HomeMy Public PortalAbout22-015 - Calling for a General Election to be held November 8, 2022Sponsored by: City Clerk RESOLUTION NO. 22-015 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, CALLING FOR A GENERAL ELECTION TO BE HELD ON NOVEMBER 8, 2022 IN THE CITY OF OPA-LOCKA FOR THE PURPOSE OF ELECTING A MAYOR AND TWO CITY COMMISSIONERS; FURTHER PROVIDING FOR A RUN- OFF ELECTION, IF REQUIRED, TO BE HELD ON DECEMBER 6, 2022; PROVIDING FOR CONDUCT OF SAID ELECTIONS BY MIAMI-DADE COUNTY ELECTIONS DEPARTMENT (MIAMI-DADE COUNTY); PROVIDING THAT VOTING PRECINCTS FOR SAID ELECTIONS SHALL BE THOSE AS ESTABLISHED BY MIAMI-DADE COUNTY; PROVIDING FOR NOTICE OF SAID ELECTIONS; PROVIDING FOR THE FORM OF BALLOT AND REGISTRATION IN ACCORDANCE WITH STATE LAW; PROVIDING FOR VOTER PARTICIPATION VIA VOTE -BY MAIL IN SAID ELECTIONS IN ACCORDANCE WITH STATE LAW; PROVIDING FOR PAYMENT FOR CONDUCTING ELECTIONS TO MIAMI-DADE COUNTY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. In accordance with provisions of the Charter and Code of the City of Opa- locka, Florida, a General Election is hereby called and directed to be held in the City of Opa- locka, Florida, from 7:00 a.m. to 7:00 p.m. on November 8, 2022, for the purpose of electing a Mayor and two City Commissioners, each of whom shall hold office for the terms as provided by law. If required, pursuant to provisions of the City Charter, a Run -Off Election shall be held from 7:00 a.m. to 7:00 p.m. on December 6, 2022. 1 Resolution No. 22-015 Section 2. That the appropriate and proper Miami -Dade County election officials shall conduct this General Election and Run -Off Election hereby called, with acceptance of the certification of the results of the Elections to be performed by the City Commission. The official returns for each precinct shall be furnished to the City Clerk of the City of Opa-locka as soon as the ballots from all precincts have been tabulated. Section 3. That the voting precincts in the City for this General Election and Run -Off Election shall be as established by the proper and appropriate Miami -Dade County election officials. All electors shall vote at the polling places and the voting precincts as determined by the Miami -Dade County election officials. Section 4. Not less than thirty days' notice of the adoption of this Resolution and of its provisions calling this General Election and Run -Off Election shall be given by publication in the Miami Herald, a newspaper of general circulation in Opa-locka, Miami -Dade County, Florida. Such publication shall be made in accordance with State Law and Section 8.5-3(b) of the Code of the City of Opa-Locka.1 Section 5. The Notice of Elections shall be substantially in the following form: CITY OF OPA-LOCKA, FLORIDA NOTICE OF GENERAL ELECTION {AND RUN-OFF ELECTION, IF REQUIRED) Notice is hereby given that a General Election has been called by the City Commission of the City of Opa-locka, Florida, and will be held in said City from 7:00 a.m. until 7:00 p.m. on November 8, 2022, for the purpose of electing a Mayor and two (2) City Commissioners, each of whom shall hold office for the terms as Pursuant to City Code Section 8.5-3(b) "The City Commission shall authorize and direct the City Clerk to give notice of the adoption of such resolution and of the provisions thereof hereinbefore prescribed, by and through the publication of an appropriate advertisements in a daily newspaper of general circulation in the city at least fifteen (15) days before the day upon which such municipal election is to be held." 2 Resolution No. 22-015 provided by law. A Run -Off election, if required, shall be held from 7:00 a.m. to 7:00 p.m. on December 6, 2022. The Notice shall further set forth pertinent information regarding eligibility of electors to participate in these Elections. Section 6. The official ballot to be used in the General Election to be held on November 8, 2022, hereby called, shall be in substantially the following form, to wit: "OFFICIAL BALLOT" GENERAL ELECTION FOR ELECTING THE MAYOR AND TWO (2) CITY COMMISSIONERS OF THE CITY OF OPA-LOCKA, FLORIDA ON NOVEMBER 8, 2022 Opa-Locka — Mayor Vote for 1 (Insert names) Opa-Locka — Commissioners Vote for 2 (Insert names) Section 7. In the event a Run -Off Election is required to be held on December 6, 2022, the official ballot to be used at such Run -Off Election shall be in substantially the same form as the official ballot for the General Election in Section 6 above, except that the heading of the ballot for the Run -Off Election shall be in substantially the following form, to wit: 3 Resolution No. 22-015 "OFFICIAL BALLOT" RUN-OFF ELECTION FOR ELECTING THE MAYOR AND/OR CITY COMMISSIONERS OF THE CITY OF OPA-LOCKA, FLORIDA ON DECEMBER 6, 2022 Vote by mail ballots shall be issued in accordance with the election laws of the State of Florida pertaining thereto. Section 8. Registration of persons desiring to vote in the General and Run -Off Elections shall be in accordance with the general law of the State of Florida governing voter registration. Each person desiring to become a registered voter shall be responsible for properly filling out the registration form and returning it to the Miami -Dade County Elections Department. All questions concerning voter registration should be directed to the Miami -Dade County Elections Department, 2700 NW 87 Avenue, Miami, Florida 33172; Telephone: (305) 499 - VOTE (8683). Section 9. That voters participating via a Vote -by -Mail ballot in this General Election and/or Run -Off Election shall be entitled to cast their ballots in accordance with the provisions of the Laws of the State of Florida with respect to such voting. Section 10. That the City of Opa-locka shall pay all expenses for conducting this General Election and, if required, the Run -Off Election, and will pay to Miami -Dade County or directly to all persons or firms, upon receipt of invoice or statement approved by the Supervisor of Elections of Miami -Dade County, Florida. Section 11. The recitals to the preamble herein are incorporated by reference. Section 12. This Resolution shall take effect upon adoption by the City Commission and is subject to the final approval by the State of Florida Financial Oversight Board for the City of Opa-locka, FL to the extent appropriate. Staff Summary: Section 5.1. - Municipal Elections. A. Holding elections[.] The regular election for members of the commission and mayor shall be held on the first Tuesday after the first Monday in November of each even numbered calendar year. F. What commissioners declared elected; how tie vote decided. At any regular municipal election held under the provisions of this charter, the candidates for the office of commissioner, in number equal to the number of commissioners to be elected, who shall have received the greatest number of votes cast, shall be declared elected. The candidate for Mayor receiving the greatest number of votes cast shall be declared elected. A tie between two (2) or more candidates for the office of commissioner shall be decided by a run-off election to be held within thirty (30) days of the certification of the results of the regular election. Similarly, a tie between two or more candidates for mayor shall be decided by a run-off election to be held within thirty (30) days of the certification of the results of the regular election. No runoff shall be held less than twenty-one (21) days after the regular election. Pursuant to Sections 5.1(a) and 5.1(f) of the City of Opa-locka Charter, the City of Opa-locka General Election for the election of the mayor and two (2) city commissioners is scheduled to be held on Tuesday, November 8, 2022. A City of Opa-locka Run -Off Election, if necessary, is scheduled for Tuesday, December 6, 2022. FINANCIAL INFORMATION The Miami -Dade County Elections Department has provided the City Clerk with an estimate of $4,474.26 for the City's November 8, 2022 General Election (see estimate — General Election). The Mami-Dade County Elections Department has provided the City Clerk with an estimate of $25,838.78 for the City's December 6, 2022 Run -Off Election, if required (see estimate — Run -Off Election).
