The applicant, Rustem Kupi and Mark Vigneault of Kupi and Vigneault Architects as agent for Mr. and Mrs. Scott Morgan, property contract holder, is seeking approval to construct a two -story single family home and accessory improvements on a parcel of property generally described as Lot 11 (less the eastern 13t feet), Block 3, Polo Fields subdivision. The nature of the request requires a recommendation to the Town Commission for a Land Clearing Permit and a Level 3 Architectural /Site Plan Review. No other Board approvals are required. Site History The site is the subject of ARPB File #96 -05, which entails an application for demolition of an existing home on the property and a two -lot subdivision. That application is pending before the Town Commission, but if approved, the proposed home will be constructed on Parcel 2 of the newly created lots. Project Description The applicant proposes to construct a two -story home with five bedrooms and five full - and three half- baths. The total living area is 6,368 square feet and the gross floor area, including the living area, garage and covered patios, is 7,878 square feet. The gross area includes the double- counting of the floor area of a staircase /foyer that is open to the second floor. The property has an Effective Lot Area (dry land area) of 27,990 square feet. Under the Sliding Scale FAR, the maximum permissible floor area is 8,198 square feet, or 320 square feet more than what is proposed. Architectural Review and Planning Board ARPB File #96 -08 July 3, 1996 Page 2 The architectural style of the home is best described as Gulf Stream - Bermuda. Design elements include: a white cement tile roof; decorative chimney caps; exposed rafter tails on the one -story sections and enclosed eaves on the two -story section; yellow stucco walls with corner quoins; casement windows with muntins; pronounced window sills and lintels; louvered shutters; and a covered veranda on the first floor with a second -floor balcony above. Other design features include: french doors in the back, some with arched tops; a slightly recessed front entry with molded door surround and rounded transom; bay windows; and decorative handrail on the second floor balcony. The proposed home has a first floor elevation of +7' -8" NGVD. First floor eave lines are 10' -4" for the house and 12' -4" for the garage, and the second floor eave line is 21' -6 ". The second finished floor level is set at 11' -6, with the exception of the game room which is approximately 2 feet higher to permit a 14' -8" ceiling in the living room below. Roof heights for one -story elements vary from 16' -6" to 19' -6 ", with the second floor peaking at 30' and the chimneys at 35'. All roofs have a 7/12 slope, except the two -story portion which has a flattened peak at the 30' height level. Other proposed improvements to the site include a pool and deck area in the rear. Improvements in the front include entry piers at the street with a circle drive leading to the front door. A service drive then splits from the circle and leads to a a side - facing three -car garage. The applicant proposes to save and /or relocate most of the existing significant vegetation, particularly along the perimeter of the property. Included in the packet are both existing and proposed landscape drawings, and attached to the application form is a list of the plant materials to be relocated or removed. Only a limited amount of fill will be needed to achieve the proposed floor elevation given that the floor level of the existing home is approximately the same as that proposed. As a result, most of the surrounding ground elevations will remain unchanged as well. A combination of swales and French drains will be used to meet stormwater retention requirements, while sanitary sewage requirements will be met by the private Gulf Stream Homeowners Improvement Association system. Land Clearing Permit Chapter 58, Article VI of the Town Code of Ordinances provides criteria for the issuance of a Land Clearing Permit. In general, a Land Clearing Permit is required for both the removal of significant vegetation and the addition of fill. As discussed, little fill will be needed, and most of the significant plant materials are to be saved or relocated. Based on the information submitted by the applicant, staff finds the Architectural Review and Planning Board ARPB File #96 -08 July 3, 1996 Page 3 proposed vegetative relocations/ removals and addition of fill to be consistent with all applicable Land Clearing permitting criteria. Level 3 Architectural /Site Plan Review Chapter 66, Article V.1. of the Zoning Code enumerates the 12 standards applicable to applications for a Level 3 Architectural /Site Plan Review. These standards include consistency with all applicable sections of the Gulf Stream Design Manual. Please note that the standards found in Article VII, Predominate Styles, of the Design Manual also are applicable as the applicant has chosen to use the Gulf Stream - Bermuda style. Although two -story homes are discouraged in the Core zoning district, staff believes the potential negative impacts are mitigated by the use of one -story wings and the location of the two -story portion near the center of the lot. In addition, the lot is nearly twice as large as surrounding lots, which helps to maintain a proper proportion between the mass of the home and the lot, and between the home and surrounding homes. Based on the materials submitted by the applicant, staff finds the project consistent with all applicable standards, including those contained in the Gulf Stream Design Manual, with the conditions that: 1) A minimum 5 foot fence or wall shall be provided to enclose the pool area as per County building requirements; and 2) The driveway material shall conform to the requirements of the Design Manual. Recommendation 1. A motion to recommend approval of a Land Clearing Permit based on a finding that the plans and documents submitted by the applicant, as proposed, meet all applicable permitting criteria. 2. A motion to recommend approval of a Level 3 Architectural /Site Plan Review based on the plans and documents submitted by the applicant and a finding that the following conditions are necessary for the proposed improvements to be consistent with the applicable review criteria: a.
