BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, MAY 25, 1978
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in
2 regular session May 25, 1978 at the hour of 9:00 a.m. in the Municipal Building
3 in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb present.
4 The following business was had, to wit:

6 Mr. Webb moved to approve the minutes of the previous meeting as prepared, seconded
7 by Mr. Anderson and on unanimous voice vote, the motion was carried.

II/ 9 Mr. Anderson examined proof of publication for bids for the construction of
10 curbs, sidewalks, storm sewers and pavement in the Bealview area and found it _
11 to be in order. Mr. Webb moved it be accepted and placed on file, seconded by
12 Mr . Anderson and on unanimous voice vote, the motion was carried.

14 The following bids were received and recorded: John Rigsby Excavating, $168,814.19;
15 A&D Excavating Co. $146,246.99.

17 Mr. Webb moved to take the bids under advisement, seconded by Mr. Anderson and
18 on unanimous voice vote, the motion was carried.

20 Mr. Meredith announced the condemnation of the McClelland property has been
21 postponed until June 15 at the request of Mr. McClelland's attorney.

23 Concerning the condemnation proceedings against Ms Faye Morris on property located
24 at 2426 North 17th, Building Commissioner Charles. Roberts stated Ms Morris is
25 in the audience. She appears because she was told to, but Mr. Robert Campbell,
26 Towne House Apartments, has purchased this property on contract. Mr. Campbell
27 reported to Mr. Roberts that he will repair the property and get it back into
28 shape. Mr. Roberts stated that as far as we know now there is no reason for
29 Mr. Campbell to appear and certainly not Ms Morris. Mr. Campbell has assured
30 Mr. Roberts he will repair the property and bring it up to code. Ms Morris
31 stated she did sell the property to Mr. Campbell on contract and he has gotten
32 behind on everything and the property is still in her name. If Mr. Campbell
33 does not bring it up to standard, Ms Morris stated she will. Mr. Roberts stated
34 that when a permit is granted, it will be for one (1) year and Mr. Roberts will
35 suggest the outside of the property first be painted and doing whatever needs to
36 be done to make it look compatable with the neighborhood. In answer to Mr.
37 Anderson's question, Mr. Roberts stated he is satisfied that his condemnation
38 order will be complied with. Mr. Meredith stated a reasonable time should be
39 established for him to 'get this work done and requested Mr. Roberts report back
40 and stay on top of the situation for Ms Morris' .protection so the property
41 doesn't get any more run down. Mr. Anderson stated that if Mr. Campbell doesn't
42 perform, the City will look to Ms Morris as the legal owner. Mr. Roberts
43 stated he will furnish the Board with a letter as to what is asked and what Mr.
44 Campbell will do. Mr. Anderson stated the Board is not affirming, denying, or
45 modifying Mr. Robert's order in any way. This hearing is being continued until
46 such time as Board is satisfied the order has been complied with; in reality,
47 affirming the._order that it must be complied with and you will report to the Board
48 when it is complied with. Mr. Meredith stated the hearing is continued.

50 Mr. Roy Wagner requested permission to hold the Shrine Parade on Saturday,
51 August 5 with formation starting at 1:00 p.m. and the parade starting at 2:00
52 p.m. and ending at 3:30 p.m. The route of the parade would be the same as last
53 year with formation being on 20th and 21st Streets with the parading going west
54 on Main Street to 16th, north on 16th to North "A" and west on North "A" to 10th
55 for disbanment. Traffic would be re—routed at 22nd and Main.

57 Mr. Anderson moved to approve the Tarum Shrine Parade and route as outlined by
58 date and time, seconded by Mr. Webb. Mr. Meredith noted this is subject to
59 State Highway approval. On unanimous voice vote, the Mr. Anderson's motion was
60 carried.

1 Deputy Director of Community Development Matt Nepote stated he has. received
2 a letter from Argosy Manufacturing requesting deviations from some 33
3 specifications contained in the spec packet for City busses. The specs specify
4 that any requests received must be acted on by the Board of Public Works.
5 Each item should be handled individually. (See attached request letter from
6 Argosy) .

11 G2- Argosy requested wet weight of 24' passenger coach 8,370 lbs, and with lift
12 9,000 lbs. Mr. Haynes pointed out this is a larger unit than the specifications.

14 Mr. Anderson moved that there be no deviation allowed for G2, seconded by Mr.
15 Webb and on unanimous voice vote, the motion wa.s carried.

17 G3C Mr. Anderson moved that no deviation be allowed on G3C, seconded by Mr.
18 Webb and on unanimous voice vote, the motion was carried.

20 G4- Mr. Anderson moved that no deviation be allowed on G4, seconded by Mr.
21 Webb and on unanimous voice vote, the motion was carried.

23 Ms Barbara Barnhizer of the Department of Community Development interrupted the
24 meeting to point out -that Mr. Rigsby's bid for the Bealview Project had been
25 incorrectly read. The amount should have been $167,814.19 intead of $168,814.19.
26 Mr. Webb moved the minutes be so corrected on Mr. Rigsby's bid, seconded by
27 Mr. Anderson and on unanimous voice vote, the motion was carried.

29 G9B Mr. Anderson moved no deviation be permitted on G9B as he feels it is
30 covered in G9F, seconded by Mr. Webb and on unanimous voice vote, the motion was
31 carried.

33 Mr. Webb moved for a five (5) minute recess, seconded by Mr. Anderson. The
34 motion carried with Mr. Meredith voting no.

36 The Board of Works reconviened.

38 GlOD=Mt.Anderson wrote the attached opinion on this deviation; however, things
39 have changed since he wrote his opinion. Under GlOD could be accepted but
40 he feels the words "within the intent of" cannot be exchanged for words "as is
41 spelled out" as the intent would be changed. Mr. Anderson moved that the
42 deviation GlOD be accepted as far as the last sentence as prior approval of.
43 Argosy but words "within the intent of" as words "as spelled out" as it changes
44 the meanings of the specs. This motion died for lack of a second. Mr. Anderson
45 moved to find the paragraph acceptable as far as prior approval but do not feel
46 it can replace "within the intent of" with words "as is spelled out", seconded
47 by Mr. Webb and on unanimous voice vote, the motion was carried.

49 G10E-Mr. Anderson moved that G1OE have no deviation, seconded by Mr. Webb and
50 on unanimous voice, the motion was carried.

52 G10E-Mr. Anderson moved that the first sentence be permitted but the other two
53 (2) sentences be stricken and not allowed, seconded by Mr. Webb and on unanimous
54 voice vote, the motion was carried.

56 G15A-Mr. Anderson moved that no deviation be permitted, seconded by Mr. Webb and
57 on unanimous voice vote, the motion was carried.

59 G29- No deviation, just a statement of facts. Mr. Anderson acknowledges receipt
60 of test plans under G29. Mr. Anderson moved that Mr. Nepote in a .le.tter of
61 response acknowledge receipt under G29 of test plans under specs that road
62 test plans have been received, seconded by Mr. Webb and on unanimous voice vote,
63 the motion was carried.

TECHNICAL SPECIFICATION
1 Item 1 - Mr. Webb moved the first paragraph meets the intent of specifications
2 but length "no", seconded by Mr. Anderson and on unanimous voice vote, the motion l�
3 was carried.

5 Item 3B - Mr. Webb moved that we inform the manufacture that we trust that their
6 comments fulfill the requirement of this part of the specifications and we have
7 received same. The motion died for lack of a second. Mr.- Anderson moved that we
8 inform the manufacture that we assume that their comments fulfill the requirement
9 of this part of the specifications and we have received same, seconded by Mr.
10 Webb and on unanimous voice vote, the motion was carried.

12 Item 6E - Mr. Anderson moved that the specs require that in asking for deviations
13 must be fully supported with technical data, that pertinent information be
14 provided and item 6E does not provide all information, seconded by Mr. Meredith.
15- Motion passed with Mr. Webb abstaining.

17 Item 7C - Mr. Webb moved that four (4) sealed beam headlights are an acceptable
18 alternate to two (2) sealed beam headlights, seconded by Mr. Anderson and on
19 unanimous voice vote, the motion was carried.

21 Item 7L - Mr. Webb moved that we reply to L by stating that we have not received
22 sufficient engineering date to evaluate this request, seconded by Mr. Anderson and
23 on unanimous voice vote, the motion was carried.-

25 Item 8F - Mr. Webb moved to notify that we are in receipt of your certification
26 of the 24' Argosy compact bus but direct your attention to Item 1 General
27 Demensions (18') , seconded by Mr. Anderson and on unanimous voice vote, the motion
28 was carried.

30 Item 9 - Mr. Anderson moved this not be acceptable, seconded by Mr. Webb and
31 on unanimous voice vote, the motion was carried. -

33 Item 11B - Mr. Anderson moved that Item 11B be found not acceptable, seconded by
34 Mr. Webb and on unanimous voice vote, the motion was carried.

36 Item 12A - Mr. Webb moved Item 12A be acceptable, seconded by Mr. Anderson and
37 on unanimous voice vote, the motion was carried.

39 Item 17A - Mr. Anderson moved that 17A be not accepted, seconded by Mr. Webb and
40 on unanimous voice vote, the motion was carried.

42 Item 20 - Mr. Anderson moved that Item 20 be not acceptable, seconded by Mr. Webb
43 and on unanimous voice vote, the motion was carried.

45 Item 21B - Mr. Anderson moved that Item 21B be found not acceptable, seconded by
46 Mr. Meredith and on unanimous voice vote, the motion was carried.

48 Item 22A - Mr. Webb moved to reject 22A since we don't have sufficient engineering
49 data to evaluate it, seconded by Mr. Anderson, and on unanimous voice vote, the
50 motion was carried.

52 Item 22B - Mr. Webb moved 5/8" exterior 'CD' plywood is an acceptable alternate to
53 1/2" exterior plywood, seconded by Mr. Anderson and on unanimous voice vote, the
54 motion was carried.

56 Item 22C - Mr. Webb moved we have not received sufficient engineering date to
57 evaluate this, seconded by Mr. Anderson and on unanimous voice vote, the motion
58 was carried.

60 Item- 22D - Mr. Webb moved this is an acceptable alternate, seconded by Mr.
61 Anderson and on unanimous voice vote, the motion was carried.

63 Item 22E - Mr. Webb moved this is an acceptable alternate, seconded by Mr.

66 Item 23A - Mr. Anderson moved for acceptance of Item 23A, seconded by Mr. Webb and

1 Item 23C - Mr. Anderson moved to find this not acceptable, seconded by Mr. Webb
2 and on unanimous voice vote, the motion was carried.

4 Mr. Anderson noted that where an item is acceptable, it is only 'substituting that
5 referred to in Argosy's request and not the whole section. All other items remain
6 the same.

8 Item 24A - Mr. Webb moved that Item 24A be denied, seconded by Mr. Anderson and
9 on unanimous voice vote, the motion was carried.

11 Item 24B. - Mr. Webb moved that there is not enough date to evaluate this
12 request, seconded by Mr. Anderson and on unanimous: voice vote, the motion was
13 carried.

15 Item 25B - Mr. Anderson moved to find Item 25B not acceptable, seconded by Mr.
16 Webb and on unanimous voice vote, the motion was carried.

18 Item 27B Item #1 vehicles - Mr. Webb moved 27B be denied, seconded by Mr.
19 Anderson and on unanimous voice vote, the motion was carried.

21 Item 27C Item #2 vehicles - Mr. Anderson moved that Item 27C #2 vehicles is not
22 acceptable, seconded by Mr.. Webb and on unanimous voice vote, the motion was

- 25 There being no further business on motion duly made, seconded and passed, the
26 meeting was adjourned.
