Forest Hill Blvd Address: 555 Pelican Ln Wellington, Florida 33414 Gulf Stream, FL 33483 Page 1 of 3 The undersigned grantor, together with his successors and assigns, in consideration of the payment of $1.00 and the further consideration that Grantor shall have the right to review and comment upon the proposed appearance of each new above ground installation prior to the installation thereof, the adequacy and receipt of which is hereby acknowledged, does grant and give to the Town of Gulf Stream, a Florida municipal corporation, whose address is 100 Sea Road, Gulf Stream, Florida 33483, hereafter referred to within this document as the Reserved for Circuit Court Grantee, together with their agents, successors, and assigns, a non-exclusive easement forever for the construction, operation and maintenance of street lighting facilities as set forth in attached Exhibit “B” or otherwise consistent in wattage and design with those elsewhere in the Town of Gulf Stream, Florida, and underground electric distribution facilities, and underground communications utility facilities (including street lighting poles and fixtures, underground wire and cables, conduits, pad-mounted cabinets and transformers, and appurtenant above ground equipment) to be installed from time to time; with the right to relocate, reconstruct, improve, add to, enlarge, change the voltage as well as the size of, and remove such facilities or any of them within an easement being more particularly described as follows: See Attached EXHIBIT “A” (“Easement Area”) Together with the right of ingress and egress to the Easement Area at all times; the right to clear the Easement Area and keep it cleared of all obstructions, trees and undergrowth with trunks or stems growing within the Easement Area where such obstructions adversely impact Grantee’s ability to enjoy the rights granted herein; and further grants the right of ingress and egress at all times, as required for the construction, maintenance, inspection, or operation of grantee's facilities; and the right to assign to Florida Power & Light Company whose address is 700 Universe Boulevard, Juno Beach, Florida; and/or Comcast Communications whose address is 10435 Ironwood Road, Palm Beach Gardens, Florida; and/or AT&T Southeast whose address is 3535 Colonnade Parkway, Birmingham, Alabama; their licensees, agents, successors and assigns, all rights granted herein; and the right to record such assignments in the public records of Palm Beach County, Florida; except that no assignee shall have the rightto assign its right except to a bona fide successor or subsidiary for the sole purpose of providing underground electrical or communications utility service.
