SELLER'S AFFIDAVIT
STATE OF FLORIDA
COUNTY OF OKALOOSA
The undersigned Jacob Dorman Wingard, Jr., being first duly sworn, on oath deposes and states as follows:
1. I am over the age of 18 and have personal knowledge of the matters set forth herein.
2. I am the sole member of Crestview Investment Company, LLC, (the "Company") which owns the
real property described in Exhibit A hereto (the "Property").
3. The Company has separately authorized the transaction with the City of Crestview, Florida whereby
the Company will convey the Property as set forth in the contract between the Company and the City.
4. Title to the Property has never been disputed to my personal knowledge, nor do I know of any facts
by reason of which the title to, or possession of, the Property might be disputed or by reason of which any claim to
Property might be asserted adversely to me.
5. To my personal knowledge no party is in possession of all or any portion of the Property under any
unrecorded leases, tenancy at will or otherwise.
6. The Company has not during its ownership of the Property conveyed any portion of the Property nor
done any act or allowed any act to be done which has changed or could change the boundaries of the premises,
except as set forth in the warranty deed approved by the parties in the Transaction, and except for the conveyance of
a portion of the property for roadway purposes (Redstone extension).
7. The Company has not allowed any encroachments on the Property by any adjoining landowners nor
have I encroached upon any property of adjoining landowners.
8. The Company has not allowed any easements, rights of way, continuous driveway usage, drain,
sewer, water, gas or oil pipeline or other rights or passage to others over the Property and have no knowledge of
such adverse rights.
9. There has not been any construction, erection, alteration or repairs of any structures or
improvements on the Property, or materials delivered to the Property, within the last six months for which any
charges or costs remain unpaid.
10. I do not have knowledge of any highways, abandoned roads, lanes, cemetery or family burial
grounds, springs, streams, rivers, ponds, or lakes bordering or running through the Property.
11. I do not have knowledge of any due taxes; special assessment liens, fines, penalties or other liens
affecting the Property.
12. The Company has not allowed and I do not know of any violation of any covenants, restrictions,
agreements, conditions or zoning ordinances affecting the Property.
13. There are no pending lawsuits, proceedings, judgments, bankruptcies, liens or executions against me
or the Company which would give rise to any claim against the Pr erty.

office address is Post Office Box 171, Crestview, Florida 32536 ("Grantor"), to the City of
Crestview, Florida, a municipal corporation, whose address is 198 Wilson Street North,
Crestview, Florida 32536 ("Grantee"):
(Whenever used herein the term "Grantor" and "Grantee" include all the parties to this
instrument and the heirs, legal representatives and assigns of individuals, and the
successors and assigns of corporations, trusts and trustees)
Witnesseth, that the Grantor, for and in consideration of the sum of Ten Dollars,
($10.00) and other valuable considerations, receipt whereof is hereby acknowledged, hereby
grants, bargains, sells, aliens, remises, releases, conveys and confirms unto the Grantee,
