HomeMy Public PortalAbout22-051- Exchange of property owned by VSquared Investments LLCSponsored by: City Manager RESOLUTION NO. 22-051 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE EXCHANGE OF THE PROPERTY IDENTIFIED BY FOLIO 08-2122-007-0270, AND OWNED BY THE CITY WITH PROPERTY IDENTIFIED BY FOLIO 08-2122-000-0031, AND OWNED BY VSQUARED INVESTMENTS, LLC. AND TAKE ALL OTHER NECESSARY ACTIONS TO EFFECTUATE THE INTENT OF THIS RESOLUTION; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Property Owner, Vsquared Investments, LLC of the parcel identified by folio 08-2122-000-0031 and located at NW 143rd Street and NW 22nd Avenue ("subject property"), intended to build a single-family home on this site. However, the site is zoned for multi -family residential and is not large enough for multifamily development. Consequently, the property owner is now requesting to exchange his property (folio 08-2122-000-0031) for a nearby City -Owned parcel, identified by folio 08- 2122-007-0270, to accommodate single-family home development; and WHEREAS, the property owned by Vsquared Investments, LLC is a Six Thousand Two Hundred Fifty (6,250) square foot parcel and is adjacent to City -owned properties to the north and west; and WHEREAS, on April 22, 2009, pursuant to Resolution No. 09-7458, the City declared folio 08-2122-007-0270 a surplus property and authorized the City Manager to execute an agreement for the transfer. According to City staff, the transfer conditions were never completed and the City is still the owner of property stated in said resolution pursuant to Miami -Dade County property appraiser and relevant City supporting documents; and WHEREAS, the City Commission finds that it is in the best interest of the City and its residents to exchange/ swap the property identified by folio 08-2122-007-0270, and owned by the City with the property identified by folio 08-2122-000-0031, and owned by VSQUARED INVESTMENTS, LLC. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Resolution No. 22-051 Section 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The City Commission of the City of Opa-Locka hereby authorizes the exchange/ swap of the property identified by folio 08-2122-007-0270, and owned by the City for the property identified by folio 08-2122-000-003, owned by VSQUARED INVESTMENTS, LLC. and further authorizes the Interim City Manager to take all other necessary actions to effectuate the intent of this Resolution. Section 3. SCRIVENER'S ERRORS Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager following review by the City Attorney and without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 4. EFFECTIVE DATE This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. PASSED and ADOPTED this 5th day of October, 2022. Staff Summary: The Planning and Community Development [PCD] staff received an unsolicited offer for City owned property that is located at 14270 NW 22nd Place. The City administration is interested in acquiring the property east of Segal which is owned by the person making the unsolicited offer for the City owned property. PCD staff recommended a property swap of the property east of Segal Park for the City Owned property at 14270 NW 22nd Place or it is recommended that the City would purchase the property that is east of Segal Park. This City owned property was recommended for the surplus list per resolution 09-7458 for the construction of a single- family house. Since that time, this property has been used as supplemental parking for the Helen Miller Center at Segal Park. This offer is from My Quick Home Buyers located in Davie, Florida. Their price for the property east of Segal Park is $100,000.00. They would like to acquire the City owned property which is valued at $80,000.00 per Miami -Dade County Property Appraisal Office. The City Manager recommends moving forward with the land swap or purchase the property east of Segal Park. These acquisitions will accomplish several things: • The purchase or swap of the City property on 14270 NW 22 Place will allow the development of this property as a Single-family home for homeowners and contributor to the City's tax base. This addresses our goal as part of the Affordable Housing Initiative • The purchase or swap of the property east of Segal Park will provide access to the 1.6 ac City owned property for development to be determined. • If the land swap is not considered, the owner of the property east of the Segal Park is willing to sell the property for $100K, which is $16/sf • The City property on 14270 NW 22 Place provide 10 parking spaces as overflow parking for the Helen Miller Center. • The property east of Segal Park will provide 12-15 interim parking spaces along the northside of NW 143rd Street contiguous to Segal Park and the Helen Miller Center until the future development is determined. • The City will be looking to add 10 parking space within Segal Park site as part of the Opa-locka Parks Master Plan. BACKGROUND In February 2018, Mr. Ivo Vassilev approached the City of Opa-locka on behalf of his client who is interested in selling a land parcel on NW 143 St and NW 22 Ct - folio 08-2122-000-0031. This 6250sf parcel is adjacent to city owned properties to the north and west. Mr. Vassilev wanted to see if the City of Opa- locka would have any interest in purchasing the property from his client. While this area is not located within the Opa-locka CRA, it may be considering an area for future expansion. The initial asking price is $49K. The property was previously acquired by tax certificate in July 2015. There are City liens on this property - $1888.64 as of June 2018 along with outstanding tax certificates. There are two additional properties totaling 9975sf which are adjacent [east] to this property which are not for sale at this time, but the agent believes the owners may be interested in selling as well as these three properties are surrounded by City owned properties [Segal Park to the west and City owned property to the north and east]. Financial Impact If the property exchange is approved the new property owner has indicated that a single-family home will be developed on this site which will generate an increase in property taxes. The current property owner, Vsquared Investments, LLC must satisfy all outstanding tax certificates on the property (identified by folio 08-2122-000-0031) as a condition of the land exchange approval. The City will address the current City Liens on this parcel as this parcel will secure street frontage for the City -owned property adjacent to the north and east of Segal Park. This is an unbudgeted acquisition which will be addressed in the first budget amendment for FY 23 and will be funded through utilization of General Fund Available Fund Balance. The City's interest in acquiring this property would be to own all the property between Segal Park and the City owned properties [former Christian Memorial Hospital site] at 14310-14322 NW 22 Avenue for future expansion of Segal Park [see attachment C] with more recreational amenities, proposed performing art center/gymnasium and overflow parking, or for future multifamily residential/mixed use development opportunities [see attachment D]. There have been several emails over the last couple of months between Mr. Vassilev and PCD staff. If the City of Opa-locka is interested in acquiring this property, we need to discuss and determine the method for the City to move forward on this acquisition. Since our first communication with Mr. Vassilev, he has informed staff that the property owner has dropped the price on their lot from $49K to $39K and now $34K. We need to respond to them before the property is sold to another speculator and the City has to begin again to resolve this situation. The property's orientation makes it difficult to develop under the present zoning setback requirements. It would make sense that the property be acquired by the City of Opa-locka and merged with the City owned properties to the west and north of this property. In June 2018, PCD Staff recommended to the City Manager that the City should counter their offer at $12.5K and/or consider a land swap/trade for another City owned properties. I've informed the agent of the City's financial challenges and inability to purchase the property. Seems the agent's client has come back to consider the land swap option, however he did not state which city owned property his client wishes to swap for. This is a key acquisition that needs to be address immediately. As for the two adjacent properties to the east, because this potential acquisition would further land -lock this property owner, they could either follow suit and sell to the City or continue to be a holdout! PCD staff believe that the acquisition of Mr. Vassilev property would place the City in a better position to acquire the other two properties.
