HomeMy Public PortalAboutAnimal Control Services Interlocal Agreement with Walton County Sheriff DepartmentINTERLOCAL AGREEMENT/ MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CRESTIVEW AND THE WALTON COUNTY SHERIFF'S DEPARTMENT FOR INTERIM EMERGENCY ANIMAL CONTROL SERVICES THIS MEMORANDUM OF UNDERSTANDING ("MOU") is an interlocal agreement pursuant to Section 163.01 (4) and (5), Florida Statutes and is made and entered into as of January 1, 2022 by and between the City of Crestview, Okaloosa County and the Walton County Sheriff's Office ("WCSO"). The purpose of this MOU is to memorialize an agreement between the parties concerning the provision of emergency animal control services for a period commencing on January 1, 2022 and ending on March 1, 2022 (the "Term"), unless earlier terminated as provided herein. WHEREAS, the City of Crestview ("City") is in need of certain interim emergency animal control services for the Term (the "Interim Services"); and WHEREAS, WCSO provides animal control services in its jurisdiction and has the capability and capacity to provide the Interim Services to the City as further provided herein; and WHEREAS, the City desires to contract with WCSO for such Interim Services, and WCSO is willing to provide such services to the City, on an emergency, "as -needed" basis during the Tenn. NOW THEREFORE, the City and WCSO agree to the following terms and conditions for the provision of the Interim Services: 1. WCSO will provide the City with the following Interim Services: a. Respond to and/or assist with the following types of service requests: i. Dangerous animal and bite cases. ii. Assist with injured stray animals on an emergency basis. iii. Assist law enforcement and other agencies in impounding dangerous animals. iv. Assist law enforcement and other agencies in confiscation of animals where permitted or required by law. v. Assist with City investigations of animal cruelty and neglect, which may also include removal of neglected or abused animals. vi. Assist with City investigations of dangerous and potentially dangerous animal claims, which may include impounding animals and follow up compliance inspections. vii. Provide shelter and veterinary treatment as necessary, except in those cases associated with animal cruelty /neglect. b. The City shall provide an officer of the City Police Department to accompany WCSO on any Interim Service call occurring within the jurisdiction of the City/City limits. c. WCSO shall contact the City prior to performing veterinary services on an animal if the cost is anticipated (in the sole discretion of the WCSO) to be more than one thousand dollars ($1000) in total. Wage 2. The City acknowledges and agrees that the foregoing services provided by WCSO are not law enforcement activities, but are animal control services that may be performed by civilian, non -sworn personnel employed by WCSO. 3. Payment to WCSO for services rendered under this Agreement shall be as follows: a. The City shall pay WCSO $35.00 per hour for any Interim Services rendered. Time will be calculated from the time the WCSO employee is dispatched until all work related to the call is complete as determined in the sole discretion of the WCSO. b. The City will reimburse WCSO on a pass -through basis (or directly pay providers if necessary) actual costs incurred for veterinary services rendered related to calls or animals originating from the City, and for any other reasonable and necessary expense incurred by WCSO in the care of in -custody animals from the City. c. WCSO will bill the City monthly for services rendered. The bill will provide basic details related to the call as well as detailed information for reimbursement of incurred expenses. Back up information can be in the form of receipts or customary format used by WCSO for such purposes. 4. WCSO will maintain any and all records as required for this service and provide them on request in accordance with public records laws. 5. Rendition of service, standards of performance, discipline of officers and employees, and other matters incident to performance of service and control of any and all WCSO personnel will remain with WCSO. 6. This MOU may not be assigned or subcontracted to any other individual, firm or entity without the express and prior written approval of the City and WCSO. 7. Either party may request changes in the Agreement. Any and all agreed modifications shall be in writing, signed by each of the parties. 8. Without waiving any privilege of sovereign immunity available to either party to this MOU, the City agrees to defend, indemnify and hold harmless WCSO for any claims arising as a result of WCSO's performance of this agreement except with respect to claims under Chapter 119, Florida Statutes for gross negligence of any party or employee in performance of services. 9. If any term or condition of this Agreement or the application thereof to any party or circumstance is held invalid, such invalidity shall not affect other terms, conditions or applications which can be given effect without the invalid term, condition or application. 10. This MOU represents the entire Agreement between the parties and supersedes any prior oral statements, discussions or understandings between the parties. 2IPage 11.
