Special Magistrate Hearing
At the public hearing before the Special Magistrate all interested parties may appear and be heard with respect to the
proposed items. Notice is given pursuant to Section 286.0105, Florida Statutes, that in order to appeal any decision made at
these public hearings, you will need a verbatim record of the proceedings. It will be your responsibility to ensure that a
verbatim record is made. In accordance with the Americans with Disabilities Act, any persons with a disability requiring
reasonable accommodations in order to participate in this meeting should call the City Clerk at (850) 6821560 at least 48
hours prior to the public hearing.
1 Call to Order
Special Magistrate Sam Taylor convened the hearing at 5:32 PM in the Council Chambers at City Hall

violation of Crestview Code of Ordinances Chapter 38 ‐ Section 38‐4(4) Excessive Vegetation, Debris, Junk
and Trash Date of notices are in attached documents. No notices have been pickup up or signed for.
Property was posted 10 days before the hearing. (1/7/2021) Was inspected today (1/19/2021) and remains
in non‐compliance.
There has been no response from the owner. Notices have been sent to all addresses listed for Mr.
Youngblood. Staff recommends $250 Fee in to be paid by 2/22/2021. If still in non‐compliance by
3/22/2021 a $250 a day to be assigned with interest. Magistrate Sam Taylor concurred with staff opinion
and assigned fees as recommended.

537 Hathaway street North. The property ;has been posted for a violation of Crestview Code of Ordinances
Chapter 38 ‐ Section 38‐4(4) Excessive Vegetation, Debris, Junk and Trash Date of notices are in attached

Ms Oglesby stated that she received a phone call today from the home owners, stating that they were in
quarantine due to Covid and could not attend the meeting. the Magistrate stated due to this, case number
20‐878 would be continued until the February Magistrate Hearing and all evidence would be presented at
that time

reasonable repairs required to bring the property into compliance and charge the violator
with the reasonable cost of the repairs along with any fines imposed.

before the Special Magistrate. You will have the opportunity to present your side of the
case and present witnesses, as well as question the witnesses against you prior to the
Special Magistrates ruling.

- Maintain a public nuisance prohibited.
The existence of any accumulation of vegetation, debris, rubbish, trash, garbage, garden
trash or junk, as defined in this Chapter, upon any parcel of land, improved or unimproved,
within the city, to the extent that such parcel may threaten or endanger the public health,
safety or welfare or may reasonably cause disease or adversely affect and impair the
economic welfare of adjacent property, is hereby prohibited and declared to be a public
nuisance.
