BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, SEPTEMBER 29, 1977
1 The Board of Public Works and Safety of the City of Richmond,
2 Indiana, met in regular session September 29, 1977 at the hour
3 of 9:00 a.m. in the Municipal Building in said City. Mr.
4 Meredith presided with Mr. Anderson and Mr. Webb present. The
5 following business was had, to wit:

7 Mr. Webb moved to approve the minutes of the previous meeting
8 as prepared, seconded by Mr. Anderson and on unanimous voice
9 vote the motion was carried.

11 Mr. Anderson moved to approve the minutes of the special meet-
12 ing held September 26, 1977, seconded by Mr. Webb and on unanimous
13 voice vote the motion was carried.

15 Mr. Anderson examined the proof of publication for bids for street
16 materials for Community Development and found it to be in order.

18 Mr. Webb moved to accept and file this proof of publication,
19 seconded by Mr. Anderson and on unanimous voice vote the motion
20 was carried.

22 The following bids were received and recorded: Magaw bid $15. 75
23 on itemq 1 through 6; Trojan Asphalt, Inc. bid $15.65 on items
24 1 through 6.

26 Mr. Anderson moved to take these bids under advisement, seconded
27 by Mr. Webb and on unanimous voice vote the motion was carried.

29 Mr. Anderson examined the proof of publication for bids for
30 leaf vacuum machines for the Department of Transportation and
31 found it to be in order.

33 Mr. Anderson moved to accept and file this proof of publication,
34 seconded by Mr. Webb and on unanimous voice vote the motion
35 was carried.

37 The following bid was received and recorded: Ries Equipment Co. ,
38 Inc. bid three (3) leaf machines at $3,980.00 each for a total
39 of $11,940.00.

41 Mr. Anderson moved to take these bids under advisement, seconded
42 by Mr. Webb and on unanimous voice vote the motion was carried.

44 Mr. John Schneider, representing Glick, requested a change in
45 drainage for Cambridge Square Sub-Division for a pond from
46 detention to retention basin and final approval for street
47 drainage under an access road to the project. City Plan Director
48 Bob Goodwin pointed out the approval recommended by the Plan
49 Commission and Council was based on the plan being worked out to
50 the satisfaction of the City Engineer and the Board of Works.

52 Mr. Webb moved to approve this plan subject to a hold harmless
53 agreement that meets the satisfaction of the City Attorney,
54 seconded by Mr. Anderson and on unanimous voice vote the motion
55 was carried.

57 Mr. Anderson moved to accept the recommendation of Chief Charles
58 Chris that Robert Beatty, Robert Burdette, James Downs,
59 Virginia Henemyre, John Mexin, John Miller, Marilyn Murray,
60 Clarence Porfidio, Alfred Shearer and Robert Windle be accepted
61 as duly qualified Richmond Police Department Reserve Officers
62 and be sworn as such, seconded by Mr. Webb and on unanimous
63 voice vote the motion was carried.

1 Mr. Meredith established the time of the swearing in
2 ceremonies as. Friday, September 30 at 6:00 p.m. in the
3 Board of Works Room.

5 Traffic Division Captain Scott Loper recommended that
6 Chapter 41, Article XIII Section 41.78 of the Richmond
7 Municipal Code be amended.to read "No person shall park
8 a vehicle on any street for a continuous period of time
9 longer than 24 hours, including Mobile Campers, Boats, Boat
10 Trailers and Trailers, or any other vehicle without motive
11 power designed for the conveyance of persons, property
12 or animals.

14 .Mr. Anderson moved that this amendment be presented to Common
15 Council, seconded by Mr. Webb and on unanimous voice vote
16 the motion was carried.

18 Mr. Anderson moved to accept the recommendation of Capt.
' 19 ' Loper that .the. north, south alley between So. 9th Street
20 and So. 10th Street, between the service drive South of
21 the Promenade and S. "A" Street, be converted to a two way
22 alley, seconded by Mr. Webb and on unanimous voice vote
23 the motion was carried. Mr. Meredith instructed the City
24 Attorney to prepare this recommendation for Council.

26 City Plan Director Robert Goodwin reviewed the. fiscal
27 plan for Ordinance No. 3202-1977 noting the main concern
28 in this area is road repairs. This area is not at this
29 time under litigation.

31 On Ordinance No. 3203-1977, annexation of the Southeast
32 area, action to be taken by the Board of Public Works and
33 Safety should include street repairs and installation of
34 sixteen (16) street lights. It was pointed out that this.
35 area now has fire protection by the City under contract by
36 the Wayne Twp. Fire Department and has County Police and
37 Planning.

39 Mr. Anderson stated the Board of Works is working within
40 the range of their duties concerning the areas under
41 Ordinances 3202 and 3203 as newly annexed areas even
42 though 3203 is under litigation.

44 Mr. Anderson stated some of the duties of the Board in
45 connection_:..with Ordinance No. 3235-1977, which is 'another
46 annexation Ordinance pending .before. Council include hiring
47 of additional police, additional police equipment, additional
48 fire protection, streetlights in area and street repair,
49 some of which is due to utility cuts.

51 Mr. Anderson stated he fells in order that the Board
52 recognizes its responsibility under statute as to providing
53 governmental proprietary services to ;the 'City newly annexed
54 areas and afeas proposed for annexation, serveral motions
55 are in order at this time to get us ready to provide these
56 services.

58 Mr. Anderson moved that the Board of Works and Safety
59 having studied the fiscal plan as adopted for Ordinance
60 No. 3202 as passed by Common Council and in compliance
61 with the expressed policy of the City to provide these
62 services by the. fiscal plan that the Board of Works now move
63 and request that the Street Department provide those range
64 of services set forth'in the fiscal plan under the time
65 schedule as set out, seconded by Mr. Webb and on unanimous
66 voice vote the motion was carried.

1 Mr. Anderson moved that under Ordinance No. 3203 having been
2 approved by the Common Council and Common Council having
3 adopted the fiscal plan and policy by Resolution to provide
4 governmental proprietary services and the Board of Public
5 Works and Safety recognizing its duties to provide govern-
6 mental proprietary services to the area recently annexed
7 that, in compliance with these documents, that we request the
8 Street Department to provide the range of services as set
9 forth in the fiscal policy of the plan within the time schedule
10 as outlined and further under 3203 that we approve and authorize
11 the installation of sixteen (16) street lights in the time as
12 set forth, seconded by Mr. Webb and on unanimous voice vote
13 the motion was carried. Mr. Meredith pointed out that .this
14 Ordinance is under litigation so the time referred to is
15 whenever the Court decides whether it is annexed or not.

17 Mr. Anderson moved that the Common Council., having on its
18 agenda pending Ordinance No. 3235 and will have presented to it
19 the recommendation of the Plan Commission as well as the suggested
20 fiscal plan and policy, and the Board of Public Works and Safety,
21 having studied the proposed fiscal plan and policy to be sub-
22 witted with said Ordinance and said Board of Public Works
23 recognizing certain governmental proprietary duties they are
24 under, now authorize, subject to the approval of the Ordinance,
25 - the hiring of three (3) additional policemen to service the area
26 and said authorizi.on being effective whenever the Ordinance
27 becomes effective. He further moved that an additional sum
28 totaling $244. 75 be added to the budget for the police depart-
29 meet to provide the necessary ticket books and initial
30 laboratory supplies to service this area and further move an
31 expenditure of $10,966.00 be provided for fire protection for the
32 area as outlined in the fiscal plan and also that the Street
33 Department provide the range. of services within the time period
34 as outlined in the fiscal plan and that forty-nine (49) street
35 lights be installed at the time that's appropriate within the
36 fiscal plan, seconded by Mr. Webb and on unanimous voice vote
37 the motion was carried.

39 Mr. Anderson moved that pursuant to IC 18-1-6-15C that the Board
40 recommend to the Common Council for funds needed to be provided
41 for these services, that funds be specifically earmarked and to
42 be utilized to provide these services in these different
43 services, for example in the authorizing the hiring of three
44 (3) additional policemen the funds here will come from tax
45 monies received from this area to provide these services and
46 we reimburse those funds that are utilized in the interim,
47 for the additional equipment for the policemen that again tax
48 monies received from the area be utilized and impounded to
49 provide the services. For the fire protection needed for this
50 area that we can use the general tax monies coming from that
51 area and for the Street Department to provide necessary street
52 repairs and other services as outlined, that again tax monies
53 be used from that area to provide the services ,which means
54 those monies will be impounded, and as far as the installation
55 of the street lights, funding for this service is to be requested
56 from Revenue Sharing or the General Fund pending upon the
57 circumstances at the time of such approval, seconded by Mr.
58 Webb and on unanimous voice vote the motion was carried.

60 Mr. Anderson moved that .a copy of these motions and these
61 requests and these authorizations be sent by letter to the
62 president of Common Council, members of Common Council .and Mrs.
63 Trimble, City Clerk and to be part of the fiscal plans and
64 recommedations of the Plan Commission for the Monday night agenda,
65 seconded by Mr. Webb and on unanimous voice vote the motion
66 was carried.

1 Mr. Webb moved on recommendation of Chief Chris, to
2 establish Sunday, October 30, 1977 from 4:00 to 8:00 p.m.
3 for the celebration of Halloween, seconded by Mr. Anderson.

6 Community Development Director Tim Ryder announced that
7 tommorrow at 10:00 a.m. opening ceremonies will be held
8 at Hawkins Road and North 20th Street to dedicate the
9 final leg of the northeast by—pass.

11 There being no further business on motion duly made, seconded
12 and passed the meeting was adjourned.

These minutes were amended to include this response from Chief
Chris on page 2 line 50.
In response to a question raised by Mr. Anderson as to why
additional policemen are needed under Ordinance No. 3235 and
not under 3202 and 3203, Chief of Police Charles Chris stated
the area to be covered had been looked at and the amount of
service as -provided by the existing district and to the
extent of development known and extent of development proposed
within a three (3) year requirement period, that the
additional service can be provided by the officer who serves
that eastern district. Many of, thos.e roads are used as cut
throughs and around the district now. In a tour of duty,
although some of those roads are technically outside the city
limits, they are used to move from one district to another
or from one part of that district to another to answer calls
or to change patrol patterns. Chief Chris stated he did not
see additional work in that area as being a burden on that
district and that district can absorb additional duties.
