BOARD . OF . PUBLIC WORKS .& SAFETY OF THE
CITY OF RI'CHMOND, INDIANA, APRIL 15, 1971
The Board of Public Works & Safety of the City of Richmond,
Indiana, met in special session April 15 , 1971 , at the hour
of 11 : 00 a .m. Mr . Cecere presided with Mr . Howell and Mr .
Benner present. The following business was had to-wit :
Mr . Cecere announced that the hearing is being continued from
the previous day . Officer Tevis and Counsel were present .
Mr . Cecere said that the Board had deliberated for several
hours . He appreciated everyone' s attitude and conduct through-
out the hearing .
Mr . Cecere said there was no question that on two accounts
Officer Tevis refused a direct order by a superior officer .
He refuted analogies made to the Calley case, because there was
no suggestion of anything immoral i:n the orders given. Mr .
Cecere felt that the justification that it was necessary to
disobey orders in order to gain attention was wrong, because
a police officer cannot make a decision to refuse to obey an
order without jeopardizing the integrity of the Board and the
City . The Chief of Police and the Board of Works _are available -
to correct situations .
Mr . Cecere said the Board considered Officer Tevis ' s record and
testimony of his fellow officers , all indicate that he is a good
officer with outstanding potential and a desire to fulfill his
obligation to the Department .
Mr . Cecere announced the Board found Officer Tevis -guilty on
two counts of disobedience and no other charges . The sentence
. is to be suspension for seven days , from this time until April
22, 1971 .
There being no further business on motion duly made, seconded and
passed, the meeting was adjourned.
