Cecere presiding- with Mr . Howell and Mr. Willis present The- following business was had to-wit: . Mr . Howell moved to approve the minutes of the previous meeting - seconded by Mr. -Wi'l l'i sand .on unanimous voice vote the: motion I was 'carried . Fire Chief William Berry recommended the Board. a,dvanc..e. Ronald Denton from regular 'fireman to Engineer, effective October 16, -1970-. Mr-. 1 Howell moved the Board approve the promotion, Mr .- . Willis seconded, and on unanimous • voi-ce vote the motion was - - • carried . - - Mr . Willis recommended the Board adopt DeclaratorvResol-ution No. 6.-1970., :vacati ng-a - portion .ofLthe.cf i-rst' alley east of North 13th Street, between North "H" and North 1W" Streets; and set the date for a public hearing for November 12 , 1970, at 10:00 a .m. The portion to be. vacated has never been improved -and is 'not used as an alley .. ; ..C.ost -of. advertising and recording are -to be borne by Mr . Satterfield . Mr . Willis moved the -Board adopt Declaratory Resolution No. 6-1970, Mr . . Howell seconded and on 'unanimous •voice ' vote . the motion was carried .- Councilman Kenneth Paus.t came to discuss the Ride-and--Shop arrangement. with the Bus Company . He said that the downtown merchants had been subsidizing -.the program at $ .20 a ride, • except for an emergency period. during. which they - pai d •$.25 . The agreed period. has expired. and: the merchants are. no longer-: willing to pay the extra $ .05.. He said the Bus Company was not .anxious - to . continue •.the: program. Mr . Cecere said he thought IIIthe program stimulated business . The Board took the problem III under advisement S:ani.tar�,y_ Commissioner Ed ' Ross reported ,that the Sanitary -Commi-ss-ion - has approved rerouting the sewer - from Lincoln Street to Randaph Street,—and recommends .th.e Board :allow.. the contractor • to use- explosives east of Northwest' 1st Street and to the River bank on :-an experimental bas i s,. :wi t:h control equipment ::to .determine the ' size::ofcthe= area affected by the :blast .: The -Gas Company, Water -Company, and Telephone Company representatives said they • had : no objections to the- test area . A gas line will have to be . moved, in any case . to-:al low 'for the- new sewer route Morris Hart, Divi lion ' Engineer -for the Telephone-Company said- he 'was concerned about a sub office - located in the area, but he. did not -object- -to the area in question . A representative of Consulting -Engineers , . Steeg and Associates, 'said he would observe- the- :blasting -and- make his - reports -.tothe Board.. Mr . . Howell. moved the -Board allow the blasting in the designated area, Mr . Willis seconded; and -on unanimous voice .vote the motion was carried . Building Commissioner Ed Gains - recommended the Board allow him to . advertise- for:•bi-ds:"to tear down, the' property - at -,2518 Northwest 16th Street, owned-. by .James Hensley and - condemned . in.-September, 1969 . Notice of condemnation. has, been served on Mr-. Hensley and - - . the Board had notified him to come before it to show. cause why the IIIorder of-. the - Building Commissioner - should . not be .:carr,ied out.. Mr,:- Hensley ;di d. not - appear- or communicate: with the Board many - way, a:l though the- return- receipt was received in the Clerk 's • office. . Mr . Howell .moved_ the Board authorize - and order the- Building Commissioner to proceed to advertise for the demolition of the property, pursuant to statute, Mr-. Willis 'seconded, and on unanimous voice vote the motion was carried . Board of Works Minutes . October 15, 1970 • Page 2 • Robert 13Urton, representing Mr . Charles -Jaffe :of .Sam Jaffe Company, requesti ng cont i nuance'.of the variance on the open , burning which the Board had granted him two months ag.o. Mr . Jaffe had traveled extensively to find a proper incinerator , had found -one, and had been about to sign the contract, when the Gas Company informed. him,- that,, contrary to an. earlier promise, they would not be able to supply the gas for the incinerator due to a. short- age . Mr . Jaffe is now negotiating with the Gas Company, asking them to reconsider , and they have promised him a decision within two' weeks- • Mr . Jaffe di-d, not::choose the type of. incinerator which can handle liquid 'waste 'because .of prohibitive cost . Mr.. Bur-ton said that the Board should allow the .continuance because Mr . Jaffe is doing his best to comply with the .ordinance ;and is acting in good faith . Mr . Cecere said' that Mr . Jaffe should impress upon the_ Gas Company officials that the problem is urgent and a decision should be given within a week. . He said the Board would ask Gas Company representatives to be present at the next meeting to discuss -the problem. - Commissioner Ross reported that-building material tends. to use up the landfill unnecessarily and should not be dumped there . Mr . Cecere said he thought the Landfill was for everyone ' s use. Commissioner Ross explained -that landfill sites. are becoming increasingly difficult to find, . si.nce it is used primarily to waste which decomposes and could pollute waterways . To fill it with non=decomposing' 'material is using the landfill unnecessarily when sites are available where the -Material could be used for fill . Engineer Willis said that -he has had several requests from citizens for -fi 1-1 material . • He offered the services of his office to keep track of available sites for dumping. building materials . James Weichman appeared to report -that he and -two other realtors had been appointed by-the Circuit Court' Judge :to appraise two lots at 17th and North "J" Street , owned by the City . He -.said they had been asked to reconsider their appraisal ,- which they are willing to do, provided they would have a wr.itten .guarantee that the Light Plant wool d• not: be required to move : thesubstat i on . Mr : Cecere said such a guarantee could be given . . • Mr . Wei.chman also inquired whether a real estate commission would be paid for services ' rendered in connection with property at South 5th and "A" Streets , which the :City bought and which he negotiated . Mr . Cecere said that there is no legal obligation to pay, since no contract .had been entered into, but the Board Would consider making -a payment 'since 'a service had. been rendered, and would take the problem under advisement . • Mr . Howell moved the . Board adopt Declaratory Resolution No. 4-1970 asking the ' Circuit Court Judge to 'appoint appraisers for property located in the 1800 block of West Main Street, on the north side, Mr . Willis seconded, and on unanimous voice. vote the motion was carried . Mr . Willis moved the Board adopt Declaratory Resolution: No. 3 -1970, changing the name' of 'North 31st Street between• Park Avenue and Parkwood 'Drive to Glenwood Drive, . Mr . Howell seconded and on unanimous voice vote .the motion was carried . Representatives of Aid Ambulance Service from Indianapolis discussed their take-over of the ambulance service within a day .
