DRAWER 1209, CRESTVIEW, FLORIDA 32536 Phone # (850) 682 – 1560 September 21, 2021 5:30 PM Council Chambers Special Magistrate Hearing Minutes At the public hearing before the Special Magistrate all interested parties may appear and be heard with respect to the proposed items. Notice is given pursuant to Section 286.0105, Florida Statutes, that in order to appeal any decision made at these public hearings, you will need a verbatim record of the proceedings. It will be your responsibility to ensure that a verbatim record is made. In accordance with the Americans with Disabilities Act, any persons with a disability requiring reasonable accommodations in order to participate in this meeting should call the City Clerk at (850) 682-1560 at least 48 hours prior to the public hearing. 1 Call to Order The hearing was called to order at 5:27 by Special Magistrate Sam Taylor 2 Administration of oath to staff/ Respondents /Witnesses 3 Red Light Hearings Magistrate Sam Taylor administered the oath to those who would be providing testimony in the Red light Hearing. 3.1. HOV 1012000000075527 Investigator Don Howe of the Crestview PD presented the case for the City and reviewed the video. Mr. Vignolo gave testimony in his defense. Magistrate Sam Taylor found the defendant to be guilty of the violation and ordered that the $158 fine plus the $75 hearing fee be paid. Inv. Howe explained that there is no points for the defendant's Driver's license in these cases. 4 Code Enforcement Hearings Magistrate Sam Taylor explained to those present that the cases would be taken out of order to accommodate those present. He then administered the oath to those who would be providing testimony in the Code Enforcement hearings. 4.1. 21-479 Owner Name: Birdie Richardson Address of Violation: 663 Lee Avenue Staff presented the case. The Magistrate asked the building official to address the building that is in violation. The main building is fine, it is the single wide trailer See Building Official Structural Determination in the attached documents. Mr. Richardson addressed the magistrate, and stated the matter would be taken care of asap. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance (remove or demolish the trailer) by 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The magistrate agreed with staff recommendation and ordered same. 4.2. 21-812 Owner Name: Lula Belle Westbrooks Address of Violation: 697 Walnut Avenue Staff presented the case. The Magistrate asked the building official to address the building that is in violation, and his recommendations. See Building Official Structural Determination in the attached documents, F. Westbrooks, Lula Belle's son, spoke to the violations. He asked for more time for the violations to be corrected as he lives out of state. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by 10/22/21, a $250 a day fine will be assessed with an annual interest of 6.77%. The magistrate found that the property is in violation, but due to circumstances, gave Mr. Westbrooks 90 days (12/22/21) to comply with the order. 4.3. 21-321 Owner Name: Tiffannie & Lex Morrill Address of Violation: 105 Mercie Lane Staff presented the case. The Magistrate asked the building official to address the building that is in violation. See Building Official Structural Determination in the attached documents. There were no witnesses for the property owner. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The Magistrate agreed with the recommendation and so ordered. 4.4. 21-322 Owner Name: Timothy & Alisca Simpler Address of Violation: 525 Brackin Street Staff presented the case. The Magistrate asked the building official to address the building that is in violation. See Building Official Structural Determination in the attached documents, No witnesses were present for the property owner. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The Magistrate agreed with the recommendation and so ordered. 4.5. 21-741 Owner Name: Justino C Guerra Address of Violation:406 E Griffith Avenue Staff presented the case. The Magistrate asked the building official to address the building that is in violation. See Building Official Structural Determination in the attached documents. No witnesses were present for the property owner. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by obtaining permit to remove unsafe structure and debris removed from property 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The magistrate agreed with staff recommendation and ordered same. 4.6. 21-1314 Owner Name: Annie R & Thomas V Kolmetz. Address of Violation: 620 Shortwell Avenue Staff presented the case. The Magistrate asked the building official to address the building that is in violation. See Building Official Structural Determination in the attached documents .No witnesses were present for the property owner. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The Magistrate agreed with the recommendation and ordered same. 4.7. 21-858 Owner Name: GMAC Mortgage LLC Address of Violation: 653 6th Avenue Staff presented the case. The Magistrate asked the building official to address the building that is in violation. See Building Official Structural Determination in the attached documents. There were no witnesses present for the property owner. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The Magistrate agreed with the recommendation and ordered same. 4.8. 21-862 Owner Name: Denzel Dockery Address of Violation:769 Walnut Avenue W Staff presented the case. This case involves an inoperable vehicle. Some have been removed but not all. There were no witnesses for the property owner. Staff then made the following recommendation. That on or before 10/22/21 the $250 administrative fee be paid and if the property is not brought into compliance by 10/22/21 a $250 a day fine be assessed with an annual interest of 6.77%. The Magistrate agreed with the recommendation and ordered same. The hearing was adjourned at 7:00 pm. 5 Adjournment
