HomeMy Public PortalAboutr 16-130eoolufiou of toe Porog4 of &rteref, �M 531 No. 16 -130 Date of Adoption 21, 4716 STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION OFFICE OF NATURAL RESOURCE RESTORATION PASSAIC RIVER NATURAL RESOURCE RESTORATION PROJECTS (NEWARK BAY COiNIPLEX) ENABLING RESOLUTION WHEREAS, the New Jersey Department of Environmental Protection, Office of Natural Resource Restoration ( "State "), has issued a notice of competitive grant funding availability to municipal governments and regional entities for assistance in the acquisition and development of lands for the enhancement of public access and enjoyment to waterfront resources in the Newark Bay Complex, which is inclusive of the Arthur Kill waterway on the eastern boundary of the Borough; and WHEREAS, the Borough of Carteret ( "Borough ") desires to further the public access to and enjoyment of the Arthur Kill waterfront by obtaining funding from the State to fund future phases of the Waterfront Marina project at Block 201, Lots 3.02 and 4. NOW, THEREFORE, the governing body/board resolves that CNIE Associates is hereby authorized to: (a) make application for such a grant, (b) provide additional application information and famish such documents as may be required, and (c) act as the authorized correspondent of the above named applicant; and WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Office of Natural Resource Restoration, and notify the Borough of the amount of the funding award; and WHEREAS, the Borough is willing to use the State's funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the State for the above named project; NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE Borough of Carteret 1. That Mayor Daniel J Reiman is hereby authorized to execute an agreement and any amendment thereto with the State known as Waterfront Marina 2. That the Borough will provide matching share of at least 50% of the funding available necessary to complete the project; 4. That the Borough agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and 5. That this resolution shall take effect immediately.
