HomeMy Public PortalAbout03-01-1979 V 7 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, MARCH 1, 1979 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session March 1, 1979 at the hour of 9:00 a.m. in the Municipal 3 Building of said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 Mr. Anderson moved to approve the minutes of the previous meeting as prepared, 7 seconded by Mr. Webb and on unanimous voice vote, the motion was carried. 8 9 Mr. Anderson examined proof of publication for the used busses and found it 10 to; be in order. Mr. Anderson moved it be accepted and filed, seconded by Mr. 11 Webb and on unanimous voice vote, the motion was carried. 12 13 The following bid was received and recorded: 14 15 All Nations True Holiness Tabernacle on vehicle No. 111 TC 25 25155 $200.00 16 17 Deputy Director of Community Development Matt Nepote stated appraisals have been 18 obtained on all the busses. 19 20 Mr. Anderson moved to take this under advisement, seconded by Mr. Webb- and 21 on unanimous voice vote, the motion was carried. 22 23 Mr. Jeff Conniff, 733 South 9th Street, appeared requesting one hour parking 24 from 8:00 a.m. to 5:00 p.m. on South''H"- from South 9th to the alley on both 25 sides of the street to providecustomer parking for his place_ of business. He 26 stated he owns the properities on both sides of the street and there are no 27 residents facing "H" Street with the exception of apartments above one of his 28 buildings in that block. He further stated he has an employee's parking lot 29 on the north side of his building; however, the entrance is on the south and 30 it is difficult for customers to unload equipment on the north- side. Capt. 31 Loper stated he has not had an opportunity to study this problem and make a 32 recommendation. 33 34 Mr. Anderson moved to take this matter under advisement to get the recommendation 35 of Capt. Loper after study of the Traffic Division, seconded by Mr. Webb and 36 on unanimous voice vote, the motion was carried. . - 37 38 Director of Community Development Tim Ryder stated that part of the 1976 39 Community Development activity was to improve the North 15th Street railroad 40 crossing with rubberized crossing. The cost of this is not wise, so he looked- 41 into off system aid program for crossing improvements which is a state and 42 federal program with a 90 - 10 match. (the City providing the 10%) . . The 43 engineering firm making.-` the -study to do this is proposing-new timber rather 44 than rubber. The C.D. match would be $ '11,000. Mr. Ryder recommended 45 participating in this. program. . He stated they are working on the 12th Street 46 crossing which would be an on system program which is 100% federally funded. 47 Traffic on 15th Street doesn't warrant rubber. Capt., Loper stated a timber 48 erossing would suffice as the traffic is mostly residential since industry has 49 moved out of that area. Mr. Anderson stated he has reviewed the contract with 50 the Consolidated Rail Corporation and finds it to be in order. 51 52 . Mr. Anderson moved to accept the contract, seconded by Mr. Webb and on unanimous 53 voice vote, the motion was carried. 54 - 55 Chief of Police Charles Chris presented the following change in the Manual for 56 Department of Police, General Rules and Regulations, Article IV, Section 2, 57 Paragraph (f) 58 59 Paragraph (f) reads as follows: 60 61 Officers should use their revolvers only in case of self-defense, 62 or in the defense of another person, or other extreme cases and 63 only then with great prudence. If a felon escapes, or seeks to 64 escape, every effort should first be made to secure his capture 65 without resort to weapons. The practice of firing warning shots 66 is strictly prohibited. A written report to the Chief is required 67 when a firearm is discharged. Board of Public Works and Safety Cont. March 1, 1979 Page t. 1 Proposed change would read" as follows: 2 3 Officers shall use deadly force only in self—defense, or in 4 the defense of another person or in the pursuit of a suspect 5 known to have committed physical violence on the person of 6 another and there is a substantial risk that the person whose 7 arrest is sought will cause death or serious bodily harm if his 8 apprehension is delayed. Deadly force shall never be used on 9 mere suspicion that a crime, no matter how serious, was committed, 10 or that the person being pursued committed the crime. The officer 11 shall have witnessed the crime or know as a virtual certainty 12 that the suspect .committed an offense for which the use of deadly 13 force is permissible. Every effort to apprehend the suspect 14 should be exhausted and deadly force is the last resort. Warning 15 shots are not permitted under any circumstances. A written 16 report to the Chief is required when a firearm is discharged. . 17 18 Mr. Anderson moved to delete from the .Manual for Department of Police, General 19 Rules and Regulations, Article IV, Section 2, Paragraph (f) and substitute 20 therefor the proposed change as submitted, seconded by Mr. Webb and on unanimous 21 voice vote, the motion was carried. 22 23 Discussion was held on the proposed increase requested by Clearview Cable TV. 24 Mr. Jim Weichmann, representing his tenants, and other interested citizens, 25 stated it would be very difficult for people on fixed incomes to continue with 26 Cable if this was granted,_ 27 28 Mr. Meredith stated he has received calls, letters and petitions against this 29 increase. 30 31 Mr. Anderson stated the City should not deter Clearview Cable from providing 32 the. additional service of the distant signal and the Board should decide if 33 the service justifies the increase in rates. He requested a financial statement 34 of Clearview be provided the City. 35 36 Attorney George Tripp, representing Clearview, stated there is only 51% 37 saturation of the market in Richmond, where most cities' have between 75 and 38 80%. Therefore, they feel they need to provide more service of programs 39 that cannot be received off a tower. 40 41 Mrs. Daniel O'Connor, 211 Linden Court, spoke against the increase and stated 42 she is satisfied with what she has. 43 44 Mr. Meredith announced this item will remain under advisement for further input. 45 46 Mr. Anderson moved to accept and file the February 1979 report from the Building 47 Commissioner, seconded by Mr. Webb and on unanimous voice vote, the motion was 48 carried. 49 50 There being no further business on motion duly made, seconded and passed, the 51 meeting was adjourned. 52 53 Donald E.
