HomeMy Public PortalAbout05-12-1977 / BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, MAY 12, 1977 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met 2 in regular session May 12, 1977 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Meredith presided with Mr. Anderson and Mr. Webb 4 present. The following business was had, to-wit: 5 6 Mr. Anderson moved to approve the minutes of the previous meeting as corrected 7 to include accepting and filing of proof of publication for Holsapple Street II/ 8 Improvement, seconded by Mr. Webb and on unanimous voice vote the motion was 9 carried. 10 11 Mr. Matt Stegall; . representing Old Richmond, Inc.; requested. permission to use 12 the main foyer of the City Building from June 12 to June 30, 1977 for a dis- 13 play of eleven (11) Indiana cities' growth in the last 200 years. The College 14 of Architecture and Planning at Ball State University is circulating this 15 exhibit. There will be no cost to the. City or to Old Richmond and students 16 from Ball State will assemble and disassemble the exhibit. Mr. Anderson moved 17 for permission for Old Richmond to use the foyer of the City Building for 18 the display, seconded by Mr. Webb and on unanimous voice vote the motion was 19 carried. 20 21 Bike-A-Thon, which was the seconditem on the agenda, was stricken from the 22 agenda and will not appear until a further request is received. 23 24 Ms. Barbara Barnhizer of Community Development Department recommended that 25 the bid for the Holsapple Street Improvement be awarded to A & D Excavating 26 at a cost of $122,691. 75 upon concurrence of HUD. Mr. Anderson moved accept- 27 ance of the recommendation of Community Development to award the bid to A & D 28 Excavating, subject to concurrence of HUD, seconded by Mr. Webb and on unani- 29 mous voice vote the motion was carried. 30 - 31 Mr. Anderson recommended that the City accept a settlement in the matter of a 32 Barrett Law - Willie Smith suit which arose from a sanitary sewer on Straight- "' like Pike as the property owner is willing to advance to the City of Richmond 34 fifteen hundred dollars ($1500.00) as his assessment. The Board of Works 35 is asked to sign a release. Mr. Anderson's recommendationis,based on the 36 recommendation of two (2) former City Attorneys, Mr. Robert Reinke and Mr. 37 Robert Burton. 38 39 Mr. Anderson requested-.the following letter appear in the minutes: 40 41 February 22, 1977 42 43 Mr. Don Meredith 44 City Controller 45 City of Richmond 46 Municipal Building 47 Richmond, Indiana 47374 48 49 Re: Willie Smith vs. City of Richmond 50 Cause No. C-73-6333-C - Wayne Circuit Court 51 52 Dear Mr. Meredith: 53 54 Bob Reinke has advised me that the above captioned suit 55 can be settled by Mr. Smith paying to the City the sum of 56 $1,500.00. 57 58 In light of the difficulties in the suit, as I recall 59 them, regarding the necessity of going through a complete 60 Sanitary District proceeding as well as the serious technical 61 operations raised by the lawsuit and the question of the 62 benefits to this particular property, it is my opinion that 63 this is a fair settlement. May 12, 1977 Page 2 1 Mr. Meredith moved to enter into the mutual release, seconded by Mr. Webb. 2 Mr. Meredith and Mr. Webb voted aye with Mr. Anderson abstaining. 3 4 Mr. Webb moved to approve the recommendation of Sgt. Ron Williams to remove 5 a stop sign at the intersection of No. 19th & "F" for eastbound traffic on 6 No. "F" and that a yield sign be installed in place of the stop sign, seconded 7 by Mr. Anderson and on unanimous voice vote the motion was carried. 8 9 Fire Chief Paul Mullin recommended a fire hydrant on Northwest llth Street 10 on a request by Wayne Dairy Products, Inc. near their building site. The 11 exact location of this hydrant is to be determined when the building is far 12 enough under construction to require more fire protection. 13 14 Mr. Anderson moved to accept the recommendation of the Richmond Fire Depart- 15 ment as to the installation of this hydrant. As Mr. Webb wished to amend this 16 motion, Mr. Anderson's motion died for lack of a second. 17 18 Mr. Webb moved the recommendation of the Richmond Fire Department for installa- 19 • tion of a fire hydrant near the new building of Wayne Dairy Products, Inc. 20 on Northwest llth Street with the Water Company working with the City Engin- 21 eer's office to determine the most advantageous location for all parties con- 22 cerned, seconded by Mr. Anderson and on unanimous voice vote the motion was 23 carried. 24 25 Mr. Anderson moved to accept the recommendation of Fire Chief Paul Mullin 26 for the advancement of Edward Kenney and Franklin DeVito to Firefighters First 27 Class, effective May 13, 1977, seconded by Mr. Webb and on unanimous voice 28 vote the motion was carried. 29 30 Fire Chief Paul Mullin recommended Deputy Fire Marshall William Griffin be 31 reduced to the rank of firefighter and that he be suspended for a period of 32 sixty (60) days from the Richmond Fire Department without pay and that all 33 bidding rights shall be suspended for one (1) year. This action is being 34 taken for violation of Article XIV, Section 1, Item, J, of the Rules and 35 Regulations of the Richmond Fire Department, which is conduct unbecoming a11/ 36 firefighter. The suspension period is May 12, 1977 through July 10, 1977. 37 Chief Mullin stated Mr. Griffin indicated in writing that he did not wish 38 to be present, does not wish to be represented and waives all his rights. 39 40 Mr. Anderson moved acceptance of the recommendation of Chief Mullin, seconded 41 by Mr. Webb and on unanimous voice vote the motion was carried. 42 43 There being no further business on motion duly made, seconded and passed, the 44 meeting was adjourned. 45 46 Donald E.
