CITY OF RICHMOND, INDIANA, JULY 26, 1979
1 The Board of Public Works and Safety of the City of Richmond, Indiana,
2 met in regular session July 26, 1979 at the hour of 9:00 a.m. in the
3 Municipal Building of said City. Mr. Meredith presided with Mr. Anderson
4 and Mr. Webb present. The following business was had, to- wit:

6 Mr. Webb moved to approve the minutes of the previous meeting as prepared,
7 seconded by Mr. Anderson and on unanimous voice vote, the motion was carried.

9 Mr. James Wiechman, representing Porter Poster Service, presented an Order
10 Vacating an Alley prepared by Attorney Robert O'Maley for vacation of the
11 alley located between North 4th & 5th and "D" & the 20th Century Bridge.
12 Mr. Wiechman stated he will assume the responsibility of recording the
13 vacation. Assistant Director of City Planning, Dan Dooley, presented a
14 letter stating the Plan Commission held a public hearing on this petition
15 on Tuesday, July 24, 1979 and voted to recommend the alley be vacated subject
16 to a sixteen (16) foot easement being granted to the City of Richmond for the
17 benefit of public and private utilities as a utility pole and sanitary sewer
18 presently exist in the alley. Mr. Webb moved that the petition to vacate
19 the alley between North 4th & 5th immediately south of North "D" Street,
20 being subject to a grant of easement of private and public utilities, be
21 approved, seconded by Mr. Anderson and on unanimous voice vote, the motion
22 was carried.

24 Mr. Webb presented a curb cut request from Pizza Hut, 2250 Chester Blvd.
25 The petition has been checked and approved by the Plan, Traffic and Engineering
26 Departments. This petition also has State Highway approval. Mr. Webb moved
27 to approve the curb cut for Pizza Hut, seconded by Mr. Anderson and on
28 unanimous voice vote, the motion was carried.

30 Mr. Webb presented a curb cut request on N.W. llth south of Sheridan from
31 Belden Corporation for a new truck terminal. This. request has been checked
III32 and approved by the Plan, Traffic and Engineering Departments. Mr. Webb
33 moved to approve the Belden curb cut.petition; on N.W. 11th Street, seconded
34 by. Mr. Anderson and on unanimous voice vote, the motion was carried.

36 Chief of Police Charles Chris requested that Sgt. Marshall Smith and Officer
37 Robert Nickoli attend the Police Role in Child Abuse and Neglect Workshop,
38 conducted by the IACP, August 6-9, 1979 in Chicago, Illinois. Mr. Anderson
39 moved to accept the recommendation of the Chief for schooling, seconded by
40 Mr. Webb and on unanimous voice vote, the motion was carried.

42 Ms Barbara Barnhizer presented the recommendation from Community Development
43 for awarding the bid for the South 16th Street sanitary sewer project.
44 Community Development recommends the bid be awarded to Mike DeLucio and has
45 HUD concurrence on file. Ms Barnhizer noted an error in computation on Item
46 8D which changes the total amount from $58,728 to $58,968, however, DeLucio is
47 still the low bidder. Mr. Webb moved that the South 16th Street sewer project
48 be awarded to DeLucio, seconded by Mr. Anderson and on unanimous voice vote,
49 the motion was carried.

51 Community Development presented a mortgage release for Heritage Restorations,
52 Inc. for property located at 403 South 4th Street and part of Lot 84 of
53 John Smith Addition of the City of Richmond. The amount of the mortgage is
54 $15,000. Mr. Webb moved for approval of the release, seconded by Mr. Anderson
55 and on unanimous voice vote, the motion was carried.

III57 Reporting on the Dotson nuisance hearing, Mr. Dan Dooley noted that Dotson has
58 removed the nuisance on his propertyand Mr. Dooley recommended the matter be
59 dismissed. Mr. Webb so moved, seconded by Mr. Meredith. The motion was carried
60 with City Attorney Ed Anderson abstaining from voting.

1 Mr. Meredith recessed the Board until 10:00 a.m. at which time two (2)
2 nuisance hearings are scheduled.

4 The Board reconvened at 10:00 a.m.

6 City Attorney Ed. Anderson conducted a nuisance hearing..against Mr. Ronald
7 Helton, 1114 Green Street. A return receipt was presented signed by Mr.
8 Helton stating he did get a copy of the order to appear; however, he was
9 not present. Mr. Jeff Cooper of the Plan Department stated there is no
10 indication of progress in the situation as the two (2) cars still are there.
11 ' Mr.. Helton told Mr. Cooper he has sold the cars and is having them removed.
12 The cars remain as shown in the original picture. Mr. .Anderson recommended
13 the cars be removed within thirty (30) days. Mr.. Webb moved that the
14 nuisance at 1114 Green Street be removed and Mr. Ronald He-ltonbe informed that
15 he has thirty (30) days. to remove said nuisance, seconded by Mr. Meredith.
16 Following discussion, Mr. Webb withdrew his motion and Mr. Meredith withdrew
17 his second. Mr. Meredith moved that. a nuisance exists; at 1114 Green Street and
18 that a nuisance is maintained and is ordered removed .within the thirty (30)
19 day period and if Mr. Helton does not remove it that .the City will and charge
20 Mr. Helton with the cost of removal, seconded by Mr. Webb. The motion carried
21 with Mr. Anderson abstaining. . .

23 The Board requested a report from the Plan Department.. showing the number of
24 nuisance complaints filed and the numbex:' of prospective nuisances cleared
25 before filing.

27 City Attorney Ed Anderson conducted a nuisance hearing against .Mr. Colin White
28 for property located at 610 North 12th Street.. . A return receipt was presented
` 29 signed by Mr. White for receiving notice of the. hearing; however, Mr.. White
30 was not present. Mr. Dennis Bronston of the Plan, Department stated the
31 condition still exists and the complaint was filed July 5. Mr. Bronston stated
32 he feels there may also be a zoning violation 'at this location. Mr. Bronston
33 has checked ownership of the property and stated Mr.. White is the owner of
34 record of the lot where the nuisance is being. maintained. Mr. Anderson
35 recommended the Board issue an order that the nuisance does. exist, that he is
36 maintaining it, that it be removed within thirty .(30) days and, •if not,
37 the City will remove it and all costs be assessed against Mr. White. Mr.
38 Webb so moved, seconded by Mr. Meredith. The motion carried with Mr. Anderson
39 abstaining.

42 meeting was adjourned.
