Bermuda style residence under construction (ARPB #99 -7), to the north is a two -story "other /various style" home. Key Issues Considered During Review: 1. Addition of fill in manmade cove; easement needed 2. Variance Request, eight Findings of Fact 3. Concerns of near -by resident regarding similarities in homes along Wright way (Urban Design Studio has reviewed the application) 4. Windows over garage Recommendations (Four Motions): A. A motion to approve a Special Exception to reduce the rear setback from 50' to 42'8 "' for a one -story portion of the home, based on a finding that the design meets the applicable review standards. B. A motion to recommend approval of a Special Exception to exceed the permitted floor area by 160 feet for unenclosed porch area, based on a finding that the design meets the applicable review standards, subject to correcting the FAR calculations on the plans *. C. A motion to approve the south side setback variance of 1'8 "based on a finding that the request meets the variance review standards. D. A motion to approve a Level III Architectural Site Plan Review, based on a finding that the proposed plans are consistent with applicable review standards, based on the following conditions: 1. Approval from the Army Corp of Engineers shall be required prior to any fill being added to the existing cove area on the southwest portion of the site. This shall be secured prior to the issuance of a building permit. 2. The property owner shall dedicate two easements to the Town prior to building permit application: a 10 -foot easement along the south property line for drainage purposes, and if needed, an easement along the west property line for annual maintenance of a planned outfall. The property owner shall coordinate the seawall construction and home construction with the Towns replacement of the drainage pipe on the property. The property owner shall be responsible for all costs associated with the seawall. 3. Drainage Plans, prepared by a professional engineer, shall be submitted prior to building permit. Any replacement driveway shall be designed to include a swale, to prevent the n n run -off of drainage onto the road and to facilitate the free flow of drainage across the front of the property 4. The Construction Traffic Management Plan submitted with the application shall be followed during construction. 5. This approval is based on the plans submitted on October 12, 2000. The plans shall be redesigned to incorporate the recommendations in the staff report [see below] and Urban Design Studio report [attached] and shall be resubmitted to the ARPB far approval prior to application for building permit. Basis for Recommendation: Site Plan Review A 2,795 square foot, one -story Gulf Stream Bermuda style residence exists on the property. In 1999, the owner received approval for a second story addition (ARPB #99 -08). The owner has now decided to replace the home with a new two -story residence. The design has several features that do not appear to be consistent with the Bermuda Style, including windows with "Bahamas" shutters over the garage doors and master bath window. Also, the first and second story eave heights are in the discouraged range. Staff has recommended conditions to address these items. In order to make the design more consistent with the Design Manual and Bermuda style, staff recommends that the plans be revised prior to permit application, as follows: ❑ Lower the one -story eave height to 11'6", and the second -story eave height to 24' ❑ Add additional muntins to the windows, to create smaller panes. ❑ Remove the windows and Bahamas shutters over the garage doors and master bath window. ❑ Revise window design and placement to be more uniform. ❑ Break front picture window into two rectangular windows. ❑ Revise rounded windows to a more traditional fanlight design. ❑ Revise front door way to a Bermuda style, for example a rectangular door with a fanlight above and sidelights. ❑ Remove shutters from garage doors. In order to better distinguish this structure from the other two -story homes on the street, prior to building permit application it is recommended that the owner consider: ❑ Adding a balcony across the full second story at the front of the house, and ❑ Using a different railing design (Bermuda- compatible); one not used on the other homes on the street. ❑ Revising plans to incorporate additional suggestions made in the attached UDS report. Special Exceptions The design appears to meet the review standards for both of the requested Special Exceptions. Site Reconfiguration / Fill The applicant proposes to fill in an existing manmade cove and to extend the seawall to a point even with the seawall constructed along the property to the south, then angled to meet the seawall to the north. Staff recommends a condition.( #1) that requires Army Corp of Engineers' approval prior to submitting for a building permit. The Town currently has a drainage pipe along the southern portion of this lot. The filling -in of the boat slip will disrupt the drainage in the area. Accordingly, the Town has requested easements that will enable us the remedy this situation. The applicant has agreed to voluntarily donate the easement under specific terms. (Condition #2 addresses this) Variance for South Side Setback Each side setback is proposed at 15 feet. Because the lot is 106 feet wide, the two side setbacks must total 31.8 feet (30% of lot width). The applicant has supplied information on how they believe the request meets the eight mandatory variance findings (included in package on the application form). The ARPB should review these carefully. Although the applicant has not provided a strong hardship argument, the variance is for 1.8 feet and could be considered "de minimus" (insignificant). At this time, the adjacent property to the south is also owned by Delray Ocean Estates. ARPB # 000 -13, page 2 n n Concerns Regarding Similarities and Scale Due to near -by residents' concerns, the plans were sent to our design consultant, Urban Design Studios (UDS). Code Requirements that must be met prior to issuance of a Building Permit: 1. Unless the home is connected to the private Sewer System, Health Department approval of the septic system will be required prior to issuance of a building permit. 2. The proposed finished floor elevation (8' NGVD) for the home shall be labeled on the plans for the building permit application. 3. Correct the FAR calculations shown on the plans to show the additional 160 S.F. 4. The required mechanical equipment setback is 12; equipment must be screened. Updated 6/2/99 TOWN OF GULF STREAM, FLORIDA Construction - Damage Prevention Policy The following policy is established to assist in protecting residential lawns from damage caused by construction vehicles. • V As an exception to the Town's Right -of -Way Policy, Town residents who own property In the vicinity of an active construction site will be permitted to install white (or painted dark green) capped PVC pipes, 36" above grade along the front of their property, 2' from road's edge. These pipes should be approximately 9' apart. The maximum pipe size shall be 2" in diameter. The pipes shall be removed immediately following the issuance of Certificate of Occupancy for the construction site. As part of the site plan review process the project architect shall submit a "construction traffic management plan" to be followed by the contractor. This would be required as part of the application submittal and will be made a condition of approval. ISSUE #2 Review the .similarities in building form and / eatures between the esisling residence at 570 Wright Way, the residence under construction at 590 Wright Wav, and the proposed subject residence at 600 Wright Way. Urban Design Studio reviewed the floor plans, elevations, landscape plans, and existing conditions and found the proposed residence at 600 Wright Way to he adequately different from the residences at 570 and 590 Wright Way. Some design measures should be taken to ensure the uniqueness of each residence. • Balcony could be extended across second floor elevation to enhance the horizontal break up created by the first story roof. • Balcony rails should he different from the existing pattern on 590 Wright Way. • Building principle color should he different from both 570 and 590 Wright Way. The proposed beige with green shutters is acceptable. The entry feature should be significantly different from the neighbors as well as consistent with the character of the Gulf Stream Bermuda Style. • A rectilinear form should replace the arched doorway. • Use of side lights is encouraged. • llse of panel shutters is encouraged. • Keystone pediment to relate to window treatment is encouraged. • The use of a more traditional light fixture is encouraged. A significant difference exists in the horizontal delineation by the first story roof on the proposed residence at 600 Wright Way. In addition, the garage arrangement offers a different approach. It is our recommendation that with some modifications to the windows and entry treatments, lowering the tie beam height and removing the small windows with hurricane shutters, this house will conform to the character issues identified in the Manual and be unique in its own right. Commissioner Orthwein moved and Commissioner Lynch seconded that the SPECIAL EXCEPTION be approved subjected to the following conditions: 1) The walkover shall be constructed to minimize its height, bulk and visual impact as much as possible. In order to accomplish this: (a) No cross members will be used (internal braces are acceptable) (b) No treads will be placed on the level top of the seawall. (c) Stair height shall not exceed 13" above grade. (d) Railing height not to exceed 3611 above grade. (e) A single rail will be placed on the south side only. New flood (F.I.R.M.) maps proposed Mrs. Garrison informed the Board that FEMA is proposing to change the FIRM maps. Changes are proposed in the reference datum from NGVD to NAVD. This change, she stated, will have a significant impact on the flood elevation in town and on application of the building permit process. She advised that she will continue to monitor the changes. 2. Drainage Update a. Van Lennep -final cost Mrs. Garrison informed the Board that the final cost of the catch basin installation at 2950 Polo Drive was $44,683.58. b. Rogers connection -full permit required Town Manager asked the Board for direction and permission to commence Phase III of the "south town area" drainage project. This would include installation of a catch basin on Gulf Stream Road, connecting to the pipe installed on 2930 Gulf Stream Road, and installing a catch basin in the Town's alley between Gulf Stream Road and Polo Drive, then installing a pipe on Mr. Roger's property connecting from the alley to Polo Drive, then going under the road connecting to the catch -basin and pipe that was installed on the Van Lennep property. She also stated that Mr. Rogers had agreed to cost -share in the project. Commissioner Devitt inquired if the road had to be torn up in order to do this work. Mr. Thrasher said yes and this is the reason why Polo Drive has not been paved as yet. The Board discussed Phase III of the project and decided that more assurance is needed to ensure positive drainage. Commissioner Orthwein moved and Commissioner Hopkins seconded that confirmation from the Town's Engineers is need to determine whether the t pipe is low enough to ensure positive drainage from areas further north on Gulf Stream Road. If confirmation is received, the Commission authorized phase III. It has charm, grace and balance; and, new construction helps maintain that uniqueness, since the Town has rules concerning size, shape and proportion. A motion to approve a Special Exception to reduce the rear setback from 50' to 42'8 " for a one -story portion of the home, based on a finding that the design meets the applicable review standards. B. A motion to recommend approval of a Special Exception to exceed the permitted floor area by 160 feet for unenclosed porch area, based on a finding that the design meets the applicable review standards, subject to correcting the FAR calculations on the plans *. C. A motion to approve the south side setback variance of 1'8, "based on a finding that the request meets the variance review standards. D. A motion to approve a Level III Architectural Site Plan Review, based on a finding that the proposed plans are consistent with applicable review standards, based on the following conditions: I. Approval from the Army Corp of Engineers shall be required prior to any fill being added to the existing cove area on the southwest portion of the site. This shall be secured prior to the issuance of a building permit. 2. The property owner shall dedicate two easements to the Town prior to building permit application: a 10 foot easement along the south property line for drainage purposes, and if needed, an easement along the west property line for annual maintenance of a planned outfall.The property owner shall coordinate the seawall construction and home construction with the Town's replacement of the drainage pipe on the property. The property owner shall be responsible for all costs associated with the seawall. 3. Drainage Plans, prepared by a professional engineer, shall be submitted prior to building permit. Any replacement driveway shall be designed to include a swale, to prevent the ti run -off of drainage onto the road and to facilitate the free flow of drainage across the front of the property 4. The Construction Traffic Management Plan submitted with the application shall be followed during construction. 5. The plans shall be redesigned to incorporate the recommendations in the staff report [see below] and Urban Design Studio report[attached] and shall be resubmitted to the ARPB for approval prior to application for building permit. Basis for Recommendation: Site Plan Review A 2,795 square foot, one -story Gulf Stream Bermuda style residence exists on the property. In 1999, the owner received approval for a second story addition (ARPB #99 -08). The owner has now decided to replace the home with a new two -story residence. The design has several features that do not appear to be consistent with the Bermuda Style, including windows with "Bahamas" shutters over the garage doors and master bath window. Also, the first and second story eave heights are in the discouraged range. Staff has recommended conditions to address these items. In order to make the design more consistent with the Design Manual and Bermuda style, staff recommends that the plans be revised prior to permit application, as follows: ❑ Lower the one -story eave height to 12', and the second -story eave height to 226." ❑ Add additional muntins to the windows, to create smaller panes. ❑ Remove the windows and Bahamas shutters over the garage doors and master bath window. ❑ Revise window design and placement to be more uniform. ❑ Break front picture window into two rectangular windows. ❑ Revise rounded windows to a more traditional fanlight design. ❑ Revise front door way to a Bermuda style, for example a rectangular door with a fanlight above and sidelights. ❑ Remove shutters from garage doors. In order to better distinguish this structure from the other two -story homes on the street, prior to building permit application it is recommended that the owner consider: ❑ Adding a balcony across the full second story at the front of the house, and ❑ Using a different railing design (Bermuda- compatible); one not used on the other homes on the street. ❑ Revising plans to incorporate additional suggestions made in the attached UDS report. Special Exceptions The design appears to meet the review standards for both of the requested Special Exceptions. Site Reconfiguration /Fill The applicant proposes to fill in an existing manmade cove and to extend the seawall to a Point even with the seawall constructed along the property to the south, then angled to meet the seawall to the north. Staff recommends a condition ( #1) that requires Army Corp of Engineers' approval prior to submitting for a building permit. The Town currently has a drainage pipe along the southern portion of this lot. The filling -in of the boat slip will disrupt the drainage in the area. Accordingly, the Town has requested easements that will enable us the remedy this situation. The applicant has agreed to voluntarily donate the easement under specific terms. (Condition #2 addresses this) Variance for South Side Setback Each side setback is proposed at 15 feet. Because the lot is 106 feet wide, the two side setbacks must total 31.8 feet (30% of lot width). The applicant has supplied information on how they believe the request meets the eight mandatory variance findings (included in package on the application form). The ARPB should review these carefully. Although the applicant has not provided a strong hardship argument, the variance is for 1.8 feet and could be considered "de minimus " (insignificant). At this time, the adjacent property to the south is also owned by Delray Ocean Estates. ARPB # 000 -13, page 2 Concerns Regarding Similarities and Scale Due to near -by residents' concerns, the plans were sent to our design consultant, Urban Design Studios (UDS). The UDS report, letter from resident and elevations /roof plans are attached. Code Requirements that must be met prior to issuance of a Building Permit: 1. Unless the home is connected to the private Sewer System, Health Department approval of the septic system will be required prior to issuance of a building permit. 2. The proposed finished floor elevation (8' NGVD) for the home shall be labeled on the plans for the building permit application. 3. Correct the FAR calculations shown on the plans to show the additional 160 S.F. 4. The required mechanical equipment setback is 12; equipment must be screened.
