ORDINANCE NO. 2022-16
AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF OPA- LOCKA, FLORIDA, ADOPTING A
FINAL MILLAGE RATE PURSUANT TO SECTION
200.065, FLORIDA STATUTES, FOR FISCAL YEAR
2022-2023, COMMENCING OCTOBER 1, 2022
THROUGH SEPTEMBER 30, 2023; SETTING FORTH
PUBLIC HEARING DATES; PROVIDING FOR
ADOPTION OF REPRESENTATIONS; PROVIDING
FOR REPEAL OF ALL PRIOR ORDINANCES IN
CONFLICT; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on July 27, 2022, the City Commission of the City of Opa-Locka,
Florida ("City Commission") adopted Resolution No. 22-013, setting the tentative millage
rate of 9.350 mills, after further review of the budget desires to set the final millage rate
of 9.350 mills for Fiscal Year 2022-2023, commencing October 1, 2022 and ending
September 30, 2023, and scheduled public hearings on September 14, 2022 and October 5,
2022; and
WHEREAS, in order to ensure broad notice and allow for public input, public
hearings were noticed and set for September 14, 2022 and October 5, 2022; and
WHEREAS, the Miami -Dade County Property Appraiser has determined the non-
exempt net aggregate value of taxable property (real, personal, and centrally assessed
properties), in the City of Opa-Locka for the Fiscal Year 2022-
2023 to be $1,551,388,190; and

WHEREAS, public hearings on September 14, 2022 and October 5, 2022, allowed
for public comment on and consideration by the City Commission of the proposed millage
rate; and
WHEREAS, the public and all interested parties have the opportunity to address
their comments to the City Commission regarding the millage rate; and
WHEREAS, having considered the comments of the public regarding the
millage rate, the City Commission of the City of Opa-Locka desires to adopt a final
millage rate for Fiscal Year 2022-2023.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA, AS FOLLOWS:
Section 1. Adoption of Representations.
The foregoing "Whereas" clauses are hereby ratified and confirmed as being
true and the same are hereby made a specific part of this Ordinance.
Section 2. Adoption of Millage Rate.
The City Commission of the City of Opa-Locka hereby adopts and establishes
the millage rate of the City of Opa-Locka for Fiscal Year 2022-2023, commencing
October 1, 2022 through September 30, 2023, at 9.3500 mills, which is $9.35 per $1,000
of assessed property value within the City of Opa-Locka. This represents an 8.80%
increase above the rolled -back rate of 8.5939 mills, which is $8. 5939 per $1,000 of assessed
property value within the City of Opa-Locka.
Section 3. Public Hearings.
Public hearings are to be held by the Commission on September 14, 2022 at 5:01
Ordinance No. 2022-16
p.m. and October 5, 2022 at 6:30 p.m.
Section 4. Transmittal.
The City Clerk of the City of Opa-Locka is hereby directed to transmit a certified
copy of this Ordinance to the Miami -Dade County Property Appraiser and the Tax
Collector of Miami -Dade County.
Section 5. Inclusion in Code.
It is hereby the intention of the Commission of the City of Opa-Locka and it is
hereby provided that the provisions of this Ordinance may become and be made a part
of the Code of Opa-Locka, Florida.
Section 6. Scrivener's Errors.
Sections of this Ordinance may be renumbered or re -lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected or re -codified copy of same with the City Clerk.
Section 7. Conflict and Repealer.
Any provision of any City of Opa-Locka ordinance or regulation which is in
conflict with the provisions of this Ordinance is repealed prospectively to the extent of
such conflict.
Section 8. Liberal Construction.
The terms and provisions of this Ordinance shall be liberally construed to affect
the purpose for which it is adopted.

Section 9. Severability.
If any portion of this Ordinance is for any reason held or declared to be
unconstitutional, invalid or void, such holding shall not affect the remaining portions
of this Ordinance. If this Ordinance shall be held to be inapplicable to any person,
property or circumstances, such holding shall not affect the applicability of this
Ordinance to any other person, property or circumstances.
Section 10. Effective Date.
This Ordinance shall take effect upon the adoption of this Ordinance by the
Commission of the City of Opa-Locka and upon a filing of a certified copy hereof with
the Florida Department of State and is subject to the approval of the Governor or
Governor's Designee.

FY 23 Tentative Millage Rate Adoption
Staff Summary:
On July 27, 2022, the City Commission adopted Resolution 22-013 which set a FY 23 Proposed Millage Rate of 9.3500
mills which supported the FY 23 Proposed City Budget. On July 31' the City submitted the City's proposed FY 23
budget to the State for review and approval.
Staff is proposing a Tentative Millage Rate of 9.3500 mills. This millage rate is 8.80% higher than the City's rolled -
back rate of 8.5939 mills and is sufficient to meet the objectives of the FY 23 Tentative Budget.
Proposed Action:
Staff recommends that the City Commission adopt the tentative millage rate of 9.3500 mills on first reading.

FY 23 Tentative General, Proprietary and Special Revenue Funds Budget Adoption
Staff Summary:
On July 19, 2022 Staff provided a detailed review of the FY 23 Proposed City Budget and followed up with a further
review of the FY 23 Proposed City Budget on July 27, 2022. At that time Staff recommended the City Commission
tentatively approve the FY 23 Proposed City Budget to allow the budget to be forwarded to the State by August 1st
2022 for review and approval as required by the Agreement of Cooperation established in accordance with
Executive Order 16-135 in response to the City's declaration of a financial emergency. The Commission adopted the
FY 23 Proposed City Budget for forwarding to the State with Resolution 22-012 and the FY 23 Proposed City Budget
was forwarded to the State on July 31St, 2022.
Proposed Action:
Staff recommends the City Commission adopt the FY 23 Tentative City Budget at this first hearing.
