HomeMy Public PortalAbout06-22-1978 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JUNE 22, 1978 1 The Board of Public Works and Safe, . of the City of Richmond, Indiana, met 2 in regular session June 22, 1978 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 Mr. Anderson moved to approve the minutes of the previous meeting, as pre- 7 pared, seconded by- Mx. Meredith and on unanimous voice vote the motion was 8 carried. 9 10 The Clerk read a letter from Mr. Robert Rhoads, Pioneer Day Committee, for 11 the Wayne County Historical Society, stating their annual celebration will 12 be on Sunday, September 10. He requested parking on the curb lane be restricted 13 around the entire block of the Museum grounds to facilitate the safety and 14 ability of three (3) horse drawn rides to operate around the block. Capt. 15 Scott Loper reported no problems in the past. Mr. Anderson moved to take this 16 request under advisement, seconded by Mr. Webb. The motion passed with Mr. 17 Meredith voting no. 18 19 Mayor Clifford Dickman reported to the Board that unofficial word has been 20 received from UMTA that 'the bid for City busses has been approved. Wayne 21 Works is the successful bidder and, as soon as written approval is received, 22 the releases will be signed. 23 24 The Clerk read a letter from Museum Board member Robert Rhoads noting an 25 increasing problem of parking on a day to day basis on North "A" Street 26 between 12th and llth Streets on the north side of the street. He requested 27 consideration of a 2 hour parking limit on this area. Capt. Loper has. investi- 28 gated this area periodically throughout different periods of the day and finds 29 there is ample parking in the area; therefore, he recommends the request be 30 denied. Mr. Anderson moved this matter be taken under advisement, seconded 31 by Mr. Webb. W. 4th Street from S. W. "C" to S. W. "D" June 29th from 28 5: 00 p.m. until 10:00 p.m. for a block party, seconded by Mr. Anderson and 29 on unanimous voice vote the motion was carried. 30 31 Mr. Webb moved to grant the request of Chief of Police Charles Chris that 32 Officer Don Ponder be sent to the Indiana Law Enforcement Academy at North- 33 western University Traffic Institute from July 10 through July 21, seconded 34 by Mr. Anderson and on unanimous voice vote the motion was carried. 35 36 Deputy Director of. Community Development Matt Nepote urged the Hoard approve 37 the bid of Wayne Works for City busses contingent upon UMTA written approval. 111 38 Mr. Anderson moved to accept the bid subject to official approval of UMTA, 39 seconded by Mr. Webb and on unanimous voice vote the motion was carried. Mr. 40 Terry Whitesell, general sales manager of Wayne Corporation, thanked the City 41 for their cooperation. 42 43 Mr. Meredith recessed the Board to reconvene at 10:00 for a hearing on the 44 Nuisance Ordinance. He noted there will be another hearing at 10:30 on this 45 ordinance and a public meeting at 4:00 p.m. with Fire Department negotiating 46 representatives. 47 48 At 10:00 a.m. City Attorney Ed Anderson conducted a hearing on Board of Works 49 vs Theresa Bryant, 132 N. W. "E" Street. Ms. Bryant identified herself as 50 being present, stated she was not represented by counsel and consented to her 51 son, Patsy Bryant as her representative. 52 53 The Clerk read the complaint which is brought for two (2) unoperable vehicles 54 located on property owned by Ms. Bryant. Ms . Bryant acknowledged receiving 55 the notice, ownership of the property and ownership of the one (1) remaining 56 vehicle. In response to Mr. Anderson's question if she agreed she is maintaining 57 a nuisance, Ms. Bryant stated the car belonged to her late husband who died 58 eleven (11) years ago and she wanted to keep the car for a remembrance. Mr. 59 Bronston identified photographs taken of the vehicles May 22, 1978 and of the 60 remaining vehicle taken June 21, 1978. Mr. Bronston presented a letter sent 61 May 25 giving seven (7) days for the removal of the vehicles, which Ms. Bryant 62 acknowledged receiving. The later further stated if this was not done in the 63 seven (7) day period, Mr. Bronston would bring a complaint to the Board of Works, 64 which was filed on May 30. The car remaining is a 1961 Lincoln Continental, 65 which Mr. Patsy Bryant states is a collector's item. He states he intends to Board of Works Cont. June 22, 1978 Page 3 1 do the work necessary to make the car operable when he can afford to. He 2 further stated he has difficulty getting parts for the car. The car is 3 plated but does not have a valid inspection sticker. It has not been moved 4 for two (2) years. Mr. Bryant stated he will try to get the car operable 5 if given time to do so. Mr. Anderson suggested to the Board in their consid- 6 eration of a decision and order that they do find a nuisance did exist here 7 originally as two (2) inoperable vehicles were described in the original 8 complaint, one has been removed, but a nuisance still does in fact exist as 9 defined under the ordinance and the Defendant does own the premises and the III 10 nuisance and that the Board consider giving the Defendant sixty (60) days 11 to abate the nuisance. Abating the nuisance mans to make it operable or 12 find a garage in which the nuisance can be removed from the sight of the 13 public. Mr. Webb so moved, seconded by Mr. Meredith. 14 15 The hearing set for 10:30 a.m. was Board of Works vs Duning Realty. This 16 is a rental property located at 204 So. 13th Street and the tenant has 17 removed the nuisance. This has been confirmed by Mr. Bronston. Mr. Meredith 18 reported Mr. Duning was in contact with him stating the nuisance has been 19 removed. 20 21 The Board recessed until 4:00 p.m. 22 '23 The Board reconvened at 4:00 p.m. with Firefighters Don Trotter, Bob Johnson, 24 Ron Purcell, Dave Harbin and Bill Smith, Fire Chief Paul Mullin and Mayor 25 Clifford Dickman. Mr. Meredith stated the purpose of the meting is to 26 finalize negotiations with the International Association of Firefighters, 27 AFL-CIO Local 1408 Richmond Professional Firefighters. The City made an 28 offer to the negotiating team which they presented to their local and are 29 now ready to report back to the City. Lt. Johnson reported the Local meeting 30 was held last night at 7:00 p.m. at No. 1 Fire House and voted forty (40) to 31 two (2) in favor of accepting the contract which states aneight per cent (8%) 32 increase for 1979 and aIsix per cent (6%) increase for 1980 and holiday pay 33 for all firefighters beginning in January of 1979. 34 35 Mr. Meredith presented an AMENDMENT TO PROFESSIONAL NEGOTIATIONS AGREEMENT, 36 which was signed by the Board, the President and Secretary of Local 1408 and 37 Mayor Dickman. 38 39 There being no further business on motion duly made, seconded and passed the 40 meeting was adjourned. 41 42 Donald E.
