HomeMy Public PortalAbout09-13-1979 BOARD OF PUBLIC WORKS AND SAFhTY OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 13, 1979 1 The Board of Public Works and Safety of the City of Richmond, .Indiana, met 2 in regular session September 13, 1979 at the hour of 9: 00 a.m. in the Municipal 3 Building of said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 Mr. Webb moved to approve the minutes of the previous meeting as prepared, 7 seconded by Mr. Anderson and on unanimous voice vote, the motion was carried. 8 9 The Mayor presented a news release concerning the football game this Friday 10 between the Richmond Red Devils and the New Castle Trojans. The Mayor stated, 11 "We want to send them to New Castle with all of our support for a successful 12 evening which will result in victory". 13 14 City Engineer stated curb cuts will now be referred to as driveway petitions 15 as curbs are not involved in some of the petitions. 16 17 Mr. Webb presented a driveway petition for the Recycling Center, 630 South 18 "M" Street. The request is for South 7thclose to."L".- The Plan, Engineering, 19 and Traffic Departments have checked the request and, since it is rather 20 close to "L", the owner has agreed to sign the driveway as "exit only". Mr. 21 Webb moved approval of the subject driveway petition, seconded by Mr. Anderson 22 and on unanimous voice vote, the motion was carried. 23 24 Mr. Webb presented a driveway petition for Mr. Dan Stamper, 2000 Boston Pike. 25 Mr. Stamper requests a driveway off of South 9th to his property. Planning-; 26 Engineering and Traffic have checked and all recommend denial. The reason 27 being that the driveway will be located extremely close to the intersection of 28 227 and South 9th. There is no stop sign for traffic at this location and the 29 angle is bad. Mr. Webb moved for denial of the driveway petition at 2000 Boston 30 Pike, seconded by Mr. Anderson and on unanimous voice vote, the motion was 31 carried. 32 33 Mr. Webb presented a driveway petition for Mr. Edward Weadick, 521.Peacock Road. 34 This request has been checked by Plan, Engineering and Traffic Departments 35 and all recommend approval. The owner is requesting to widen his driveway 36 from nine and one-half (91/2) feet to fourteen (14) feet. Mr. Webb moved for 37 approval of the subject driveway petition, seconded by Mr. Anderson and on 38 unanimous voice vote, the motion was carried. 39 40 Director of Community Development Tim Ryder presented Proof of Publication for 41 the N.W. 5th Street reconstruction project. Mr. Anderson moved it be accepted 42 and filed, seconded by Mr. Webb and on unanimous voice vote, the motion was 43 carried. 44 45 The following bids were received and recorded: -Caine Lake Gravel $208,280.55 - 46 optional: underdrains $8.80 per lineal foot; A & D Excavating $197,200.00 - 47 optional: underdrains $8.50 per lineal foot, rock excavation $65.00 per cubic 48 yard and additional excavation $4.50 per cubic yard. Mr. Webb moved the bids 49 be taken under advisement, seconded by Mr. Anderson and on unanimous voice vote, 50 the motion was carried. 51 52 Referring to the bids for tree removal which were taken under advisement, Mr. 53 Webb moved that the tree removal contract be awarded to Miracle Tree Service 54 at a unit price of $55.00 per tree subject to entering into a contract with 55 the City to perform said services, seconded by Mr. Anderson and on unanimous voice 56 vote, the motion was carried. 57 58 Chief of Police Charles Chris .presented a letter stating Lt. Stephen. Sanford 59 has been certified by the Richmond Police Department Merit Commission for 60 promotion to the Acting Rank of Captain effective September 12, 1979. Chief 61 Chris stated the vacancy is created by Acting Captain Richard Smith being placed 62 as a probationary Captain for a ninety (90) day period. The Chief recommends 63, acceptance of the Merit Commission for promotion of Lt. Sanford to the Acting 64 Rank of Captain. Mr. Anderson moved to accept the recommendation of the Chief 65 of Police that Lt. Sanford, as certified by the Richmond Police Department Board of Works Minutes Cont. September 13, 1979 Page 2 1 Merit Commission, now be promoted to the acting rank of Captain, seconded 2 by Mr. Webb and on unanimous voice vote the motion was carried. 3 4 Director of Community Development Tim Ryder stated property located at ' 5 95-97 Ft. Wayne Avenue is a vacant structure which is structurally sound 6 but is standing wide open. This has been reported to the Bureau of 7 Buildings and the Fire Marshall. The owner, Mr. Robert Barrett, is 8 deceased and his wife, who lives out of town, is trying to handle the 9 estate. Mr. Ryder has been in contact with the Attorney handling the 10 estate. For. the safety of the community, Mr. Ryder requests the Board 11 authorize Mr. 'Roberts as Building Commissioner to board up the first floor 12 and put a lien on the property so, at the time of sale, costs to the City 13 will be recovered. Mrs. Barrett has agreed to let the City remove it 14 under demolition procedure, but, it is historic and Community Development 15 cannot use demolition procedure. Mr. Anderson moved that the. ioard 16 authorize and direct the Community Development Department through the 17 Building Commissioner to secure in the most proper and economic fashion 18 the premises at 95-97 Ft. Wayne Avenue in the interest of the citizens 19 for safety and that upon securing said building a lien be placed on said 20 property, seconded by Mr. Webb and on unanimous voice vote the motion 21 was carried. • 22 23 Mr. Meredith read a monthly report from Mr. Francis Daniels, Department 24 of Weights and Measures. Mr. Webb moved the report be accepted and placed 25 on file, seconded by Mr. Anderson and on unanimous voice vote the motion 26 was carried. 27 28 Ms. Pauline Cummins, 218 N. W. "H" Street presented a problem with birds 29 in trees located on City property between the sidewalk and curb. One 30 tree is located where they 'are unable to use their front entrance because 31 of constant bird droppings. Ms. Cummins stated her son has an allergy 32 problem which is aggrevated by these droppings. She requested permission 33 to remove the one .tree and trim the remaining. City Attorney Edward 34 Anderson told Ms. Cummins it would be necessary for her to execute a 35 "save harmless agreement" with the City. Mr. Anderson moved that this matter 36 be turned over to the Superintendent.-of...-the Department of Parks & Recrea- 37 tion for his investigation and that he report back to this Board his findings 38 and recommendations, seconded by Mr. Webb. After discussion, Mr. Anderson 39 withdrew his motion and.Mr. Webb withdrew his second. Mr. Anderson then 40 moved that this .matter be turned .over to the Superintendent of the Depart- 41 ment of Parks:.& Recreation for his immediate investigation and, subject to 42 his approval, that the tree can be removed by, the property owner at their 43 own expense subject to execution with a "save harmless agreement" with the 44 City of Richmond and that she can trim other trees on City property, seconded 45 by Mr. Webb and on unanimous voice vote the motion was carried. 46 47 There being no further business on motion duly made, seconded and passed 48 the meeting was adjourned. 49 50 Donald E.
