Crestview Fire Department
The Okaloosa County Sheriffs Office and Crestview Fire Department, through their
understanding authorized representatives, hereby agree to the following:
PURPOSE
The purpose of this Memorandum of Agreement is to establish the conditional use of the Okaloosa
Qpty. Florida. Sheriffs Office — Public Safety_ Training Comp, lex located at 650 Chappie
James Street SW, Crestview, Florida by the Crestview Fire Department.
Specifically, this agreement acknowledges the operational protocols regarding the Okaloosa
County,,, Florida. Sheriff's Office — Public Safety Training Complex by the
Crestview Fire Department for training in order to:
A. Provide training of Crestview Fire Department employees authorized to provide
Emergency Medical Services.
For the Crestview Fire Department to use the Okaloosa County Sheriffs Office — Public
Safety Training Complex, the following procedures will be adhered to:
A. Public Safety Training Complex Rules, established by the Okaloosa County, Florida,
Sheriff's Office will be followed. (Attachment #1)
B. Prior to the use of the Okaloosa County Sheriff's Office — Public Safety Training
Complex, the Okaloosa County Sheriff's Office's Training Coordinator or his/her
designee will be contacted in advance and a training schedule will be established to
avoid schedule conflicts.
C. Crestview Fire Department will use their own instructors during the course of any
training.
D. During the use of the Public Safety Training Complex, an Okaloosa County
Department designee must be present to oversee the activities. Okaloosa County
Sheriffs Office Training Staff have authority to ensure that training is occurring in a
safe manner.
E. Crestview Fire Department will provide all required equipment and materials
needed to conduct training, as well as staff for the training with no cost to the
Okaloosa County Sheriff's Office.
F. The Okaloosa County Sheriffs Office Public Safety Training Complex will only be
utilized between the hours of 8:00 a.m. and 9:00 p.m., Monday through Friday.
G. Crestview Fire Department is bound by the current agreement between the Okaloosa
County, Florida, Sheriff's Office and Crestview Fire Department, and any future
agreements pertaining thereto, including any and all modifications executed by the
Okaloosa County Sheriff's Office.
H. Each member of Crestview Fire Department training on property will complete a
Waiver of Liability and Hold Harmless Agreement (Attachment #2) annually prior
using the facility. The document will be provided to the OCSO training staff for
retention purposes.
This agreement contains all terms and conditions fully understood and agreed upon by the parties.
If either party feels the agreement is not being complied with, the signatures of this agreement
accept the responsibility for resolving the disputed issues. This agreement shall be effective upon
signature by all parties listed below. This agreement will remain in effect until either party
terminates by written notification to the other party listed herein.
IN WITNESS THEREOF, the parties hereto have caused this agreement to be executed by their
undersigned officials as duly authorized.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
1) In consideration for utilizing the range facilities at the Okaloosa County Sheriff s Office —
Public Safety Training Complex located at 650 Chappie James Street SW Crestview,
Florida for training purposes and other valuable consideration, the Crestview Fire
Department and their employees do RELEASE, WAIVE, DISCHARGE AND
CONVENANT not to sue the Okaloosa County Sheriffs Office, their officers, agents,
and employees (hereinafter referred to as RELEASEES) from any and all liability, claims,
demands, actions, and causes of action whatsoever arising out of or related to any loss,
damage, injury, including death, that may be sustained by me, my employees or to any
property belonging to me or my employees, WHETHER CAUSED BY THE
NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such training
activity, or while in on or upon the premises where the activity is being conducted.
2) I further hereby agree to INDEMNIFY AND HOLD HARMLESS THE RELEASEES
from any loss, liability, damage or costs, including court costs and attorney's fees, that may
incur due to my or my employees participation in said activity on the premises, WHETHER
CAUSED BY NEGLIGENCE OF RELEASEES or otherwise.
3) I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall
be construed in accordance with the laws of the State of Florida.
4) I understand that any medical costs associated with an injury that the Crestview Fire
Department or their employees sustain are the responsibility of Crestview Fire
Department.
In signing this release, I acknowledge and represent that I have read the foregoing Waiver
of Liability and Hold Harmless Agreement, understand it and sign it.
