PtK Eh 101,11 i CLERK Brewster Town Office Building (virtual ) Chair Paul Wallace convened a remote meeting of the Planning Board at 6 : 31 pm with the following members participating remotely : Roberta Barrett , Amanda Bebrin , Charlotte Degen , Madalyn Hillis- Dineen , and Elizabeth Taylor, March Koch did not participate . Also participating remotely : Ryan Bennett , Town Planner and Lynn St. Cyr, Senior Department Assistant, and Kari Hoffmann , Select Board Liaison . This meeting will be conducted by remote participation pursuant to Chapter 20 of the Acts of 2021 . No in- person meeting attendance will be permitted . If the Town is unable to live broadcast this meeting , a record of the proceedings will be provided on the Town website as soon as possible . Wallace declared that a quorum of the Planning Board was present . 6 : 32 PM CITIZEN ' S FORUM Kari Hoffmann thanked Ryan Bennett for all her work on behalf of the town and wished her well as she leaves Brewster. 6 : 35 PM PUBLIC MEETING Approval Not Required Application #2021 = 11 : Applicant/Owner: Carey Anne Loving and John Scott Chace . Representative : John M . O ' Reilly , P . E . , P . L . S . , J . M . O ' Reilly & Associates , Inc . for property located at 0 Waldun Way and shown on Assessor' s Map 52 , Lot 4 in the Residential Medium Density ( R- M ) zoning district. Documents : • 06/ 11 /21 Plan • 08/20/21 Approval Not Required application and supporting documents John M . O ' Reilly , P . E . , P , L . S . , of J . M . O ' Reilly & Associates was present along with the Applicants . O ' Reilly stated that the ANR plan shows the division of one lot into two lots- Lot 7 and Lot 8 . Lot 7 will retain the necessary frontage and lot area for the R4 zoning district. Lot 8 will be conveyed to a parcel on Pine Bluff Road also owned by the Applicants . Degen confirmed with O ' Reilly that no wetlands were present on the property . Motion by Hillis - Dineen to Endorse Approval Not Required Application #2021 -11 . Second by Degen . Vote : 6 -0 -0 . 6 : 39 PM PUBLIC MEETING CONTINUED Continued review and discussion on proposed amendments to the Water Quality Protection District Zoning Bylaw ( Chapter 179 , Article XI ) . • 09/02/21 Water Quality Protection District Bylaw Mark Nelson of Horsley Witten was present. Nelson stated that the goals in editing the Water Quality Protection District (WQPD) Bylaw were to recognize the Stormwater Management Bylaw that the Board has been working on , housekeeping edits to clarify the performance standards for properties within the WQPD recognizing the nitrogen loading calculations that have to be done along with a Board of Health ( BOH ) regulation containing the calculation , and to address build out nitrogen loading within the Pleasant Bay Watershed with changes to the performance standards for businesses and commercial properties within the district by lowering their nitrogen loading concentrations . Nelson suggested the Board pause on the edits related to build out of the Pleasant Bay Watershed until additional public education and outreach can PB Minutes 09/08/21 Page 1 of 3 be done . Changes related to build out addressed in the previous draft of the WQPD bylaw have been removed . Wallace appreciated the removal of the changes related to build out and agreed further education would be helpful . Nelson reviewed proposed changes to the WQPD bylaw with the Board . Nelson directed the Board to Section 179-56A and clarified that projects not requiring a special permit still need to comply with performance standards . Nelson noted the removal of Section 179-56D2C because it will be duplicative of the proposed stormwater management bylaw. Nelson directed the Board to Section 179-57A and noted that the 5 ppm standard would be used for both residential and commercial projects . The BOH regulation will contain information on how to calculate nitrogen loading . Taylor asked if all nitrogen related calculations will be moved to the jurisdiction of the BOH and specifically the fertilizer bylaw. Nelson responded that the fertilizer bylaw does not have specific calculations for nitrogen . It specifies how much fertilizer can be applied on a residential or commercial property . The fertilizer bylaw does not calculate any groundwater concentration and therefore no changes are being made to that bylaw . The fertilizer loading rate included in the WQPD bylaw will be moved to the BOH regulation . Taylor suggested public education on fertilizer use specifically as it relates to lawns . Nelson agreed public education on fertilizer use was needed and thought it could be worked into public education on the nitrogen loading calculations and impacts to the Pleasant Bay Watershed . Degen asked for clarification on the timeframe related to these calculations . Nelson stated that the timeframes would be clarified in the BOH regulation . A standard nitrogen loading calculation includes looking at the total rainfall that falls on a property , total wastewater volume produced , total fertilizer application , and any other sources over a one-year period to determine the average concentration of groundwater impact . The calculation will be clarified in the BOH regulation and applicants will be provided a spreadsheet to complete . Bebrin stated that she would like to see future review and discussion of the offset language related to build out that was removed and feels it could be an interesting discussion with positive impacts . Nelson stated that future discussions on offset fees could provide benefits , but the town needs to establish a good framework with a dedicated fund with parameters . Nelson thought that this discussion could be part of the broader discussion on nitrogen loading and impacts to Pleasant Bay . Motion by Bebrin to Refer the Water Quality Protection District Bylaw Amendments to the Select Board . Second by Taylor. Vote : 6-0 -0 . 6 : 57 PM FOR YOUR INFORMATION Wallace announced the public hearings on the Floodplain District bylaw amendments and Stormwater Management would take place on Wednesday , September 22 , 2021 at 7 : 00 pm . Bennett stated that the public hearing on the amendments to the Water Quality Protection District bylaw is proposed for October 13 , 2021 . 6 : 59 PM PLANNING DISCUSSION Approval of Meeting Minutes : August 25 2021 . The Board reviewed the August 25 , 2021 meeting minutes . Motion by Degen to Approve August 25 , 2021 Meeting Minutes , as amended . Second by Bebrin . Pursuant to § 179 -26D and § 179 -51 of the Brewster zoning bylaw , the Applicant seeks a special permit to construct a single-family dwelling on a pre-existing lot of record lacking street frontage .
