Good talking to you today. Attached is my rough easement draft calling for a 5 foot wide easement along the
north and east boundary of the 20 foot road and utility easement as shown on the plat. Please provide your

The undersigned, in consideration of the payment of $1.00 and other good and
valuable consideration, the adequacy and receipt of which is hereby
acknowledged, grant and give to Florida Power & Light Company whose
address is 700 Universe Boulevard, Juno Beach, Florida; and AT&T Southeast
whose address is 3535 Colonnade Parkway, Birmingham, Alabama, hereafter
referred to within this document as the Grantee, together with their agents,
successors, and assigns, a non-exclusive easement forever for the construction,

operation and maintenance of Florida Power & Light Company underground
electric distribution utility facilities, and AT&T Southeast underground
communications utility facilities, including below grade underground wire, cables, connectors, and conduits; with the right of
ingress and egress to the Easement Area at all times, and the right to repair, maintain, operate, remove such facilities or any
part of them from time to time, within an Easement Area being more particularly described as follows:
EASEMENT AREA:
The north five (5) feet, being measured perpendicular to the north property line, and the east five (5)
feet, being measured perpendicular to the east Road Easement boundary line, of that portion of the described “20 foot Private
Road and Utility Easement” lying within Lot 5 of Hidden Harbour Estates, a subdivision as recorder in Plat Book 36, Page 110,
of the Public Records of Palm Beach County, Florida.
Furthermore, as a condition of use of the Easement Area, Grantee shall be responsible for the restoration of any Grantor’s landscape
and/or hardscape damaged or removed as a result of Grantee’s enjoyment of the rights provided herein; and all such landscape and/or
hardscape restoration, replacement, or repair shall be of equal or better quality than that which existed prior to Grantee’s actions; and
Grantee shall indemnify, defend and hold harmless Grantor from and against any and all loss, costs, expenses (including reasonable
attorneys’ fees and expenses), claims, damages and liabilities related to, or associated with Grantee’s enjoyment of the rights provided
herein.
