BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 29, 1977
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met
2 in regular session December 29, 1977 at the hour of 9:00 a.m. in the
3 Municipal Building in said City. Mr. Meredith presided with Mr. Anderson
4 present. Mr. Webb was on vacation. The following business was had, to-wit:

6 Mr. Anderson moved to approve the minutes of the previous meeting as
7 prepared, seconded by Mr. Meredith and on unanimous voice vote, the motion was
8 carried.

10 Mr. Meredith announced that as of yesterday evening the Board of Works has now
11 signed contracts with the police, fire and bus drivers.

13 Mr. Dan Dooley of the Plan Department reported the petition for vacation of
14 South 10th between Parry and South "L" Streets was heard by the Plan
15 Commission on December 20, 1977. There were ten (10) letters sent and five
16 (5) were returned in favor and one (1) from Mrs. Ballard, an adjoining property
17 owner, in opposition. The Commission voted six (6) to zero (0) to recommend
18 approval of this vacation.

20 Mr. Meredith read a letter from Fire Chief Paul Mullin stating this vacation
21 will cause no problems for the Richmond Fire Department and Capt. Scott Loper
22 of the Traffic Division of the Richmond Police Department stated this would
23 cause no problem for the Police Department. Capt. Loper further stated his
24 department would prefer access off of South "L" Street be closed.

26 At the last Board meeting Bob Goodwin stated he had received a call from
27 Attorney John Sayre stating he would like an opportunity to appear before the
28 Board on this matter. Mr. Sayre appeared with his client Mrs. Eva Ballard,
29 911 South "L". Mrs. Ballard's property adjoins, on the west, the entire street
30 considered. Mrs. Ballard stated school children had used her property
31 previously going from Hibberd and Richardson Schools to a restaurant. She
I32 fenced her property to prevent them using it, so they now use this public
33 street. She further stated cars use this. street. Mrs. Ballard stated there
34 is a storm sewer on this property. It was noted that Rev. Francis Daniels,
35 the petitioner for this vacation, does not own any adjoining property, but
36 does own property on the south side of Parry. Mrs. Jett, the adjoining
37 property owner on the east has indicated, as stated by Mrs. Ballard, she wants
38 the street vacated to gain more ground for play area for children she keeps.
39 Mrs. Ballard feels vacation would be a hardship on her as children going back
40 and forth would damage her property. Mr. Dooley stated Richmond Power & Light
41 has lines on both sides of the right-of--way. The street is sixty feet (60')
42 wide.

44 Mr. Anderson stated the public hearing was before the Plan Commission and this
45 all should have been done at that time. There is now a recommendation from
46 the Plan Commission for vacation. If this decision is reversed, the matter
47 will go to Common Council. Mr. Sayre stated Mrs. Ballard's sister died and
48 she was unable to attend the Plan Commission hearing.

50 Mrs. Dorothy Rice, 1106 South "0" Street, Mrs. Ballard's daughter, stated
51 Francis Daniels has a vacant lot between the church and his house and also owns
52 property across the street; so there should be plenty of property to build
53 a parking lot, if this is what the church wants. Mr. Sayre stated there has.
54 been no evidence as to how this ground would be used.

56 Mr. Anderson moved that the Board deny the petition as there is nothing in
III57 the form of a request from Mrs. Jett and no specific plans from the church as
58 to the use of the proposed vacation, seconded by Mr. Meredith and on unanimous
59 voice vote, the motion was carried.
