I recall the situation very well. I am rarely on the north side of town, but I had my cousin in my passenger seat, who was visiting from Thomasville, GA, and when you have a guest from out of town, it would be a sin to not introduce them to some of the best donuts around! I live on the very south side of Crestview, and work at Eglin AFB, so I do not need to travel to north Crestview unless it is a special occasion such as this. As I approached the light, and saw it turn yellow, a few things passed through my head: 1) Are there any cars waiting at the intersection to the left or the right? No. 2) Can I stop in time? Probably, but not without stressing my brakes. It is an old 2007 Jeep Grand Cherokee that I purchased in 2016.1 have since added over 100,000 miles on it, breaking the 250,000 milestone, and have never changed the brakes in it. 3) How long will the light remain yellow? I am not sure. 1 do not come to this side of town often. But I know the south side has long yellow timers, so they could be the same for this part of town. After assessing the situation, I decided the safest option for me and my passenger was to pass through the intersection. I sped up to do so, just in case it was a shorter timer, which it turned out to be. As I neared the intersection, the yellow light turned red just a fraction of a second before I passed through it. I was speeding at more than 5 mph over the legal limit of 35 posted in order to try to clear the intersection with no safety issues. There were no cars or pedestrians in front of me, and I was able to reduce my speed immediately after clearing the intersection. If there is traffic video saved for all lights this far back, this reduced speed can be confirmed at the next traffic light video feed. I understand very clearly why these traffic laws exist. The intent is to protect those transiting via public roads, so everyone can arrive at their destination safely, and at a reasonable time. The balance between speed and safety is critical to reducing accidents. Since having 3 children, I have been much keener on following the traffic laws, but specifically the intent of the traffic laws. While I will not deny that my vehicle ran the red light on 30 April, 2022, !would like to focus on the intent of this law being enforced. I used my best judgement to decide what the right action to take in that specific situation was. I acted clearly and concisely, and the result was a safe return home for donuts with my family. By taking thisroute, lend -angered no one, while reducing stress on my vehicle, which could reduce the risk of an accident in the future due to a mechanical failure. I value the work of the Crestview Police Department, and I am glad to see your team enforcing laws to help facilitate a safe city for my family. I hope that after reading this letter, we can agree that for this specific situation, a citation is not necessary. DP cases are appealed to the District Court, however there are no fees assessed. e) At the conclusion of the hearing, the local hearing officer shall determine whether a violation under this section has occurred, in which case the hearing officer shall uphold or dismiss the violation.
