Furthermore, as a condition of use of the Easement Area, Grantee shall be responsible for the restoration of any Grantor’s landscape and/or hardscape damaged or removed as a result of Grantee’s enjoyment of the rights provided herein; and all such landscape and/or hardscape restoration, replacement, or repair shall be of equal or better quality than that which existed prior to Grantee’s actions; and Grantee shall indemnify, defend and hold harmless Grantor from and against any and all loss, costs, expenses (including reasonable attorneys’ fees and expenses), claims, damages and liabilities related to, or associated with Grantee’s enjoyment of the rights provided herein.
