ADOPTION OF RESOLUTION NO. 14-5001, 14-5002 AND 14-5003 CONFIRMING APPOINTMENTS TO THE PARKS AND RECREATION, TRANSPORTATION AND PUBLIC SAFETY AND PLANNING COMMISSIONS The City Council is requested to: 1) Adopt Resolution No. 14-5001 confirming appointments to the Parks and Recreation Commission; City Council Agenda June 17, 2014 Page 2 of 10 2) Adopt Resolution No. 14-5002 confirming appointments to the Transportation and Public Safety Commission; 3) Adopt Resolution No. 14-5003 confirming appointments to the Planning Commission; and 4) Request the City Clerk to administer the Oath of Office to new commissioners. B. Proclamation – Relay for Life C. Presentation – South Coast Air Quality Management Commercial Lawn Mower Demonstration D. Presentation – Temple City Chamber of Commerce Quarterly Update 6. Recommendation: Approve Items A through M per commendations. A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Special Meeting of May 28, 2014; and 2) Minutes of the City Council Regular Meeting of June 3, 2014. Recommendation: Approve. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS – MEETING OF MAY 28, 2014 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of May 28, 2014. City Council Agenda June 17, 2014 Page 3 of 10 Recommendation: Receive and file. C. APPROVAL OF VENDING MACHINE AGREEMENTS WITH PREMIER VEND GROUP, INC. AND MCNEVIN 3 IN 1 VENDING, INC. FOR VENDING SERVICES AT LIVE OAK PARK FOR FISCAL YEARS (FY) 2014-16 City Council is requested to review and approve the Vending Machine agreements for Premier Vend Group, Inc. and McNevin 3 in 1 Vending, Inc. to provide vending services at Live Oak Park from July 1, 2014 – June 30, 2016. Recommendation: Approve the Vending Machine Agreements for vending services at Live Oak Park and authorize the Interim City Manager to execute the Agreements. D. APPROVAL OF GROUNDS MAINTENANCE AGREEMENT BETWEEN THE COUNTY OF LOS ANGELES AND THE CITY OF TEMPLE CITY For almost 50 years, the County of Los Angeles has contracted with the City of Temple City to provide maintenance of the grounds surrounding the County library adjacent to Temple City Park. The present Agreement will expire on June 30, 2014. The proposed five-year Agreement includes an increase of approximately 2% each year. Per the terms of the Agreement, the County will pay the City a total of $20,850 over the five-year term. Recommendation: Approve the Grounds Maintenance Agreement with Los Angeles County and authorize the Interim City Manager to execute the Agreement. E. APPROVAL OF FIRST AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT WITH VASQUEZ & COMPANY, LLP Consistent with the City Council’s directive during the FY 2010-11 City Budget deliberations, staff completed the formal RFP process for the City’s auditing and accounting services. A Consultant Agreement with Vasquez & Company was approved by the City Council and executed by the City Manager. The Consultant Agreement had an initial term of three years with two, one year extensions. Recommendation: Approve an amendment to the consultant agreement with Vasquez & Company, LLP, a one year extension providing for auditing services for the period ending June 30, 2014, and authorize the Interim City Manager to sign the amendment. APPROVAL OF CONSULTANT SERVICES AGREEMENT WITH WILLDAN ENGINEERING TO PROVIDE HOUSING CONSULTANT SERVICES FOR THE CITY’S HOME IMPROVEMENT PROGRAM The City issued a Request for Proposal for the housing consultant services to ensure that the City was receiving the most efficient and cost effective service. The City received and reviewed all five proposals. It is staff’s assessment that Willdan has the necessary combination of experience and credentials to help administer the City’s Home Improvement Program within budget. Recommendation: Review and approve a consultant services agreement with Willdan Engineering to provide the City with housing program consultant services through June 30, 2015 in an amount not to exceed $56,000 and authorize the Interim City Manager to finalize and execute the agreement. G. SECOND READING AND ADOPTION OF ORDINANCE NO. 14-993 AMENDING TITLE 6 (“PUBLIC HIGHW AYS, SEW ER, AND UTILITIES”), CHAPTER 2 (“SEW ERS AND W ASTE”), ARTICLE C (“GARBAGE AND RUBBISH DISPOSAL”), SPECIFICALLY, SECTION 6.2C(2) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE LOCATION, PLACEMENT TIME-FRAMES, AND CONSTRUCTION OF TRASH CONTAINERS Ordinance No. 14-993 amends the existing code by establishing acceptable trash container placement areas and new time-frames for collection days. The proposed Ordinance will improve the City’s quality of life by addressing aesthetics, public safety concerns, and increasing the effectiveness of the City’s street sweeping program and NPDES best practices. Recommendation: Adopt Ordinance No. 14-993. H. REAFFIRMATION OF COMMITTED AND ASSIGNED FUND BALANCE CLASSIFICATIONS FOR THE GENERAL FUND FOR FINANCIAL STATEMENT REPORTING PURPOSES AT JUNE 30, 2014, IN ACCORDANCE WITH THE ADOPTED GASB 54 FUND BALANCE POLICY In order to be in compliance with the City’s Government Accounting Standards Board (GASB) 54 Fund Balance Policy adopted on May 15, 2012, the City Council must reaffirm Committed Fund Balances and Assigned Fund Balances f or the General Fund prior to the end of the f iscal year f or f inancial statement reporting purposes at June 30, 2014. City Council Agenda June 17, 2014 Page 5 of 10 Recommendation: Reaffirm the Committed Fund Balance of $3,500,000 and the Assigned Fund Balance of $12,769,580 for the General Fund. I. ADOPTION OF RESOLUTION NO. 14-5004 ADOPTING THE FISCAL YEAR (FY) 2014-15 STATEMENT OF INVESTMENT POLICY The Administrative Services Director/City Treasurer is required to report information regarding investments and deposits on a quarterly basis to the City Council and City Manager. In order to be proactive and completely transparent, the Administrative Services Director/City Treasurer provides a monthly report on the investment of the City of Temple City’s funds to both the City Council and City Manager. Recommendation: Adopt Resolution No. 14-5004, adopting the Statement of Investment Policy for the City of Temple City for FY 2014-15. J. ADOPTION OF RESOLUTION NO. 14-5005 ADOPTING REVISED SALARY RANGES FOR PART-TIME CLASSIFICATIONS FOR FISCAL YEAR (FY) 2014-15, IMPLEMENTING MINIMUM WAGE Effective July 1, 2014, the State of California’s minimum wage law is increasing from $8.00 per hour to $9.00 per hour. Two of the part-time classifications (i.e., Recreation Leader I and Recreation Aide) include steps in the salary ranges for FY 2013-14 that are below $9.00 per hour. In order to be in compliance with State law, it is recommended these steps in the salary ranges be adjusted. In order to remain consistent with all other salary steps in all ranges, a 4% difference between steps is also recommended for Recreation Leader. Recommendation: Adopt Resolution No. 14-5005, adopting salary ranges for part-time classifications for FY 2014- 15, implementing minimum wage. K. FISCAL YEAR (FY) 2013-14 CITY BUDGET - FOURTH QUARTER BUDGET AMENDMENTS The City Council is requested to authorize staff to revise various budgeted appropriations for the FY 2013-14 City Budget to ensure actual spending levels is within budgeted appropriations during the current fiscal year. L. VISA CARD REPORT The City Council is requested to review, receive and file the Visa Card Report. Recommendation: Receive and file. M. ADOPTION OF RESOLUTION NO. 14-5006 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 14-5006 authorizing the payment of bills. Recommendation: Adopt Resolution No. 14-5006. 8. PUBLIC HE ARING – None 9. UNFINISHED BUSINESS – None 10. NEW BUSINESS A. REQUEST FROM SING TAO NEWSPAPERS LOS ANGELES LTD. FOR THE CITY TO HOST AND CO-SPONSOR THE “2015 SING TAO LUNAR NEW YEAR STREET FESTIVAL” This will be Sing Tao’s fifth Chinese New Year’s Festival. Previous festivals have been co-sponsored by the City of Walnut (2011-2013) and the City of Temple City (2014). In light of a successful event in 2014, Sing Tao is requesting City of Temple City to co-sponsor the 2015 Sing Tao Lunar New Year Street Festival. Presentation: Public Safety and Services Manager Recommendation: 1) Receive a presentation from Sing Tao Newspapers Los Angeles LTD. (Sing Tao) regarding their request to conduct the “2015 Sing Tao Lunar New Year Street Festival” and that the City host and co-sponsor the event; and 2) Consider hosting and co-sponsoring the “2015 Sing Tao Lunar New Year Street Festival” Saturday, January 24 – Sunday, January 25, 2015 dependent upon Sing Tao’s completion of certain conditions by December 2, 2014. City Council Agenda June 17, 2014 Page 7 of 10 B. LETTER OF SUPPORT FOR SENATE BILL 1086, THE SAFE NEIGHBORHOOD PARKS, RIVERS, AND COASTAL PROTECTION BOND ACT OF 2014 Sponsored by the California Parks and Recreation Society and authored by Los Angeles Senator Kevin De León, Senate Bill 1086, creates the framework for a future park and resources bond, the Safe Neighborhood Parks, Rivers and Coastal Protection Bond Act of 2014. If adopted by the voters, Senate Bill 1086 would authorize the issuance of bonds in an unspecified amount pursuant to the State General Obligation Bond Law to finance a safe neighborhood parks, rivers, and coastal protection program. Presentation: Parks and Recreation Director Recommendation: Authorize the Mayor to sign a letter supporting Senate Bill 1086, the proposed Safe Neighborhood Parks, River, and Coastal Protection Bond Act of 2014. C. FIRST READING AND INTRODUCTION OF ORDINANCE NO. 14-994, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 3-2C-2 (“SECOND-HAND SMOKE CONTROL”) OF ARTICLE C OF CHAPTER 2 OF TITLE 3 AND SECTION 3-5D-9 (PARK ACTIVITIES: BEHAVIOR) OF ARTICLE D OF CHAPTER 5 OF TITLE 3 OF THE TEMPLE CITY MUNICIPAL CODE The proposed Ordinance would place the same regulations on e-cigarettes and other electronic smoking devices that are already in effect for other tobacco and marijuana products. It is recommended that the City Council adopt proposed Ordinance No. 14- 994 to include electronic smoking devices in the City’s Second-Hand Smoke Ordinance and modify the prohibited types of behaviors within City parks. Presentation: Public Safety and Services Manager Recommendation: 1) Introduce Ordinance No. 14-994, for first reading by title only, amending Section 3-2C-2 of Article C of Chapter 2 of Title 3 and Section 3-5d-9 of Article D of Chapter 5 of Title 3 of the Temple City Municipal Code to include electronic smoking devices in the City’s current smoking regulations; City Council Agenda June 17, 2014 Page 8 of 10 2) Waive further reading of Ordinance No. 14-994; and 3) Schedule second reading of Ordinance No. 14-994 for July 1, 2014. 11.
