CITY OF RICHMOND', INDIANA, AUGUST 20, 1970
The Board of Public Works and Safety of the City of Richmond,
Indiana, met in regular session in the Municipal Building, August
20, 1970, at the hour of 9: 00 a .m. Mr . Cecere presiding with
Acting City Controller , Esther Thomas , attending, Field Engineer
Ralph Willis sitting in, in an advisory capacity .
Miss Thomas moved to approve the minutes of the previous meeting,
seconded by Mr . Cecere and on unanimous voice vote the motion
was carried .
Lloyd Bertsch, 1801 S . 13th Street, complained of water overflowing
onto his property from an open ditch at S . 16th and "L" Street .
Street Commissioner Elmer Toschlog said that there is more water
than the ditch can handle. He said the City has cleaned out the
parts of the ditch it owns , the rest is on private property . He
said he is planning to work. on the ditch and widen it this after-
noon . The only real solution is a storm sewer in the area . The
Engineer said he would conduct a storm sewer study from S . "Q"
Street to the bridge on S . 13th Street .
Leslie Philhower , 117 S.W. "F" Street , stating complaints about
high school students ' parking in front of their homes and littering
broken glass about the area . He said he has contacted the school
board without any results , although he feels the School Board
could take action. Mr . Cecere explained that the Board could
restrict parking in the area but this would apply to the residents
as well . Mr . Philhower agreed that this would be no solution,
since most of the people in the area have no garages or driveways
in which to park . Traffic Captain Paul Martin said he would
study the situation and try to recommend possible remedies .
Assistant Police Chief Major Doren recommended that Richard Andrews
be promoted from probationary to regular patrolman, Officer
Andrews having successfully passed his probationary year . This
promotion is to be effective August 13, 1970 . Miss Thomas moved the
Board approve the promotion, seconded by Mr . Cecere and on
unanimous voice vote the motion was carried .
Miss Thomas mved the Board approve the request of the residents
of Locust Lane to close the Street on Labor Day from 3 : 30 until
dark from 24th Street to S. "A" St . , for a block party, seconded
by Mr . Cecere and on unanimous voice vote the motion was carried.
Mr . Cecere read the following letter :

Dear Madam:
I am hereby advising the City of Richmond through its City
Clerk that a baseball was either thrown or hit from the
Municipal Park on Northwest 13th Street on July 3, 1970 that
went through our large plate glass window.
This window is in our building which is located across from •
the Municpal Ball Park and the address being 220 Northwest
13th Street . The bill in the amount of $161 . 16 is attached.
I am holding the City responsible for this loss and request
that you place it in the proper channels for approval and
payment .
I want to advise the proper that for many years I have carried
Plate Glass Insurance and the Insurance Companies have written
this for me have paid several losses . I understand that at
no time did the Insurance Company pursue those responsible,
however , I have paid my insurance, changed to two different
companies , and as of May, 1970, it was cancelled due to
excessive losses .

The experience we have been suffering from the baseball and a
few other broken windows has resulted in this action.
On Monday evening of this week, which was August 3rd, another
baseball struck the corner of our front window, however, it
did not crack it at that time.
I know this is of a serious enough situation that in the event
a passer-by would be struck with one of these balls , the City
could have a Bodily Injury claim on their hands .
I want it to go on record and request the City to check into
this problem to avoit it happening on a regular basis . I
believe a change in the screening or the position of Home Plate
would help the City correct this .
I want to thank you for giving this claim youriimmediate
attention and look forward to receipt of your check in order that
this bill may be paid .

Mr . Cecere said. .the complaint should be referred to the Park
Department . He advised Mr . McCurdy that complaints against the City
must be filed within 60 days .
The Board signed a change-order in a contract with the James H .
Drew Corp. concerning signal installations , resulting in an addition
of $2 ,287.00 .
Miss Thomas moved the Board approve a request from the Weights
and Measures Inspector to present a resolution to Council for a
transfer of funds within his department as follows : $50 .00 to
be transferred from Official Records to Gasoline, since he
would otherwise not have enough money to pay for gasoline for
the remainder of the year , seconded by Mr . Cecere and on unanimous
voice vote the motion was carried .
Street Commissioner Toschlog recommended the Board award the
contract for street department trucks to Kurdy ' s Chevrolet for
$9, 121 . 10 as the lowest and best bids . Miss Thomas moved the
Board award the contract as recommended, seconded by Mr . Cecere
and on unanimous voice vote the motion was carried .
Commissioner Toschlog recommended the Board approve the presenta-
tion to Council of the following transfers within the Motor
Vehicle Highway Budget : By Ordinance: $50 .00 from repair of
equipment to insurance, needed to handle increased insurance
premiums on existing policies ; also by Ordinance: $2 ,000 .00
from Salary-Inventory Clerk, $10,000 .00 from Payrolls,, $550 .00
from Tech . Advr . - (City Engr . ) , $50 .00 from Frt . , Exp. , Drayage,
$10 .00 from Postage, $1 , 500 .00 from Elect . Current, $100 .00
from Water , $1 ,000 .000from Rep. Bldg . and Structure, $150 .00
from Rep. of Equip. , $500 .00 from Rent to Equip. , $1 ,000 .00 from
Gasoline, $300 .00 from Oil , $500 .00 from Tires and Tubes, $15 .00
from Medical , Surgical , Dental , $1 ,000 .00 from Other Supplies ,
$2 ,000 .00 from Traffic Signs , Guides to Sts . , Alleys, Curbs ,
Sidewalks , needed to continue the current street repair program;

to Streets , Alleys , Curbs, and Sidewalks , in order to continue
the current street.. repair program. Miss Thomas moved the Board
approve the transfers , seconddd' by Mr . C.ecere and on unanimous
voice vote the motion was carried.

Mr . Cecere read a letter from Lee Cook, 917 N . 14th St . , complain-
ing about a tree he felt should be taken down . The Board referred
the complaint to the Park Department .
A second tree complaint from Marie Bailey, 1209 S . 4th Street ,
was read . The Board decided that this tree is on private property
and does not fall under the jurisdiction of the Board, although
the Board ordered the Clerk to advise Mrs . Bailey that should
the residents decide to enter into a Barrett Law project to
build a sidewalk, the tree would have to come down and the
problem would be solved .
Miss Thomas moved the Board approve the final assessment for
Improvement Resolution 1092-1970 (an alley between S .W. 10th
and S.W. 11th St . ) and set the date for a public hearing for
Sept . 17 , 19.70, 10: 00 a .m.
The took up the complaint by Councilman Paust that junk cars
are not being moved from an alley between S . llth and S. 12th
Streets . Planning Director Rick Freeman said that he ma'rks the
cars but lately they have not been moved . Collection Commissioner
Frank Robinson explained that the moving of cars is being done
with spare-time help, which has lately been tied up with repair -
ing equipment . He hopes to start moving cars again on Monday
and get back on schedule.
Sanitary Commissioner Ed Ross explained that the source of the
odor in the Johns-Manville area comes from Johns-Manville
discharge into the stream. He said he has talked to Johns-Man-
ville officials about this and they had recently installed equip-
ment which had been approved by the State Board of Health, and
which they had been given to understand would do the job of
doing away with the pollution . However, the equipment did not
live up to its promis and although they have ordered new equip-
ment, it cannot be installed until January 1 . The only alterna-
tive would be to shut down operations . Commissioner Ross felt
that the Johns-Manville people acted in good faith and did
everything possible -to eliminate the odor .
Clifton Sparks , 1316 S . "T" Place and Ben Griffin, 1307 S . "T"
Place, complained about repeated floods through their property
and into their homes . ; Mr . Cecere said that all the flood
complaints have been the result of there being no storm sewer
in the area . Engineer Willis suggested the possibility of
building a curb along the street . He, said he would check the
situation, to see if the curb could give temporary relief to
the flood problem.
