HomeMy Public PortalAbout06-01-1978 " 4/ BOARD OF_ _PUBLIC WORKS AND SAFETY OF THE - CITY OF RICHMOND, INDIANA, JUNE 1, 1978 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in 2 regular session June 1, 1978 at the hour of 9:00 a.m. in the Municipal Building 3 in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb present. 4 The following business was had, to-wit: 5 6 Mr. Webb moved to approve the minutes of the previous meeting, seconded by Mr. 7 Anderson and on unanimous voice vote, the motion was carried. 8 9 Mr. Anderson examined copies of the Palladium-Item as proof of ,publication for the 10 bid openings for construction of curbs and sidewalks in the Kinsey Community 11 Development Neighborhood. Mr. Anderson moved to accept the notice as proof of 12 publication, seconded by Mr. Webb and on unanimous voice vote, the motion was 13 carried. 14 15 The following bid was received and recorded: Bertram Construction Company, Inc. 16 $24,553.95. Mr. Webb moved to take this bid under advisement, seconded by Mr. 17 Anderson and on unanimous voice vote, the motion was carried. 18 19 Community Development Director recommended the bid of A & D Excavating for their 20 Bealview area project be accepted contingent upon HUD approval. Mr. Webb moved 21 the Bealview Project be awarded to A & D in the amount of $146,246.99,. seconded 22 by Mr. Anderson and on unanimous voice vote, the motion was carried. 23 24 Ms Mary Summons, 222 North 13th Street, requested Sunday, October 1, 1978 be 25 approved for the Ride-a-bike and presented a map indicating the route. This is 26 sponsored by the Indiana State Teachers' Association and benefits the mentally 27 retarded in Wayne County. Capt Loper would like to see flags used to identify 28 the groups of cyclists (cyclists are in groups of ten) . Mr. Anderson moved to approve 29 the Ride-a-bike as sponsored by the ISTA for the mentally retarded on the date of 30 October 1 with hours 1:00 to 8:00 p.m. under conditions that all cyclists be 31 properly identified, flags and that there be proper supervision, seconded by Mr. 32 Webb and on unanimous voice vote, the motion was carried. 33 34 Mr. Bob Johnson representing Brownie's TV & Appliance, requested extending 35 a roof over a-sidewalk on the east end of their present building located at 36 303 National Road West. He presented drawings of the proposed improvements to 37 this building. Mr. Anderson moved to approve the overhang for Brownie' s TV at 303 38 National Road West permitting a four foot (4') extension at the northeast corner 39 of said building, seconded by Mr. Webb and on unanimous voice vote, the motion 40 was carried. 41 42 Mr. Webb presented a letter from Robert A. Ridgeway requesting vacation of a 43 ten foot (10') east-west dead end alley between South "A" and South "B" on 44 6th Street. Mr. Webb stated the alley cannot be vacated to Robert A. and Judy K. 45 Ridgeway would have to be the owners of record of lots 120 and 121. Mr. Ridgeway 46 would have to get a quit claim deed from other property owners. Mr. Anderson moved 47 the matter be referred to, the Plan Commission, seconded by Mr. Webb , and on 48 unanimous voice vote, the motion was carried. 49 50 Mr. Webb presented a curb cut from Lela Pennington, 118 S .W. "G" for a residential 51 cut. Traffic, Plan, and Engineering Departments have checked this request. 52 Mr. Webb moved for approval of this curb cut, seconded by Mr. Anderson and on 53 unanimous voice vote, the motion was carried. 54 55 Mr. Webb presented a residential curb cut request from WalterBecknell, 404 South 56 18th Street. This request has been checked by the Traffic, Plan, and Engineering 57 Departments. Mr. Webb moved for approval of this curb cut, seconded by Mr. 58 Anderson and on unanimous voice vote, the motion was carried. 59 60 Mr. Webb presented a curb cut request from D & W Real Estate, Inc., 200 North 61 13th, for a cut on North 6th Street along lots 116, 118, 120, and 122. This 62 request has been approved by the Plan Commission and goes to Common Council. 63 The request has been checked by Traffic, Plan, and Engineering Departments. 64 Mr. Webb moved for approval subject to D & W Real Estate, Inc. getting final 65 approval from Common Council for a special use of this parking lot, seconded 66 by Mr. Anderson and on unanimous voice vote, the motion was carried. 67 68 Mr. Meredith set a date to receive bids on gas and diesel fuel used by the 69 City for June 22, 1978 at 9:00 a.m. Mr. Jerry Haynes and Mr. Webb will get 70 specs to the Clerk's Office for bidders. June 1, 1978 Page 2 1 The meeting was adjourned until 10:00 a.m. at which time hearings will be 2 held under the nuisance. ordinance. 3 4 The meeting reconvened at 10:00 a.m.. 5 6 The Clerk read the complaint against David & Ann Messer, 1530 South 13th Street 7 signed by John D. Bronston, City Zoning Administrator, for an inoperable Chevrolet 8 car. It was noted the party is not in the audience to answer the complaint. Mr. 9 Bronston, the complaintant is present and stated he obtained the owner of the 10 property from Court House records. He presented a picture of this vehicle 11 taken on May 3, 1978 and another taken this morning showing the nuisance has 12 not been removed. He stated the vehicle doesn't have an engine, license plate, 13 hood, or no tire or rim on front side. Mr. Bronston stated he has not contacted 14 the owner personally, but did leave his card at the residence. They have not 15 contacted him or anyone in the room. Mr. Anderson stated the Board has to decide 16 if a nuisance exists from pictures and presentation of Mr. Bronston. Mr. 17 Bronston stated his original complaint was about two (2) cars but before he filed 18 the complaint with the Board, one (1) car was removed. Mr. Meredith asked if 19 they have been properly notified to appear or have representation. Mr. 20 Anderson read Section 4 of the ordinance. After discussion, Mr. Meredith stated 21 he would assume the post office has delivered the notice to these residents 22 because there has been time for the letter to come back and they were properly 23 notified and made a decision and order on it and give thirty (30) days to remove 24 the nuisance. If it is not then removed, have it removed at their cost and a 25 copy of the decision and order should be sent to the parties involved by 26 registered mail with a return receipt. Mr. Hudson suggested all costs involved 27 should be assessed against the parties involved. Mr. Anderson will prepare the 28 order for Mr. Meredith's signature and Mr. Webb concurred. 29 30 The Clerk read the complaint against. Charles & Lexie Davis, _1315 South 15th Street 31 for a nuisance located at 1330 South 16th Street. The Davis' were not present. 32 The :complaintant, Mr. Bronston, was present, and presented pictures taken on May 33 3. He contacted neighbors who gave him the number of Ms Davis on Shamrock Court. 34 He called Ms Davis and she said relatives owned the vehicles and worked on them 35 at that particular site. Mr. Bronston told her he had received a complaint and 36 they should be removed as they are creating a nuisance. Mr. Bronston was back 3<7 at this site this morning and the vehicles are still there and are still in 38 inoperable condition. They do not have tags, engines, etc. He presented a 39 picture he took this morning. Mr. Anderson pointed out there is no return receipt 40 that proper notice was sent to appear before this Board. Mr. Meredith moved the 41 Davis' be given the same order giving them thirty (30) days to remove the 42 nuisance, sent registered mail with; a return receipt. seconded by Mr. Webb and on 43 unanimous voice vote, the motion was carried. 44 . 45 Mr. Bronston stated he wished to drop the complaint against Charles Centers, owner 46 of the vehicle and John Dean, owner of the property located at 1604 South 7th, as 47 it has been cleared up. Mr. Webb moved that the complaint against John Dean 48 be dropped, seconded by Mr. Meredith and on unanimous voice vote, the motion was 49 carried. 50 51 The Clerk read the complaint against Ira Creeck, 715 South "L" for two (2) 52 inoperable vehicles. The defendant is not in the audience, but complaintant, 53 Mr. Bronston, is. Mr. Bronston presented pictures taken on May 10, 1978. He 54 was by there this morning and both vehicles are still there, but one had been 55 moved. Both have expired license plates to the best of his knowledge. Mr. 56 Bronston stated he believes they are a nuisance under the ordinance because they 57 are unsightly. Mr. Bronston left a card on their door, but they have not 58 contacted him. Mr. Meredith stated that the decision and order be that the 59 vehicles obtain necessary license plates and inspection stickers within a 60 thirty (30) day period; if not in compliance, that will constitute removal of 61 the vehicles. It will continue to be a nuisance and it will be a nuisance 62 after the thirty (30) days and at that time the Board of Works will cause 63 said nuisance to be removed. They do not have to remove from the premises as 64 long as they comply with this statement. Mr. Webb concurred. 65 66 There being no further business on motion duly made, seconded and passed, the 67 meeting was adjourned. 68 69 Donald E.
