Roll Call: 2. Approval of Agenda: Minutes of February 24, 2010 Commissioner Cook moved, and Commissioner Soles seconded the motion to approve the Agenda. Motion carried: 6 -0. 3. Open Forum: 4. Public Hearings: a. Development Permit Winter Park Market Farmers' Market The Village at Grand Park Commissioner Shapiro moved, and Commissioner Cook seconded the motion to open the Public Hearing on Development Permit Winter Park Market Farmers' Market The Village at Grand Park. Motion carried: 6 -0. TP Trotter gave proof of publication. FRASER PLANNING COMMISSION MINUTES The section of the Fraser Town Code which regulates development permits is Chapter 16, Article 4, B- Business District. The Farmers' Market is a temporary use and as such would be considered a minor proposal. Last year, the owners of the Winter Park Market applied for a development permit to operate a Farmers' Market at the General Store. Although, the PC conditionally approved this request, the Farmers' Market never came to fruition last year. The Winter Park Market has submitted the same development permit for this year. Pending any issues that may arise at the public hearing, Staff is recommending approval of Development Permit Farmers' Market at the Winter Park Market adjacent to the "General Store" at the Village at Grand Park with the condition that all signage conform to the Fraser Sign Code or an approved First Amendment to the Grand Park Sign Plan. Mark Hanna was present to represent Winter Park Market. The starting date will be around July 1St Commissioner Soles moved, and Commissioner Cook seconded the motion to close the Public Hearing on Development Permit Winter Park Market Farmers' Market The Village at Grand Park. Motion carried: 6 -0 Commissioner Brent moved, and Commissioner Soles seconded the motion to approve the Development Permit Winter Park Market Farmers' Market The Village at Grand Park with the following conditions: 1. Written permission from the private property owner (until 12 -31 -2010) must be provided to the Town prior to conducting business. In addition, the applicant must get written permission from one of the adjacent businesses to use restroom facilities. 2. A business license must be purchased and sales tax must be collected and remitted to the Town. 3. The operator of the market may not yell, scream, use blow horns or megaphones to sell the product. Festive music kept at a reasonable volume is permitted. 4. Any required state licensing and health permits must be obtained and visible. 5. All signage conform to the Fraser Sign Code or an approved First Amendment to the Grand Park Sign Plan. Motion carried: 6 -0 5.
