officer acting within the scope of his duties.
❑ The driver of the vehicle during the alleged violation passed through the intersection when the light was red received a Uniform Traffic
Citation for the same conduct issued by a police officer. I have attached a copy of the Uniform Traffic Citation to this Affidavit.
❑ The vehicle's owner was deceased on or before the date of the violation. You must submit (I) a bill of sale or other document showing
that the vehicle was sold after the death but before the violations, al) proof that the license plate was returned after death but

To whom it may concern,
On Saturday, 30 April, at approximately 0730, I was driving home from picking up donuts from Good
Things Donuts in Crestview, FL. I recall the situation very well. I am rarely on the north side of town, but I
had my cousin in my passenger seat, who was visiting from Thomasville, GA, and when you have a guest
from out of town, it would be a sin to not introduce them to some of the best donuts around! I live on
the very south side of Crestview, and work at Eglin AFB, so I do not need to travel to north Crestview
unless it is a special occasion such as this.
As I approached the light, and saw it turn yellow, a few things passed through my head:
1) Are there any cars waiting at the intersection to the left or the right? No.
2) Can I stop in time? Probably, but not without stressing my brakes. It is an old 2007 Jeep Grand
Cherokee that I purchased in 2016.1 have since added over 100,000 miles on it, breaking the
250,000 milestone, and have never changed the brakes in it.
3) How long will the light remain yellow? I am not sure. 1 do not come to this side of town often.
But I know the south side has long yellow timers, so they could be the same for this part of
town.
After assessing the situation, I decided the safest option for me and my passenger was to pass through
the intersection. I sped up to do so, just in case it was a shorter timer, which it turned out to be. As I
neared the intersection, the yellow light turned red just a fraction of a second before I passed through it.
I was speeding at more than 5 mph over the legal limit of 35 posted in order to try to clear the
intersection with no safety issues. There were no cars or pedestrians in front of me, and I was able to
reduce my speed immediately after clearing the intersection. If there is traffic video saved for all lights
this far back, this reduced speed can be confirmed at the next traffic light video feed.
I understand very clearly why these traffic laws exist. The intent is to protect those transiting via public
roads, so everyone can arrive at their destination safely, and at a reasonable time. The balance between
speed and safety is critical to reducing accidents. Since having 3 children, I have been much keener on
following the traffic laws, but specifically the intent of the traffic laws.
While I will not deny that my vehicle ran the red light on 30 April, 2022, !would like to focus on the
intent of this law being enforced. I used my best judgement to decide what the right action to take in
that specific situation was. I acted clearly and concisely, and the result was a safe return home for
donuts with my family. By taking thisroute, lend -angered no one, while reducing stress on my vehicle,
which could reduce the risk of an accident in the future due to a mechanical failure.
I value the work of the Crestview Police Department, and I am glad to see your team enforcing laws to
help facilitate a safe city for my family. I hope that after reading this letter, we can agree that for this
specific situation, a citation is not necessary.

HOW DOES THE RED LIGHT SYSTEM WORK?
The red light photo enforcement system measures your speed as
you approach the signal. If your speed indicates that you are
unlikely to stop before the signal changes to red, it captures a
digital photog►aph of your vehicle behind the stop bar: If you then
travel past the stop bar while the signal is red, it captures a se-
cond photograph of your vehicle in the intersection and extracts
the image of your license plate. The system also captures a mo-
tion video of the event which you can review online. A Crestview
police officer reviews every single violation.

How much does it cost to file an appeal?
How do 1 file an appeal?
To file an appeal on a County Court Case (SC, CC, TR, MM & CT) the filing fee is $281.00.
To file from Circuit to the District Court (CA, DR, CF & CJ) the filing fee is $100.00 (certified
funds, no personal checks) to the Okaloosa County Clerk of Court and $300.00 (personal
checks accepted) to the district court, which may be submitted directly to the district court at:

The clerk's office does not have paperwork available for appeals - you may research Florida
Rules of Appellate procedure.
DP cases are appealed to the District Court, however there are no fees assessed.
e) At the conclusion of the hearing, the local hearing officer shall determine whether a violation
under this section has occurred, in which case the hearing officer shall uphold or dismiss the
violation. The local hearing officer shall issue a final administrative order including the
determination and, if the notice of violation is upheld, require the petitioner to pay the penalty
previously assessed under paragraph (1)(b), and may also require the petitioner to pay county
or municipal costs, not to exceed $250. The final administrative order shall be mailed to the
petitioner by first-class mail.
(f) An aggrieved party may appeal a final administrative order consistent with the process
provided under s. 162.11.
162.11 Appeals. —An aggrieved party, including the local governing body, may appeal a final
administrative order of an enforcement board to the circuit court. Such an appeal shall not be a
hearing de novo but shall be limited to appellate review of the record created before the enforcement
board. An appeal shall be filed within 30 days of the execution of the order to be appealed.
