held until such time that the conveyancing documents are delivered and executed, 60 seconded by Mr. Webb and on unanimous voice vote the motion was carried. 61 • 62 • Mr. Meredith stated a hearing was held last week on a curb cut petition from 63 Dr. Fox which was taken under.advisement for an opinion by the City Attorney. 64 Mr. Anderson stated he was still studying it and requested more time. Mr. 65 Meredith stated it will be continued under advisement. Board of Works Minutes cont. December 20, 1979 Page 2 1 Fifth District Councilman Terry Whitesell spoke on behalf of the residents on 2 N. W. "L". He stated he spoke to the County Commissioners Monday concerning 3 the railroad crossing at N. L. ."L" and llth Street. The railroad seems to be 4 the dividing line between the City and County. There is a dangerous condition 5 existing there as there are crossing signs and the residents are interested in 6 getting flasher lights. Councilman Whitesell requested investigation to see 7 who has .jurisdiction and what program could be worked out to.see if flasher . 8 light system could be put in there. The Commissioners are turning the .matter 9 over to the County Engineer. Mr. Webb stated his records indicate the cross- 10 ing is two thirds County and one third City. Mr. Webb stated it is his opinion 11 that County has jurisdiction based on the way taxes are returned to the County 12 and City. Councilman Whitesell recommended Mr. Webb get together with the 13 County Engineer to work it out. 14 • 15 W. Anderson moved to :accept: the Department of Weights and Measures report 16 for.November, 1979, seconded by Mr. Webb and on unanimous voice vote the 17 motion was carried. 18 19 There being no further business the meeting was adjourned. 20 21 Donald E.
